A New Kind Of "Outrageous Misconduct": Effects To Undermine The Law's Ability To Deter And Punish Intentional And Outrageous Corporate Behavior, Candace Howard Apr 2005

A New Kind Of "Outrageous Misconduct": Effects To Undermine The Law's Ability To Deter And Punish Intentional And Outrageous Corporate Behavior, Candace Howard

Student Articles and Papers

The current tort "reform" movement, if successful, will completely undermine our most effective tool for deterring outrageous corporate misconduct: the threat of punitive damages. Such "reform" would have a particularly egregious impact on the environment and public health because, due to a lack of enforcement and the undetectable nature of many pollutants, environmental offenses are often more difficult to deter than other types of offenses. The essay argues that, although rarely imposed for environmental offenses, punitive damages are especially vital in that arena because, when imposed, they are richly deserved. It concludes that, rather than tort reform, what we need …

Political Trials In Domestic And International Law, Eric A. Posner Apr 2005

Political Trials In Domestic And International Law, Eric A. Posner

Public Law and Legal Theory Working Papers

Due process protections and other constitutional restrictions normally ensure that citizens cannot be tried and punished for political dissent, but these same restrictions interfere with criminal convictions of terrorists and others who pose a non-immediate but real threat to public safety. To counter these threats, governments may use various subterfuges to avoid constitutional protections, often with the complicity of judges, but when they do so, they risk losing the confidence of the public, which may believe that the government targets legitimate political opponents. This paper argues that that the amount of process enjoyed by defendants in criminal trials reflects a …

Honk To Remove This Demonstration: The Eighth Circuit Adopts A Heckler's Veto, Aaron E. Schwartz

Missouri Law Review

Freedom of speech is a pillar of American ideology, providing protection from rule by the majority and allowing those with minority opinions to participate in political dialog. Generally, the courts have allowed extremely limited restrictions. However, in Frye v. Kansas City Police Department, the Eighth Circuit appears decide the opposite, placing convince for the many over the rights of the few.

Saginaw Chippewa Tribal Relations And The Social Production Of Space In Isabella County, Michigan, Bryan Thomas Swanson

Masters Theses

This thesis focuses on how the historical and cultural geography of the Saginaw Chippewa tribe of Mount Pleasant, Michigan and specifically on through their Soaring Eagle Casino reshaped the physical and cultural landscape of Isabella County. For this research I utilized documentary/archival evidence such as local histories, newspapers, plat maps and I also conducted field surveys. The research findings indicated that through the Soaring Eagle Casino the Saginaw Chippewa tribe has changed Isabella County, as well as their own social standing. Since 1993 the tribe has used casino revenues to purchase 1185 acres of land to add to the Isabella …

The State Of Disproportionate Minority Confinement (Dmc) In Mississippi’S Juvenile Detention Facilities, Saliba D. Mukoro Apr 2005

The State Of Disproportionate Minority Confinement (Dmc) In Mississippi’S Juvenile Detention Facilities, Saliba D. Mukoro

African Journal of Criminology and Justice Studies

Disproportionate Minority Confinement (DMC) has become a national issue due to several amendments to the JJDP Act of 1974 requiring compliance of all states’ participating in the formula grants program. All participating states, including the State of Mississippi, have thus introduced several programs to tackle the DMC problems in their various states for six years running. Giving these programmatic interventions, this study seeks to determine if DMC still exist in the juvenile detention facilities in the State of Mississippi. A survey instrument designed to measure racial composition of detainees was administered to the 18 juvenile facilities. The resulting data were …

Obstacles To Effective Policing In Nigeria, Emmanuel C. Onyeozili Apr 2005

Obstacles To Effective Policing In Nigeria, Emmanuel C. Onyeozili

African Journal of Criminology and Justice Studies

This paper traces the history of colonial social control and Policing in Nigeria, and also reviews the literature and examines how colonialism demonized, discredited, and supplanted the traditional system of policing. It establishes that in place of the old (traditional) system, colonialism imposed a new (but alien) militarized policing geared toward the colonial needs of political oppression and economic exploitation without regard to the needs of the colonized. The post colonial state was thus bequeathed a corrupt police system that fails to cater to the needs of the people. This unfortunate development explains the emergence of “ethnic armies” in the …
