Ordeal By Trial: Judicial References To The Nightmare World Of Franz Kafka, Parker B. Potter Jr. May 2005

Ordeal By Trial: Judicial References To The Nightmare World Of Franz Kafka, Parker B. Potter Jr.

The University of New Hampshire Law Review

[Excerpt] "Franz Kafka’s novel The Trial is firmly entrenched in the modern consciousness as an exemplar of judicial indifference to the most basic rights of citizens to understand the nature of criminal proceedings directed against them. Yet, Kafka was not mentioned in an American judicial opinion until forty years after his death in 1924. Since the mid 1970s, however, Kafka’s name has appeared in more than 400 opinions written by American state and federal judges. Judges have used Kafka to criticize bureaucratic absurdity, unfair tribunals of all sorts, and even their own colleagues on the other side of an appellate …

Pluralizing International Criminal Justice, Mark A. Drumbl May 2005

Pluralizing International Criminal Justice, Mark A. Drumbl

Michigan Law Review

From Nuremberg to The Hague scours the institutions of international criminal justice in order to examine their legitimacy and effectiveness. This collection of essays is edited by Philippe Sands, an eminent authority on public international law and professor at University College London. The five essays derive from an equal number of public lectures held in London between April and June 2002. The essays - concise and in places informal - carefully avoid legalese and arcania. Taken together, they cover an impressive spectrum of issues. Read individually, however, each essay is ordered around one or two well-tailored themes, thereby ensuring analytic …

Equality, Objectivity, And Neutrality, Alafair S. Burke May 2005

Equality, Objectivity, And Neutrality, Alafair S. Burke

Michigan Law Review

When is homicide reasonable? That familiar, yet unanswered question continues to intrigue both courts and criminal law scholars, in large part because any response must first address the question, "reasonable to whom?" The standard story about why that threshold question is both difficult and interesting usually involves a juxtaposition of "objective" and "subjective" standards for judging claims of reasonableness. On the one hand, the story goes, is a "subjective" standard of reasonableness under which jurors evaluate the reasonableness of a criminal defendant's beliefs and actions by comparing them to those of a hypothetical reasonable person sharing all of the individual …

Good Mental Health Key To Success In Traumatic Job, Carla Kimbrough May 2005

Good Mental Health Key To Success In Traumatic Job, Carla Kimbrough

College of Journalism and Mass Communications: Faculty Publications

Sometimes what we do is no fun. We cover devastation, the horrors of war and tragedy simply because we must. We record history. We tell the stories of life and of death. As journalists, that's what we are called to do.
In this rough and tumble world, we are charged with being ready for anything. The wise among us carry a change of clothes in our trunks, a passport in our top drawer and a can-do spirit in our souls. We are journalists.

The Matamoros “Drug Cult” Murders: Borderland Perceptions And The Shaping Of Belief, Victor Gomez May 2005

The Matamoros “Drug Cult” Murders: Borderland Perceptions And The Shaping Of Belief, Victor Gomez

Theses and Dissertations - UTB/UTPA

Media coverage of the Matamoros “drug cult murders” highlighted the abduction and murder of twenty-one year old college student, Mark Kilroy, while enhancing negative images of Mexican people. What makes the Kilroy coverage a watershed in history is how racism played a part during and after print media coverage of the discovery at Santa Elena. Through U.S. media especially, Anglo beliefs of cultural backwardness, Mexican police corruption, and religious misrepresentation are expressed by way of stereotypes held about Mexican border people. In this day and age, U.S. media uses these superficial beliefs to portray one group of people, and enhances …

Domestic Violence Screening Education And Implementation In Nursing Station In Northern Manitoba, Sherie Anne Wray

Theses and Dissertations

Domestic violence (DV) has been around for many years. Today and for the last several decades, it had become increasingly known as a large social problem. This project gave the nurses working in the federal nursing stations of isolated northern Manitoba information and education on DV. The aim of this project was to improve the nurses' ability to screen, detect, communicate, support, and refer victims ofDV to the appropriate resources. This project was based on two parts: an education package and a telephone conference that took place with the nursing stations . The education package consisted of a variety of …
