Legal Reasoning, Phoebe C. Ellsworth Jan 2005

Legal Reasoning, Phoebe C. Ellsworth

Book Chapters

For more than a century, lawyers have written about legal reasoning, and the flow of books and articles describing, analyzing, and reformulating the topic continues unabated. The volume and persistence of this "unrelenting discussion" (Simon, 1998, p. 4) suggests that there is no solid consensus about what legal reasoning is. Legal scholars have a tenacious intuition - or at least a strong hope - that legal reasoning is distinctive, that it is not the same as logic, or scientific reasoning, or ordinary decision making, and there have been dozens of attempts to describe what it is that sets it apart …

Betting On Democracy: Electoral Ritual In The Philippine Presidential Campaign, Filomeno V. Aguilar Jr Jan 2005

Betting On Democracy: Electoral Ritual In The Philippine Presidential Campaign, Filomeno V. Aguilar Jr

History Department Faculty Publications

This article ofers an analysis of the ritual character of Philippine elections for national positions, particularly for the presidency. It is argued that the structuring of the electoral complex is akin to a ritual, specifically, a ritualized gamble or game of chance. The cultural figuration of elections is traced to long-term historical processes. The broad insights on Filipino political culture are supported as well as expanded by data collected by the lnstitute of Philippine Culture (PC), Ateneo de Manila University, from sixteen focus group discussions conducted nationwide before national elections were held on 10 May 2004.

Engaged And Engaging Science: A Component Of A Good Liberal Education, Judith A. Ramaley, Rosemary R. Haggett Jan 2005

Engaged And Engaging Science: A Component Of A Good Liberal Education, Judith A. Ramaley, Rosemary R. Haggett

Higher Education

We live in a period of rapid and complex socioeconomic change. The forces driving this change are reshaping the educational landscape in ways that we are only beginning to understand. Many recent reports and books, including the 2002 report from the Association of American Colleges and Universities (AAC&U), Greater Expectations: A New Vision for Learning as a Nation Goes to College, have explored the implications of these changes and have identified growing gaps between the intentions and assumptions of faculty, the actual experiences of students, and the demands of the workplace. The lack of clarity of purpose in undergraduate education …

Afterword - Outsider Citizenships And Multidimensional Borders: The Power And Danger Of Not Belonging, Pedro A. Malavet

UF Law Faculty Publications

In this closing for the LatCrit VIII symposium, I adopt a collective view of the articles, and attempt to develop how the themes discussed in them fit within LatCrit scholarship. I will then interrogate the future of our enterprise by discussing the danger of succumbing to the seduction of the real or perceived need "to reinvent the wheel," or at least to clothe ideas in overly-developed language. Last, the Conclusion discusses how LatCrit scholarship is both promoted and challenged by the articles published here. I further include some suggested institutional responses to the opportunities for mentoring and nurturing that I …

Black Protectionism As A Civil Rights Strategy, Katheryn Russell-Brown Jan 2005

Black Protectionism As A Civil Rights Strategy, Katheryn Russell-Brown

UF Law Faculty Publications

This Article has identified and outlined the parameters of Black protectionism, a practice used by African-Americans to protect prominent community members who have been charged with criminal or unethical activity. This practice took root during slavery-during a time when a false or minor charge against one African-American could result in death or great bodily harm to him and scores of other African-Americans. History has cultivated a culture of Black mistrust of Whites in particular and mainstream society in general. This suspicion is reinforced with the continued disparate treatment of African-Americans within the criminal justice system. History and contemporary conditions explain …

Raza Womyn Engaged In Love And Revolution: Chicana/Latina Student Activists Creating Safe Spaces Within The University, Anita Tuerina Revilla

Cleveland State Law Review

My own and other research shows that Queer/Chicana/Latina college students who come from disadvantaged backgrounds or marginalized communities to the university often engage in a process of resistance to oppressive practices and environments within those institutions, even while continuing their education. While a higher education can be a form of liberation for many of these women, it can simultaneously be oppressive to some. As women learn how to negotiate both privilege and oppression in the college setting, they develop tools for understanding their conditions. One of these tools is political and social consciousness, which is often internalized and acted upon …

