Intellectual Property Rights In Digital Media: A Comparative Analysis Of Legal Protection, Technological Measures And New Business Models Under E.U. And U.S. Law, Nicola Lucchi

ExpressO

The production of digital content is a phenomenon which has completely changed the conditions of access to knowledge. Within this framework it becomes even more important to find and to formulate a new settlement for intellectual property rights balancing contrasted rights. Owners of the old technology and policy makers have found two different solutions and remedies for intellectual property rights: legal and technological. When both remedies work together any rights that a consumer may have under copyright law could be replaced by a unilaterally defined contractual term and condition. To balance this inequity this article analyses different solutions under U.S. …

Does Birth Order Affect Intelligence?, Carolyn M. Lambert May 2005

Does Birth Order Affect Intelligence?, Carolyn M. Lambert

Theses and Dissertations

The purpose of this exploratory investigation was to determine whether birth order has an effect on intelligence. Seventy-four undergraduate students from Rowan University participated in my study. During class-time, I handed out a questionnaire with questions pertaining to the student's birth order within their family and SAT scores. The SAT scores served as a measure of intelligence. The SAT scores were broken into seven different ranges, between 800 - 1400 & above. The birth order variable was broken down into four levels; firstborn, middle child, youngest and only child. The different levels of birth order and SAT scores were compared …

The Real Impact Of Eliminating Affirmative Action In American Law Schools: An Empirical Critique Of Richard Sander's Study, David L. Chambers, Timothy T. Clydesdale, William C. Kidder, Richard O. Lempert May 2005

The Real Impact Of Eliminating Affirmative Action In American Law Schools: An Empirical Critique Of Richard Sander's Study, David L. Chambers, Timothy T. Clydesdale, William C. Kidder, Richard O. Lempert

Law & Economics Working Papers Archive: 2003-2009

In an article in Stanford Law Review, Richard Sander argues that the practice of American law schools of taking race into account in admissions to law school perversely leads to fewer black lawyers entering the bar each year than would be the case without affirmative action. Sander’s claim is that, while ending affirmative action would reduce somewhat the number of black students admitted to any law school, there would in the end be more black lawyers because those black students who do attend law school would no longer attend schools where they are over their heads academically and would graduate …

High-Stakes Testing And Assessment: One Is Not The Other, Enrique Murillo, Alayne Sullivan May 2005

High-Stakes Testing And Assessment: One Is Not The Other, Enrique Murillo, Alayne Sullivan

Journal of Critical Issues in Educational Practice

Since the institution of the common school and the advent of universal education, Americans have placed tremendous faith in public schools. Public education cultivates an informed citizenry, one of the pillars of a liberal democracy. But more importantly, schools are a repository for our common dreams of human potential and individual self-actualization. Because they so thoroughly shape the lives and life-chances of our youth, school issues are freighted with an emotional charge. Education remains the last fully public American institution, one in which millions of students cast their common lot daily and strive to become better readers, better citizens, better …

Ecstatic Morality And Sexual Politics: A Catholic And Antitotalitarian Theory Of The Body, Graham James Mcaleer May 2005

Ecstatic Morality And Sexual Politics: A Catholic And Antitotalitarian Theory Of The Body, Graham James Mcaleer

Religion

This first book-length treatment of Thomas Aquinas’s theory of the body presents a Catholic understanding of the body and its implications for social and political philosophy. Making a fundamental contribution to antitotalitarian theory, McAleer argues that a sexual politics reliant upon Aquinas’s theory of the body is better (because less violent) than other commonly available theories. He contrasts this theory with those of four other groups of thinkers: the continental tradition represented by Kant, Schopenhauer, Merleau-Ponty, Nancy, Levinas, and Deleuze; feminism, in the work of Donna Haraway; an alternative Catholic theory to be found in Karl Rahner; and the “Radical …

Manifestation Of Differences In Item-Level Characteristics In Scale-Level Measurement Invariance Tests Of Multi-Group Confirmatory Factor Analyses, Bruno D. Zumbo, Kim H. Koh May 2005

