Law And War: Individual Rights, Executive Authority, And Judicial Power In England During World War I, Rachel Vorspan

Vanderbilt Journal of Transnational Law

In this-Article Professor Vorspan examines the role of the English courts during World War I, particularly the judicial response to executive infringements on individual liberty. Focusing on detention, deportation, conscription, and confiscation of property, the Author revises the conventional depiction of the English judiciary during World War I as passive and peripheral. She argues that in four ways the judges were activist and energetic, both in advancing the government's war effort and in promoting their own policies and powers. First, they were judicial warriors, developing innovative legal strategies to legitimize detention and other governmental restrictions on personal freedom. Second, they …

Statement of Problem

HB 455 brought about the 1998 Omnibus Crime Act which created the Police Officer Professional Standards;16 requirements to becoming a peace officer in Kentucky. Five of the standards defined minimum physical agility standards. Though physical agility testing has had a history of controversy, validation studies have been created to support this practice. Though officers are testing for a level of physical agility upon entering the police officer field in Kentucky, no statewide policy has been passed to ensure that this level be maintained. We recall Supreme Court Justice and Nuremberg prosecutor Robert Houghwout Jackson (1892-1954) for many reasons, but certainly a leading one is the striking contrast between his humble origins and his exalted destinations. Jackson's life began literally in the deep woods, on a family farm in the gorgeous rural isolation of Spring Creek Township in northwestern Pennsylvania's Warren County. He spent his boyhood and obtained his basic public school education in Frewsburg, a small town in southwestern New York State. While still a teenager, Jackson spent one additional year as a high school student in nearby Jamestown, New York, but he …

The purchase of illegal drugs by an undercover police officer is commonly known as a “buy and bust” operation. In the twenty-first century, the stakes in the longstanding war on drugs are high as law enforcement and national security agencies join forces to confront the disturbing ties between terrorism and illegal narcotics. In addition to being a weapon in the arsenal of law enforcement, the buy and bust operation also tells an interesting story about motive in the criminal law. Criminal accusation stigmatizes. Merely having been accused of a crime lasts in the public eye, damaging one's reputation and threatening current and future employment, relationships, social status, and more. But vast numbers of criminal cases are dismissed soon after arrest, and countless accusations are unfounded orunprovable. Nevertheless, police officers and prosecutors routinely name criminal accusees to the public upon arrest or suspicion, with no obligation to publicize a defendant's exoneration, or the dismissal of his case, or a decision not to file charges against him at all. This paper proposes a new network centric architecture that can be used by first responders to effectively respond to crisis situations. The powerful network-centric concept originally developed for and mainly used in the military environment, can be effectively used for civilian security and emergency response missions. This paper also proposes the use of a swarm of intelligent robots as a part of the network-centric architecture to aid the first responders. Discussions of what justice means in mediation have a dialectical quality to them. At various points in the field's history, the notion that justice in mediation consists of fully maximized disputant self-determination holds sway. The American system of governance includes a network of state and local units identified as either general purpose or special purpose governments. The latter are often aligned with, but operate independently of, general purpose governments. Even as these special purpose or special district governments have shown extraordinary growth relative to their general purpose counterparts, there has been little interest in them or the structural characteristics that distinguish their systems for maintaining order and assuring accountable behaviors. The Markle Task Force on National Security in the Information Age was created to produce recommendations on how to best leverage intelligence and information to improve security without compromising existing civil liberties. Their second report proposed that the government set up an information-sharing network using currently available technology to improve our ability to prevent terrorist attacks, while protecting civil liberties. The Markle recommendations have been incorporated into the recent Intelligence Reform and Terrorism Prevention Act of 2004. Judicial challenges to order-maintenance policing apparently are leading some city officials to adapt the tools of property regulation to a task traditionally reserved for the police - the control of disorderly people. Examples of efforts to regulate disorder, ex ante, through land-management strategies include homeless campuses that centralize housing and social services, neighborhood exclusion zone policies that empower local officials to exclude disorderly individuals from struggling communities, and the selective targeting of inner-city neighborhoods for aggressive property inspections. Although the Warren Court had its share of grand decisions, perhaps it should be known instead for its grand goals--particularly the goals of ending America's shameful history of segregation and of providing a broad array of constitutional rights to persons accused of committing crimes. Brown v. Board of Education and Miranda v. Arizona, the two most well-known decisions of the Warren Court (and possibly the two most well-known decisions in the history of the Supreme Court), best capture the Court's labor in the rocky fields of our nation's legal, political, and cultural life.