Changes In Gender Ideology Among Professional Women And Men In Cuba Today, Marta Nunez Sarmiento Jan 2005

Changes In Gender Ideology Among Professional Women And Men In Cuba Today, Marta Nunez Sarmiento

Cleveland State Law Review

This presentation summarizes the reflections of what it means to be women and men in Cuba today, among a group of Havana professionals. I asked them to emphasize the influence in this process of women's employment and decision making among women, two citizen rights which have been strongly promoted in Cuba in the last forty years. I also asked them to think about the socialization processes, which took place in Cuba and which contributed to these changes. Therefore, this paper is divided into two main topics: First, changes in gender ideology among Cuban professional men and women under the influence …

Reparations For Mexican Braceros - Lessons Learned From Japanese And African American Attempts At Redress , Ronald L. Mize Jr. Jan 2005

Reparations For Mexican Braceros - Lessons Learned From Japanese And African American Attempts At Redress , Ronald L. Mize Jr.

Cleveland State Law Review

The U.S.-Mexico Bracero Program, 1942-1964, was designed originally to be a war-time labor relief measure that brought Mexican laborers to the United States to work in the agricultural and railroad industries. Over the past six years, I have conducted field research in Colorado and California with those who were most directly impacted by the Bracero Program - the formerly contracted Mexican workers. During the summer of 2002, my research was submitted as expert testimony on behalf of Braceros in a class action lawsuit associated with the Bracero savings program. The ten percent deducted from workers' paychecks is, from my research, …

Prenuptial Agreements: A New Reason To Revive An Old Rule, Jeffrey G. Sherman Jan 2005

Prenuptial Agreements: A New Reason To Revive An Old Rule, Jeffrey G. Sherman

Cleveland State Law Review

This article is divided into five parts. The first part discusses the justification for our society's continued promotion of the institution of marriage. The second discusses why prenuptial agreements have become so widespread. The third gives an account of American courts' shift from rejecting prenuptial agreements to routinely enforcing them. The fourth presents my argument for treating as inequitable per se the enforcement of prenuptial agreements. And the fifth explores how the adoption of my view of prenuptial agreements might affect the popularity of marriage.

Stranger Within, Anniina Suominen Jan 2005

Stranger Within, Anniina Suominen

Journal of Social Theory in Art Education

I base my teaching philosophy on the continuous self-directed learning of an individual. My goal is to help my students to learn to problematize their perception, their ways of thinking, their understanding of themselves, and their satisfaction with achieved learning goals. I support my students in their journeys of becoming critical searchers and inquirers of knowledge, visuality, and perceived reality. Although it is apparent they have learned to question authority and pre-given role and behavior models, I watch them searching for shortcuts for the answers within the complex structure of too many potential solutions.

Visual Culture And Teenage Girls: Unraveling “Cultural” Threads Tied To “Self” And “Other”, Carrie Markello Jan 2005

Visual Culture And Teenage Girls: Unraveling “Cultural” Threads Tied To “Self” And “Other”, Carrie Markello

Journal of Social Theory in Art Education

Visual culture is prevalent in almost every aspect of our lives. We take photos with our cell phones, read magazines brimming with full color images, visit art museums, download streaming video, watch MTV, and scan street signs to find our favorite fast food restaurant. One hundred years ago, except for visiting art museums and reading magazines, these activities were nonexistent. As the twentieth century progressed, visual culture has increasingly been disseminated through new technological developments. In the sixties, Marshall McLuhan forecasted the impact of media upon our changing world. "The medium or process, of our time-electronic technology-is reshaping and restructuring …

A Household Probability Model For The Purchase Of A New Suv, 1998-2002, Keith Eugene Brunton Jan 2005

A Household Probability Model For The Purchase Of A New Suv, 1998-2002, Keith Eugene Brunton

Masters Culminating Experiences (1993-2011)