Manifestation Of Differences In Item-Level Characteristics In Scale-Level Measurement Invariance Tests Of Multi-Group Confirmatory Factor Analyses, Bruno D. Zumbo, Kim H. Koh

Journal of Modern Applied Statistical Methods

If a researcher applies the conventional tests of scale-level measurement invariance through multi-group confirmatory factor analysis of a PC matrix and MLE to test hypotheses of strong and full measurement invariance when the researcher has a rating scale response format wherein the item characteristics are different for the two groups of respondents, do these scale-level analyses reflect (or ignore) differences in item threshold characteristics? Results of the current study demonstrate the inadequacy of judging the suitability of a measurement instrument across groups by only investigating the factor structure of the measure for the different groups with a PC matrix and …

All-Inclusive List of Electronic Theses and Dissertations

In Marion County, Indiana the Hispanic population increased tremendously over the last decade. Predictions indicate that this vast influx of Hispanics will continue well into the twenty-first century. Predictions also indicate that growth in the Hispanic population poses serious educational concerns for schools across the country. The purpose of this qualitative study was to examine the Indianapolis Public Schools and the eight township school districts in Marion County, Indiana in terms of their acceptance of this influx of Hispanic high school students. This research investigated the English as a Second Language (ESL) Coordinator, Hispanic student and parent perceptions in terms …

Consumer Perception And Food Packaging, Dan Agnew, Patti Nibert, Shawna Wells May 2005

Consumer Perception And Food Packaging, Dan Agnew, Patti Nibert, Shawna Wells

Undergraduate Psychology Research Methods Journal

Color in food packaging may influence consumer perception of various factors of health of the food product. If lighter colored food packages are seen as healthy, people who are concerned about health will purchase these products. In this study, fifty participants were asked to answer questions about food products based on the packaging color. There were four trials of products, all of which contained three packages that were colored red, green, or light blue. Ultimately, products that were lighter in color, i.e. light blue, were indicated as being the healthier products

People Perception: The Effects Of Facial Piercings, Sarah Torpea May 2005

People Perception: The Effects Of Facial Piercings, Sarah Torpea

Undergraduate Psychology Research Methods Journal

The research hypothesis of this study is that subjects will have a more negative perception of models with facial piercings than models without. There were 35 subjects surveyed. Each subject looked at 15 pictures of people between the ages of 19 and 21 years. There were 11 filler pictures and four model pictures in each survey. The subject answered questions that helped them to rate these people on different positive and negative scales. The models were shown with no facial piercing, a fake lip piercing, a fake nose piercing or both a fake lip and nose piercing. The same models …

A Tale Of Two Visions: Can A New View Of Personality Help Integrate Psychology?, John D. Mayer May 2005

A Tale Of Two Visions: Can A New View Of Personality Help Integrate Psychology?, John D. Mayer

Psychology

Personality psychology studies how psychological systems work together. Consequently, the field can act as a unifying resource for the broader discipline of psychology. Yet personality's current fieldwide organization promotes a fragmented view of the person, seen through such competing theories as the psychodynamic, trait, and humanistic. There exists an alternative--a systems framework for personality--that focuses on 4 topics: identifying personality, personality's parts, its organization, and its development. This new framework and its view of personality are described. The framework is applied to such issues as personality measurement, psychotherapy outcome research, and education. The new framework may better organize the field …

Buried Alive: Hard Science Fiction Since The Golden Age, Bonny Mcdonald May 2005

Buried Alive: Hard Science Fiction Since The Golden Age, Bonny Mcdonald

Masters Theses & Specialist Projects

A substantial body of science fiction authors, critics and fans appreciate the literary attention the New Wave of the '60s and '70s brought to the genre of science fiction, but regret the seemingly lasting move away from the hard science classics of the '50s and before. They argue that "the hard stuff' is at the very heart of sf and that its future—still on the path set by the New Wave—is ostensibly a dead end. Many important critics along with hundreds of sf fan websites display this fatalistic concern, asking over and over "Is hard science fiction dead?" The answer …
