Judicial Impediments To Legislating Equality For Same-Sex Couples In The European Union, Bruce Carolan Jan 2005

Judicial Impediments To Legislating Equality For Same-Sex Couples In The European Union, Bruce Carolan

Articles

In the United States, the state and federal courts often has been the first port of call for activists hoping to advance the cause of same-sex couples. State courts, in particular, have ruled on occasion that guarantees of equal rights or due process contained in state constitutions require recognition of same-sex marriage or civil unions. These court decisions, in turn, have sparked a legislative backlash. Legislators and voters have rejected these court decisions by amending state constitutions to limit the rights of same-sex couples. The European Union represents, in some ways, the mirror image of the United States experience. The …

By conceptualizing spirituality in educational leadership, this qualitative study seeks to explore successful educational leaders' use of spirituality to strengthen their effectiveness as it relates to school and their performance. A Study Of Feelings Of Alienation Among Relief Teachers Servicing Western Australian Government Metropolitan Primary Schools, Ralph G. Lunay

Theses: Doctorates and Masters

It is perhaps fair to say that the relief (substitute) teacher should be viewed as an extremely important educational resource, Reviewed literature spanning the better part of twenty years indicates that in parts of Australia, the United Kingdom and the United States, many students spend as much as one full year (or more) of their K-12 education having curriculum delivered to them by these individuals. Unfortunately, the literature also indicates that many relief teachers are still viewed by many as less than "real" teachers in terms of perceived competence, skill and capability. In addition to this, the existence of a …

The Relationship Between Self-Esteem, Self-Efficacy And Sense Of Belonging In Young Adolescents At School, Elisabeth Freeman Jan 2005

The Relationship Between Self-Esteem, Self-Efficacy And Sense Of Belonging In Young Adolescents At School, Elisabeth Freeman

Theses : Honours

Research emphasises the importance of adolescents' psychological sense of belonging in relation to academic, motivational, psychosocial, developmental, and behavioural outcomes, particularly during transition to high school. However, adolescents' adjustment during transition period does not occur in isolation, it occurs in conjunction with normative biopsychosocial change-related effects. As most of adolescents biopsychosocial needs are negotiated in high school, the school's social context assumes a fundamental role in facilitating successful adolescent adjustment, and school belonging. Features of the high school context such as perceived peer, parent, and teacher support have an influence on adolescents' perceived belonging. Similarly, the educational values, in terms …

Actor And Partner Effects Among Marital Dyads In Retirement Adjustment And Well-Being, Julie Guenette Howard Jan 2005

Actor And Partner Effects Among Marital Dyads In Retirement Adjustment And Well-Being, Julie Guenette Howard

Dissertations and Theses

Our understanding of and interest in how retirement impacts the lives of individuals have grown over the past 20 years. Studies to date have ranged from small, convenience samples composed primarily of men to large, national longitudinal samples of men and women from different professional and socioeconomic backgrounds. There is consensus in the literature that older adults generally function better with a partner; however, gaps remain. We know little about the impact of retirement beyond the individual, although research in other areas on couples has produced evidence of crossover and contagion effects relative to depression and other outcomes, including absenteeism, …

The Impact Of Events In The Immediate Aftermath Of Suicide On Family Members' Bereavement Experiences, Kelly J. Botha

Theses: Doctorates and Masters

Suicide remains a leading cause of death in Australia. Consequently, a considerable proportion of the population is, or will be, bereaved due to suicide. These individuals are referred to as survivors of suicide. Literature suggests bereavement is a significant risk factor for adverse health outcomes. The question of whether or not bereavement after suicide, as opposed to other modes of death, renders individuals more susceptible to enduring and complicated grief reactions remains unclear. Numerous key variables have been found to influence the nature, intensity and duration of the grief process. Variables that are likely to be associated with poor bereavement …

The Changing Face Of Rural General Practice: An Ethnographic Study Of General Practitioners And Their Spouses, Angela Durey Jan 2005

The Changing Face Of Rural General Practice: An Ethnographic Study Of General Practitioners And Their Spouses, Angela Durey

Theses: Doctorates and Masters

Rural general practice is general practice at its best: a comment by one GP interviewed for this study was echoed by colleagues who viewed their work in a rural setting as challenging, diverse, rewarding and satisfying. Despite reported difficulties associated with rural general practice, many GPs argued that the benefits outweigh the disadvantages. Few wanted to leave. Nonetheless, too few Australian trained GPs are willing to move from cities to work in the country. Consequently, overseas trained doctors have been recruited to fill vacancies or nurses provide health services in communities unable to attract a GP.

