State Legislation And Human Trafficking: Helpful Or Harmful?, Stephanie Richard Jan 2005

State Legislation And Human Trafficking: Helpful Or Harmful?, Stephanie Richard

University of Michigan Journal of Law Reform

Human trafficking is the modern day form of slavery. Despite the fact that thousands of people are trafficked into the United Sates each year, the majority of U.S. citizens are not aware of the nature and extent of this problem. In 2000, the U.S. government passed the Victims of Trafficking and Violence Protection Act (VTVPA) to combat this grave human rights abuse. This federal legislation takes a comprehensive approach to addressing the problem of human trafficking in the United States by acknowledging that effective prosecution cannot occur without safeguards and benefits for trafficking victims. To this end, the VTVPA enumerates …

What Does It Take To Be A (Lesbian) Parent - On Intent And Genetics, Sanja Zgonjanin Jan 2005

What Does It Take To Be A (Lesbian) Parent - On Intent And Genetics, Sanja Zgonjanin

UC Law SF Journal on Gender and Justice

This Note analyzes KM v. E.G., 13 Cal. Rptr 3d 136 (Cal. Ct. App. 2004), the first case brought in front of any court of appeals in the U.S. where the lesbian egg donor (the genetic mother) who raised her children for six years together with her partner (the gestational mother) was denied parental rights after the couple separated. The application of the intent based determination of parentage originally devised to solve competing parental claims in surrogacy case is criticized as inappropriate, unnecessary and unjustified. The absence of legal protections for lesbian parents and standards addressing issues unique to lesbian …

Association Between A Dopamine-4 Receptor Polymorphism And Blood Pressure, Srijan Sen, Randolph Nesse, Li Sheng, Scott F. Stoltenberg, Lillian Gleiberman, Margit Burmeister, Alan B. Weder Jan 2005

Association Between A Dopamine-4 Receptor Polymorphism And Blood Pressure, Srijan Sen, Randolph Nesse, Li Sheng, Scott F. Stoltenberg, Lillian Gleiberman, Margit Burmeister, Alan B. Weder

Department of Psychology: Faculty Publications

Background: Dopamine receptor genes are candidates for hypertension susceptibility. Locally released dopamine increases renal sodium excretion, and defective renal dopamine receptor signaling has been shown to play a role in hypertension. Dopamine-4 receptors are expressed in juxtaglomerular and cortical collecting cells, where dopamine activation could alter sodium and water metabolism and affect blood pressure (BP). The dopamine-4 receptor (DRD4) gene has a 16 amino acid (48 base pairs [bp]) repeat polymorphism located in exon 3 where a G-protein binding area is encoded. The long allele (defined as at least one 7 to 10 repeat) has been associated with the personality …

Envisioning Second-Order Change In America's Responses To Troubled And Troublesome Youth, Lois A. Weithorn Jan 2005

Envisioning Second-Order Change In America's Responses To Troubled And Troublesome Youth, Lois A. Weithorn

Hofstra Law Review

Every year hundreds of thousands of troubled and troublesome children experience out-of-home placements under the auspices of the mental health, juvenile justice, and child welfare systems. The annual rates of such placements were higher at the end of the twentieth century thanat any time since comprehensive data were first available in the 1920s. Decades of legislative reform have failed to achieve overall reductions in use of institutions and other out-of-home placements for troubled and troublesome youth. What has changed, however, is the way in which these failures manifest. In recent years, for example, thousands of parents have relinquished custody of …

Re-Membering Law In The Internationalizing World, Vivian Grosswald Curran Jan 2005

Re-Membering Law In The Internationalizing World, Vivian Grosswald Curran

Hofstra Law Review

This article examines some of the challenges to understanding new, non-national legal configurations as contexts of origin color understandings and evaluations of legal standards allegedly shared across legal communities. It examines a case on assisted suicide, Pretty v. U.K., decided by the European Court of Human Rights. The case illustrates mechanisms of legal integration in the European court, followed by a process of dis-integration that occurred when the decision was reported to the French legal community. The French rendition reflected a legal community's inability to process common law information through civil law cognitive grids. The article addresses both the capacity …

The Evolution Of The "Patient": Shifts In Attitudes About Consent, Genetic Information, And Commercialization In Health Care, Janet L. Dolgin Jan 2005

The Evolution Of The "Patient": Shifts In Attitudes About Consent, Genetic Information, And Commercialization In Health Care, Janet L. Dolgin

