Therapeutic Jurisprudence And The Rehabilitative Role Of The Criminal Defense Lawyer, David B. Wexler Jan 2005

Therapeutic Jurisprudence And The Rehabilitative Role Of The Criminal Defense Lawyer, David B. Wexler

St. Thomas Law Review

In the present article, I will identify the potential rehabilitative role of the attorney from the beginning stages-possible diversion, for example through sentencing and even beyond-through conditional or unconditional release, and possible efforts to expunge the criminal record. This article has two principal purposes; first, to call for the explicit recognition of a TJ criminal lawyer, and to provide, in a very sketchy manner, an overview of that role; second, to propose an agenda of research and teaching to foster the development of the rehabilitative role of the criminal lawyer. While much of the proposed research would discuss the rehabilitative …

The Evolution Of The Legal Concepts Of Family And Marriage In The Eu Legal System And Its Impact On Society, Jonathan Curci Jan 2005

The Evolution Of The Legal Concepts Of Family And Marriage In The Eu Legal System And Its Impact On Society, Jonathan Curci

St. Thomas Law Review

One particular aspect that we will examine is the emergence of new family forms in same-sex marriages. If the fundamental concepts of "marriage" are redefined, "other unions" or "family types" would be placed on par with heterosexual marriages, enjoying the same benefits the traditional family has provided over the course of humanity. This redefinition of marriage would undermine the concept of the traditional family and ignore its necessity for the benefit to mankind.

This paper reports on the results of a study of safety and security at the Salt Lake Olympic Games by a team of researchers with wide-ranging access to operations, personnel and documents from the security effort at the 2002 Winter Games. This paper focuses on three specific areas: changing definitions of safety and security during the Games; the development and maintenance of organizational structures and interaction; and lessons …

The Future Of Sodomy , Libby Adler Jan 2005

The Future Of Sodomy , Libby Adler

Fordham Urban Law Journal

This Article celebrates Lawrence v. Texas as a tremendous advance in civil rights while also recognizing future danger signs associated with the opinion. The Article underscores four elements of the opinion which may cause danger to the pro-sex position the author endorses. The Article points to the Court's: (1) standard of review; (2) reliance on consent; (3) emphasis on privacy, and; (4) respect for dignity. Ultimately, the author warns pro-sex litigators and constituencies against complacency and warns that the words that bring them joy in Lawrence may possibly bring them pain in future opinions. The author calls for vigilance, for …

Fordham Urban Law Journal - Essay- Local Policing In A Post - 9/11 World

Fordham Urban Law Journal

The era following September 11, 2001 will be remembered as the golden age of law enforcement, the age of a bold paradigm shift inspired by the great challenges we face. It is instructive first to reflect on the old paradigm: as law enforcement agencies, we moved like swimmers in different lanes, all going the same direction with the same mission, yet also working by and for ourselves. Each criminal justice agency dealt with its own issues, staying—for the most part—in its own lane. Then, 9/11 changed everything. Indeed, it is our turn to be the greatest generation. Just as World …

Democratic Policing Confronts Terror An Protest, Jerome H. Skolnick Jan 2005

Democratic Policing Confronts Terror An Protest, Jerome H. Skolnick

Syracuse Journal of International Law and Commerce

The idea of legal evolution to a rule of law necessarily implies restraints upon the coercive power of the state. Whatever we might mean by coercive state power, surely the institution of the police embodies the essence of such power. Democratic policing has long been a guiding concern in studies of American policing; and it is a major goal of nations in transition to democracy, especially those in Eastern Europe.2 By those seeking change, democratic policing must be concerned with the rule of law as well as with crime and public order and terrorism. In this article, I intend to …

Michigan Bovine Tuberculosis Eradication Project: 2005 Activities Report And Conference Proceedings

Michigan Bovine Tuberculosis Bibliography and Database

On June 7 and 8, 2005, the State of Michigan and U.S. Department of Agriculture hosted the ninth annual bovine Tuberculosis (TB) meeting of scientists, with the intent to share research information and provide updates on policies, regulations and activities regarding bovine TB.

This document is a thank you to stakeholders and serves as an annual report offering insight into the finer points of this multi-agency project. The year 2005 has been one of milestones. The Upper Peninsula received TB-Free Status; only one TB positive farm was found during routine surveillance testing; and the disease prevalence rate in Deer Management …

Situational And Driver Characteristics Associated With Deervehicle Collisions In Southeastern Michigan, Alix Marcoux, Graham Hickling, Shawn Riley, Scott Winterstein Jan 2005

Situational And Driver Characteristics Associated With Deervehicle Collisions In Southeastern Michigan, Alix Marcoux, Graham Hickling, Shawn Riley, Scott Winterstein

Wildlife Damage Management Conference Proceedings

Deer-vehicle collisions (DVCs) create societal impacts throughout the range of white-tailed deer (Odocoileus virginanus). In Michigan reported DVCs increased by nearly 60% between 1992-2003, with current estimates at more than 65,000 DVCs per year and a mean of $2,300 vehicle damage. To better understand where to direct education and information programs, we used Office of Highway Safety Planning (OHSP) data, 2001-2003, to profile driver characteristics and accident situations of DVCs in Washtenaw, Oakland, and Monroe Counties in Michigan. Each county varies in intensity of land use, human and deer densities, and available deer habitat. Deer density in Washtenaw, …

Political Trials In Domestic And International Law, Eric A. Posner Jan 2005

Political Trials In Domestic And International Law, Eric A. Posner

Articles

Due process protections and other constitutional restrictions normally ensure that citizens cannot be tried and punished for political dissent, but these same restrictions interfere with criminal convictions of terrorists and others who pose a nonimmediate but real threat to public safety. To counter these threats, governments may use various subterfuges to avoid constitutional protections-often with the complicity of judges-but when they do so, they risk losing the confidence of the public, which may believe that the government targets legitimate political opponents. This Article argues that the amount of process enjoyed by defendants in criminal trials reflects a balancing of two …

Our 18th Century Constitution In The 21st Century World, Diane P. Wood Jan 2005

Our 18th Century Constitution In The 21st Century World, Diane P. Wood

Articles

In this speech delivered for the annual James Madison Lecture, the Honorable Diane Wood tackles the classic question of whether courts should interpret the United States Constitution from an originalist or dynamic approach. Judge Wood argues for the dynamic approach and defends it against the common criticisms that doing so allows judges to stray from the original intent of those who wrote the Constitution or take into consideration improper foreign influences. She argues the necessity of an "unwritten Constitution" since a literalist approach to interpretation would lead to unworkable or even absurd results in the modern context, and since restricting …
