Revoke First, Ask Questions Later: Challenging Minnesota’S Unconstitutional Pre-Hearing Revocation Scheme, Jeffrey S. Sheridan, Erika Burkhart Booth
Revoke First, Ask Questions Later: Challenging Minnesota’S Unconstitutional Pre-Hearing Revocation Scheme, Jeffrey S. Sheridan, Erika Burkhart Booth
William Mitchell Law Review
This analysis of the constitutionality of Minnesota’s prehearing revocation scheme begins by explaining the mechanics of Minnesota’s implied consent statute. Because the United States Supreme Court has established minimum procedural due process protections that must be afforded drivers, this backdrop is examined. After considering the federal standards for procedural due process, the numerous changes to Minnesota’s implied consent statute will be addressed. Next, the current challenge will be discussed, including the factual basis for the challenge, the arguments for the statute’s unconstitutionality, and the district court’s decision. Finally, this note will conclude that, given the dramatic increase in the private …

Drought Preparedness Planning: Building Institutional Capacity, Donald A. Wilhite, Michael Hayes, Cody L. Knutson
National Drought Mitigation Center: Faculty Publications
Past attempts to manage drought and its impacts through a reactive, crisis management approach have been ineffective, poorly coordinated, and untimely, as illustrated by the hydro- illogical cycle in Figure 1. The crisis management approach has been followed in both developed and developing countries. Because of the ineffectiveness of this approach, greater interest has evolved in recent years in the adoption of a more proactive risk-based management approach in some countries (see Chapter 6). Other countries are striving to obtain a higher level of preparedness through development of national action programs that are part of the United Nations Convention to …

The Convention On Cybercrime: A Harmonized Implementation Of International Penal Law: What Prospects For Procedural Due Process?, 23 J. Marshall J. Computer & Info. L. 329 (2005), Miriam F. Miquelon-Weismann
UIC John Marshall Journal of Information Technology & Privacy Law
The CoE Convention on cybercrime provides a treaty-based framework that imposes on the participating nations the obligation to enact legislation criminalizing certain conduct related to computer systems, create investigative procedures and ensure their availability to domestic law enforcement authorities to investigate cybercrime offenses, including procedures to obtain electronic evidence in all of its forms and create a regime of broad international cooperation, including assistance in extradition of fugitives sought for crimes identified under the CoE Convention. Since there is no internationally recognized legal definition of computer crime, this article briefly presents the generally recognized categories of cybercrime and then proceeds …

A cougar attacks a jogger in the suburbs of a western city. Charlie Sayers, facing retirement as a wildlife biologist at a downsized state agency, is drawn into the search for the lion. Reconstructing The World Trade Center: An Argument For The Applicability Of Personhood Theory To Commercial Property Ownership And Use, Mary L. Clark
Reconstructing The World Trade Center: An Argument For The Applicability Of Personhood Theory To Commercial Property Ownership And Use, Mary L. Clark
Dickinson Law Review (1908-2003)
This essay highlights two critical understandings gained from examining the rise, fall, and subsequent reconstruction of the World Trade Center through the lens of personhood theory: (1) that proponents of personhood theory have failed to appreciate the significant potential for self-constitution and self-expression contained within commercial property ownership and use; and (2) that the post-9/J1 decision to leave undeveloped the 'footprinted" land underlying the original World Trade Center towers represents a decommodification (withdrawal from market) of some of the most valuable real estate in the world in explicit recognition of the personhood attachments of those who died there that day.

Footing The Bill For A Sound Basic Education In New York City: The Implementation Of Campaign For Fiscal Equity V. State, Bonnie A. Scherer
Fordham Urban Law Journal
On March 16, 2005, in what appeared to be a victory for the children of New York City, the Court of Appeals of New York, applying the Education Article, upheld a lower court decision and recommendation, by a panel of judicially appointed Special Referees, holding that the New York State school funding system failed to provide New York City children with a “sound basic education.” The Court of Appeals mandated that the State Legislature phase in $5.6 billion annually, as well as an additional $9.2 billion in a capital fund to reform the City public schools. The opinion, however, failed …