Hofstra Law Review

This paper considers the importation of the notion of autonomous individuality into the world of healthcare during the last half century; it also explores the related transformation of the patient into a consumer. These developments have many beneficial dimensions. However, this paper focuses on these developments gone awry so that the result is some sort of excess. The paper describes three such excesses. It refers to the first as the elaboration of autonomous individuality and illustrates it with reference to the involution of the informed consent doctrine. The second excess is referred to as the perversion of autonomous individuality; this is …

Sociological Thought Experiments: Five Examples From The History Of Sociology, Michael R. Hill Jan 2005

Sociological Thought Experiments: Five Examples From The History Of Sociology, Michael R. Hill

Department of Sociology: Faculty Publications

Iam honored to speak with you today about several topics close to my professional and personal heart. I say personal as well as professional because for some twenty years now my interest in the history of sociology has developed and deepened in tandem with the pioneering research conducted by my life-partner, MaryJo Deegan. Her work on Jane Addams and the Men of the Chicago School, 1892-1918 (Deegan 1988a) has become the paradigm example for the “new history” in sociology, and it is my inspiration for today’s discussion.

A Brief Centennial Bibliography Of Resources On The History Of The American Sociological Society/Association, Michael R. Hill, Susan Hoecker-Drysdale, Jack Nusan Porter, Pamela A. Roby, Kathleen Slobin, Roberta Spalter-Roth

Department of Sociology: Faculty Publications

Celebrating the centennial of the American Sociological Association provides the ritual occasion and reinforces the intellectual rationale for collectively exploring our professional and organizational roots. To guide us on our way, we have compiled a brief bibliography of relevant materials and exemplars that explicate the early history of the American Sociological Society and – to some degree – its subsequent evolution (the line separating “history” from “current events” is not always easily drawn). Practicing extreme parsimony, we have intentionally excluded literally thousands of otherwise important and instructive published works that focus primarily on specific departments of sociology, the ideas and …

Jesse Lawson And The National Sociological Society Of 1903, Michael R. Hill Jan 2005

Jesse Lawson And The National Sociological Society Of 1903, Michael R. Hill

Department of Sociology: Faculty Publications

The National Sociological Society, rather than the American Sociological Society (now Association), was apparently the first American organization with national aspirations to place, in 1903, the fateful word "Sociological" in its corporate name. Unfortunately, the recent centennial of the National Sociological Society (NSS) passed unnoticed and uncelebrated. The NSS, convened in 1903, was a shortlived organization of African Americans and whites, Northerners and Southerners, academic men, politicians, clergymen, and others, who vigorously confronted the most pressing conundrum in Jim Crow America: how to solve the race problem. The NSS was championed by Jesse Lawson -- an African-American attorney, educator, and …

Tribes And Tribulations: Beyond Sovereign Immunity And Toward Reparation And Reconciliation For The Estelusti, Carla Pratt

Faculty Articles

This Article advocates a form of micro-reparations for a limited class of African Americans--the Estelusti (black Indians). The Article seeks reparations in the form of racial healing not only from the United States Government, but also from one particular participant in African American slavery--Native American Indian Tribes. The Article begins by defining the theory of micro-reparations and providing the historical foundation which serves as the factual predicate to the claim that black Indians have for reparation. This part of the article establishes how the rule of hypo-descent or the "one drop rule" has served historically and presently to exclude black …

In Teachers' Hands: Effective Literacy Teaching Practices In The Early Years Of Schooling, William Louden, Mary Rohl, Caroline Barratt Pugh, Claire Brown, Trevor Cairney, Jess Elderfield, Helen House, Marion Meiers, Judith Rivalland, Ken Rowe

Monitoring Learning

This project investigated the link between children’s growth in English literacy in the early years of schooling and their teachers’ classroom teaching practices. Using the LLANS literacy assessment tasks, 2000 children from every state and territory were assessed at the beginning and end of their first or second year at school. The teaching practices used by teachers whose students made most progress were explored. The effective teachers used a wide repertoire and demonstrated key teaching practices with greater consistency, skill and subtlety.

Stages Of Evil: Occultism In Western Theater And Drama, Robert Lima Jan 2005

Stages Of Evil: Occultism In Western Theater And Drama, Robert Lima

Studies in Romance Languages Series

“The evil that men do” has been chronicled for thousands of years on the European stage, and perhaps nowhere else is human fear of our own evil more detailed than in its personifications in theater. In Stages of Evil, Robert Lima explores the sociohistorical implications of Christian and pagan representations of evil and the theatrical creativity that occultism has engendered. By examining examples of alchemy, astronomy, demonology, exorcism, fairies, vampires, witchcraft, hauntings, and voodoo in prominent plays, Stages of Evil explores American and European perceptions of occultism from medieval times to the modern age.
