When Process Affects Punishment: Differences In Sentences After Guilty Plea, Bench Trial, And Jury Trial In Five Guidelines States, Nancy J. King, David A. Soule, Sara Steen, Robert R. Weidner May 2005

When Process Affects Punishment: Differences In Sentences After Guilty Plea, Bench Trial, And Jury Trial In Five Guidelines States, Nancy J. King, David A. Soule, Sara Steen, Robert R. Weidner

Vanderbilt Law School Faculty Publications

The research reported in this Essay examines process discounts-differences in sentences imposed for the same offense, depending upon whether the conviction was by jury trial, bench trial, or guilty plea-in five states that use judicial sentencing guidelines. Few guidelines systems expressly recognize "plea agreement" as an acceptable basis for departure, and none authorizes judges to vary sentences based upon whether or not the defendant waived his right to a jury trial and opted for a bench trial. Nevertheless, we predicted that because of the cost savings resulting from waivers, judges and prosecutors in any sentencing system would ensure that guilty …

Gay Politics And Precedents, Frank B. Cross May 2005

Gay Politics And Precedents, Frank B. Cross

Michigan Law Review

One can find many analyses of the development of gay rights law in America but none are so illuminating as Daniel Pinello's in his book Gay Rights and American Law. More significantly, while it offers a superb understanding of the recent record of gay rights litigation, the book provides a fine-grained and sophisticated understanding of judicial decisionmaking in this important and developing area of the law. Indeed, the value of the book for students of judicial decisionmaking even transcends its value for students of gay rights jurisprudence. Quantitative empirical studies of judicial decisionmaking, well established in political science, have …

Is There A Future For Leniency In The U.S. Criminal Justice System?, Nora V. Demleitner May 2005

Is There A Future For Leniency In The U.S. Criminal Justice System?, Nora V. Demleitner

Michigan Law Review

The spring 2004 release of the gruesome pictures of sexual humiliation and torture at Abu Ghraib prison outside of Baghdad revealed how some U.S. troops, intelligence officers, and private contractors treated Iraqi prisoners taken during and after the war. High-ranking government officials may have condoned, if not encouraged, the abuses. Only reluctantly have they agreed to extend protections customarily accorded civilians and military fighters during a war to individuals detained in Iraq and Afghanistan. As Congressional investigations appear to have stalled, military inquiries have been manifold but resultless. Only a handful of low ranking soldiers have been court-martialed, and a …

Women's Substance Abuse Treatment With Supplemental Couple's Therapy: Changes In Women's Levels Of Intimacy And Autonomy In Relation To Treatment Outcomes By Treatment Modality, Charles N. Davis May 2005

Women's Substance Abuse Treatment With Supplemental Couple's Therapy: Changes In Women's Levels Of Intimacy And Autonomy In Relation To Treatment Outcomes By Treatment Modality, Charles N. Davis

All Graduate Theses and Dissertations, Spring 1920 to Summer 2023

The current study is a secondary analysis of a National Institute of Drug Abuse (NIDA) study in which 122 women received treatment for their substance abuse problems. Three models of substance abuse treatment were administered. One included standard substance abuse treatment alone and two models included supplemental couple's therapy in addition to standard treatment. The current study examined the significance of the relationship between changes in the women's levels of intimacy and autonomy, during and after treatment, and their treatment outcomes according to the treatment modality they received.

It was hypothesized that the relationship would be significant in that levels …

Marital Commitment And Religiosity In A Sample Of Adults In Utah, Sharon S. Harris

All Graduate Theses and Dissertations, Spring 1920 to Summer 2023

This study examined the relationship of three types of martial commitment and religiosity factors in a random sample of I ,316 Utah adults. Participants were surveyed to assess attitudes of marriage, divorce, and marriage education. A lack of commitment was cited by 83% of divorced adults as a major factor for their divorce. The level of commitment to spouse, commitment to marriage, and constraint commitment was determined by extrapolating items from the 2003 Utah Marriage Movement Statewide Baseline Survey. Religiosity included measures of the frequency of church attendance, church affiliation, and religious values. Regression analyses that included socio-demographics showed the …

Juvenile Fear Of Crime And Attitudes Towards The Police: The Effect Of Implementing A School Resource Officer Program In Alaska High Schools, Sean A. Case

All-Inclusive List of Electronic Theses and Dissertations

This paper presents data concerning the effect uniformed police officers have on attitudes towards the police and fear of crime within the high school setting. Two identical surveys were administered to 522 high school students at two periods during a school year. The primary purpose was to determine whether placing uniformed police officers, called School Resource Officers, in high schools would improve attitudes towards the police and reduce the fear of crime. Although opinions towards the police were positively affected and the fear of crime was reduced, neither was affected significantly. The primary implication drawn from this research is that …

Pursuing Justice For The Mentally Disabled, Grant H. Morris May 2005

Pursuing Justice For The Mentally Disabled, Grant H. Morris

San Diego Law Review

This Article considers whether lawyers act as zealous advocates when they represent mentally disordered, involuntarily committed patients who wish to assert their right to refuse treatment with psychotropic medication. After discussing a study that clearly demonstrates that lawyers do not do so, the article explores the reasons for this inappropriate behavior. Michael Perlin characterizes the problem as ?sanism,? which he describes as an irrational prejudice against mentally disabled persons of the same quality and character as other irrational prejudices that cause and are reflected in prevailing social attitudes of racism, sexism, homophobia, and ethnic bigotry. The Article critiques Perlin?s characterization …

Job Satisfaction Among United States Air Force Security Forces Personnel Post-1997 Career Field Merger, James Harrison Popphan May 2005

Job Satisfaction Among United States Air Force Security Forces Personnel Post-1997 Career Field Merger, James Harrison Popphan

All-Inclusive List of Electronic Theses and Dissertations

Research was conducted to determine factors contributing to job satisfaction among US Air Force Security Forces personnel. Previous research conducted prior to major structural changes within the career field in 1997 and increased operations tempo due to the Global War on Terror was of questionable current pertinence. Job satisfaction has been shown to directly affect retention and performance. Retention is extremely important within the career field due to a personnel shortage of 8,000 troops. The current research closely followed the research design used by Michael Reiner to assess job satisfaction in the career field in 1997, and compares current findings …