The research included defining the structure of urban areas, investigating environmental impacts …

Reforming Higher Education In Saudi Arabia: The Use Of Telecommunications Technology, Abdullah Altowjry Jan 2005

Reforming Higher Education In Saudi Arabia: The Use Of Telecommunications Technology, Abdullah Altowjry

Theses

Internet technology has become a powerful tool since its advent. Online learning is a byproduct of Internet usage and is instrumental in higher education. In the United States, the use of online learning, also known as distance learning, is widespread. It is used in almost all educational institutions. Even third world countries, which are traditionally lagging behind in any educational or sociological enterprise, are now attempting to catch up with distance learning education. Some educational institutions in the Middle East, for example, have been using distance learning in place of traditional classroom instruction. In Saudi Arabia, there is a great …

A Comparison Of Reputation-Based Trust Systems, John Folkerts Jan 2005

A Comparison Of Reputation-Based Trust Systems, John Folkerts

Theses

Recent literature contains many examples of reputation systems which are constructed in an ad hoc way or rely upon some heuristic which has been found to be useful. However, comparisons between these reputation systems has been impossible because there are no established methods of comparing performance. This paper introduces a simulation framework which can be used to perform comparison analysis between reputation models. Two reputation models, one from Abdul-Rahman and Hailes (ARH) [1], and one from Mui, Mohtashemi, and Halberstadt (MMH) [17] are implemented and compared with regard to accuracy, performance and resistance to deception. In order to improve performance …

“The Indispensable Basis Of Democracy”: American Catholicism, The Church-State Debate, And The Soul Of American Liberalism, 1920–1929, Zachary R. Calo Jan 2005

“The Indispensable Basis Of Democracy”: American Catholicism, The Church-State Debate, And The Soul Of American Liberalism, 1920–1929, Zachary R. Calo

Scholarly Works

Several recent works of scholarship explore how Establishment Clause jurisprudence has been shaped by broader political debates over the role of religion in public life. This literature focuses on the politics of anti-Catholicism, particularly during the early years of Establishment Clause jurisprudence in the1940s and 1950s. While not questioning the centrality of this period to the historical narrative, this Note argues that the political contest over church and state took shape in an earlier debate over the compatibility of Catholicism and the Constitution during the 1920s. The Church’s response to the anti-Catholicism of this period was of particular importance. Catholic …

The Civilization Of The Criminal Law, Christopher Slobogin Jan 2005

The Civilization Of The Criminal Law, Christopher Slobogin

Vanderbilt Law Review

The boundaries of the criminal justice system are eroding. A vast amount of relatively innocuous behavior is now criminalized. The line between criminal penalties and administrative sanctions is dissolving, as criminal law relaxes its mens rea requirements and government bureaucracies aggressively pursue regulatory violations. Distinctions between criminal and civil forfeiture, contempt, and deportation proceedings have been vanishingly subtle for some time. Perhaps the most serious assault on the integrity of today's criminal justice system, however, is the increasing prominence of the "dangerousness criterion" as justification for confinement by the government. Governmental deprivations of liberty have usually been the province of …

By Any Other Name?: On Being “Regarded As” Black, And Why Title Vii Should Apply Even If Lakisha And Jamal Are White, Angela Onwuachi-Willig, Mario L. Barnes

Faculty Scholarship

Forty years after the passage of Title VII, scholars Marianne Bertrand and Sendhil Mullainathan reported the results of their groundbreaking study, Are Emily and Greg More Employable Than Lakisha and Jamal? A Field Experiment on Labor Market Discrimination. Their study revealed that simply having an African American-sounding name significantly decreased one's opportunity to receive a job interview, regardless of occupation or industry. The results of Bertrand and Mullainathan's investigation raise critical questions about the effectiveness of Title VII as a remedy for race discrimination in the hiring market today, especially as employment discrimination has evolved into different forms. As shown …

Two Theories Of Fairness, Nathan Schneider Jan 2005

Two Theories Of Fairness, Nathan Schneider

LSU Master's Theses

In A Theory of Justice, John Rawls argues that justice is to be understood as fairness. The theory of justice as fairness is an ethical theory which argues that broad principles are able to capture the nature of what constitutes a just society. Rawls argues that all that is required for a society to be just is for it to be fair. A just society is one which has institutions which protect individual rights and liberties of all citizens and has a pattern of distribution of resources. Rawls' institutional approach to justice has one problem. Rawls' theory of justice as …

Toward A Construct Validation Of The Louisiana School Analysis Model Instructional Staff Questionnaire, Nikki Bray Clark Jan 2005

Toward A Construct Validation Of The Louisiana School Analysis Model Instructional Staff Questionnaire, Nikki Bray Clark

LSU Doctoral Dissertations

This study assessed the construct validity of the School Analysis Model (SAM) Instructional Staff Questionnaire. Construct validation was necessary for several reasons. First, it has not been possible to obtain evidence of the latent factor structure of this key component of the School Analysis Model (SAM). A factor analysis using data collected with the questionnaire was conducted to assess and identify the underlying factor structure of the instrument. Second, there is no evidence that the constructs measured by the SAM are associated with attributes of school performance further empirical analysis was done to determine if latent constructs contained within the …