This project suggests that SUV buyers have significantly different characteristics than other automobile buyers. Drawing data from the Consumer Expenditure Survey for 1998 through 2002 and employing a binomial logistical regression technique, this project identifies the determinants that significantly influence the household’s decision to purchase a new sport utility vehicle (SUV). Market trends (growth in the SUV market or other unmeasured factors), the reference person’s age (the household’s preferences based upon their position in the family life cycle), the reference person’s education level (general household preferences), income (the flow of resources into the household), region (demographic differences and needs based …

Migratory Movement: The Politics Of Ethnic Community (Re) Construction Among Creoles Of Color, 1920-1940, Andrew Jolivétte

Ethnic Studies Review

This article considers the social and economic conditions under which Creoles of Color left the state of Louisiana from 1920-1940.1 Because Creoles in the years following 1920 were legally reclassified as black, many lost their land, social and legal rights, and access to education as well as the possibility of upward mobility to which they had previously had access when they were accorded the status of a distinct/legal ethnic group. Creole families had to make decisions about the economic, social, religious, and cultural futures of their children and the community as a whole. As a form of resistance to colonial …

Being Ourselves: Immigrant Culture And Self-Identification Among Young Haitians In Montréal, Scooter Pégram Jan 2005

Being Ourselves: Immigrant Culture And Self-Identification Among Young Haitians In Montréal, Scooter Pégram

Ethnic Studies Review

Since the early 1960s, large numbers of Haitians have emigrated from their native island nation. Changes in federal immigration legislation in the 1970s in both the United States and Canada enabled immigrants of colour a facilitated entry into the two countries, and this factor contributed to the arrival of Haitians to the North American continent. These newcomers primarily settled in cities along the eastern seaboard, in Boston, Miami, Montréal and New York. The initial motivator of this two-wave Haitian migration was the extreme political persecution that existed in Haiti under the iron-fisted rule of the Duvalier dictatorships and their secret …

[Review Of] Evelyn Nakano Glenn. Unequal Freedom: How Race And Gender Shaped American Citizenship And Labor, Philip Q. Yang Jan 2005

[Review Of] Evelyn Nakano Glenn. Unequal Freedom: How Race And Gender Shaped American Citizenship And Labor, Philip Q. Yang

Ethnic Studies Review

Evelyn Glenn is among the pioneers who laid the groundwork for an intersective approach of race, class, and gender to the analysis of social inequality. This new book carries on and extends her well-established intellectual project along this line of inquiry in both depth and breadth. In Unequal Freedom, Glenn offers an exemplary historical and comparative analysis of how race and gender as fundamental organizing principles of social institutions shaped American citizenship and labor system from the end of Reconstruction to the eve of World War II. She begins with a brief introduction to the book project in the introductory …

The Ethnic Impulse In Frank X. Gaspar's Poetry And Fiction, Reinaldo Silva Jan 2005

The Ethnic Impulse In Frank X. Gaspar's Poetry And Fiction, Reinaldo Silva

Ethnic Studies Review

Although a compelling and award-winning voice in contemporary American literature, the work of Frank Xavier Gaspar (1946-) has not received the attention it deserves. Apart from an article by Alice R. Clemente,(1) to my knowledge, there are no other scholarly publications touching upon his writings, all of which published in the course of the last seventeen years. While his work appeals to all audiences in the United States of America and even abroad -- Portugal in particular -- his poems dealing with issues related to his ancestral culture and ethnic background are the ones which have sparked the attention of …

[Review Of] Robert Utley, Battlefield And Classroom: An Autobiography Of Richard Henry Pratt, Sarah R. Shillinger Jan 2005

[Review Of] Robert Utley, Battlefield And Classroom: An Autobiography Of Richard Henry Pratt, Sarah R. Shillinger

Ethnic Studies Review

Battlefield and classroom is an important book that looks at a crucial era in American Indian history. Robert Utley's notes have done an excellent job in making Richard Pratt and his motivations and impact on American Indian tribal life accessible to the average reader while retaining the book's value as a scholarly work. It is a must read for those attempting to understand the importance of the boarding school era. With this book, Utley has successfully reopened the debate that has surrounded Richard Pratt and his motives.
