The History Of Wrongful Execution, Bruce P. Smith Jan 2005

The History Of Wrongful Execution, Bruce P. Smith

Sturm College of Law: Faculty Scholarship

Since the refinement of forensic DNA analysis in the early 199os, the problem of "wrongful execution" -the execution of persons who are actually innocent or the risk that such persons might be executed-has received considerable attention from scholars, legal practitioners, politicians, jurists, and social activists. The history of wrongful execution, however, remains unwritten.

This Article demonstrates that the problem of wrongful execution, although often considered to be a modern-day concern, preoccupied leading Anglo-American legal commentators in the seventeenth and eighteenth centuries. Troubled by several notorious instances of wrongful execution, prominent writers such as Matthew Hale and William Blackstone urged courts …

Optimising Physiotherapy Care For Acute Low Back Pain – Identifying Non-Responders To Treatment, James H. Mcauley, Benedict M. Wand, C Bird, Lorraine H. De Souza Jan 2005

Optimising Physiotherapy Care For Acute Low Back Pain – Identifying Non-Responders To Treatment, James H. Mcauley, Benedict M. Wand, C Bird, Lorraine H. De Souza

Health Sciences Conference Papers

Recent evidence suggests that positive effects of physiotherapy for acute low back pain patients can be achieved if treatment is delivered early enough. However it is clear that not all patients treated with physiotherapy are likely to report equally positive outcomes from their treatment. The identification of clinical characteristics of those patients who do less well will help refine models of care for acute low back pain.

Aim: To identify non-responders to early active physiotherapy.

Method: A secondary analysis was conducted on the data from a recently published randomised controlled trial of early physiotherapy for acute low back pain. All …

Language Production: A Complex Dynamic System With A Chronometric Footprint, Kim Kirsner, John Dunn, Kathryn Hird Jan 2005

Language Production: A Complex Dynamic System With A Chronometric Footprint, Kim Kirsner, John Dunn, Kathryn Hird

Medical Conference Papers

In this paper we outline a new approach to the study of language production. Central to this approach is the assumption that communication takes place in a dynamic environment in which cognitive resources are deployed to achieve ‘Right-Time’ as distinct from ‘Fast-as-Possible’ solutions. This is based on the assumption that language production includes a single, integrated, interactive process that recruits and coordinates information from a variety of internal, external and interactive sources to build each speech segment. The output of this process is reflected in the longer of the two log-normal pause duration distributions observed in spontaneous speech (Kirsner, Dunn, …

The Future Of Sodomy , Libby Adler Jan 2005

The Future Of Sodomy , Libby Adler

Fordham Urban Law Journal

This Article celebrates Lawrence v. Texas as a tremendous advance in civil rights while also recognizing future danger signs associated with the opinion. The Article underscores four elements of the opinion which may cause danger to the pro-sex position the author endorses. The Article points to the Court's: (1) standard of review; (2) reliance on consent; (3) emphasis on privacy, and; (4) respect for dignity. Ultimately, the author warns pro-sex litigators and constituencies against complacency and warns that the words that bring them joy in Lawrence may possibly bring them pain in future opinions. The author calls for vigilance, for …

A Dangerous Mix: Mandatory Sentence Enhancements And The Use Of Motive, Joshua S. Geller Jan 2005

A Dangerous Mix: Mandatory Sentence Enhancements And The Use Of Motive, Joshua S. Geller

Fordham Urban Law Journal

The comment begins with a story about an attack that took place against a homosexual where the attacker was then charged with a hate crime because he attacked a homosexual and seemingly was motivated by the victims sexual preference. The resulting strict punishment was based on motive and the comment discusses whether it is a good idea to mandate stricter punishment for crimes based on different kinds of motives. The comment then explores the differences between intent and motive, examines motive in the view of conspiracies based on Pinkerton liability and such, and looks at motive in the context of …

Profits And Professionalism, Deborah Rhode

Fordham Urban Law Journal

This Article looks at the financial effect of ethics work. The author examines to what effect and under what circumstances “ethics pays,” and what can be done to increase the rate of return. The article studies this issue in three different contexts. First, it looks at workplace cultures and professional values. The author tries to find how the legal professional can create more organizational structures in which adhering to principles serves prudential interests. The second context is pro bono work. Here, the author looks at the pro bono benefits to, the lawyer, and legal employer, as well as the costs …

Hash Browns For Breakfast, Baked Potatoes For Dinner: Changes In Food Attitudes As A Function Of Motivation And Context, Stephen Crites, Shelley Aikman Jan 2005

Hash Browns For Breakfast, Baked Potatoes For Dinner: Changes In Food Attitudes As A Function Of Motivation And Context, Stephen Crites, Shelley Aikman

Departmental Papers (Psych)

Two studies investigated whether participants' motivational state and the context in which attitude reports are made influence food attitudes. Specifically, these studies examined whether hunger and the time-typicality of foods (i.e. match or mismatch between the time when a food is typically eaten and the time the attitude is reported) interact to influence reported attitudes. Study 1 suggests that hunger leads to more positive attitudes toward foods that are typically eaten at the time the attitude report is made (e.g. breakfast foods in morning) compared to foods not typically eaten at the time the attitude report is made (e.g. breakfast …

Impact Of Nutrition Knowledge On Food Evaluations, Stephen Crites, Shelley Aikman Jan 2005

Impact Of Nutrition Knowledge On Food Evaluations, Stephen Crites, Shelley Aikman

Departmental Papers (Psych)

Objective: This study explored whether nutrition knowledge interacted with evaluations of a food’s healthiness to influence food attitudes (ie, global evaluations). Since attitudes guide behavior, understanding factors that impact food attitudes is one way to understand food selection and why factors such as nutrition knowledge have only a modest impact on food selection. We hypothesized that the relation between health evaluations and food attitudes would be stronger for people high in nutrition knowledge. We also explored the macronutrient composition of foods, and how it related to attitudes and health evaluations.

Design: Survey employing multilevel analyses to examine within- and between-subject …

Roots Of The Rorschach Controversy, Howard Garb, James Wood, Scott Lilienfeld, M. Nezworski Jan 2005

Roots Of The Rorschach Controversy, Howard Garb, James Wood, Scott Lilienfeld, M. Nezworski

Departmental Papers (Psych)

The controversy surrounding the Rorschach is updated, and an analysis of its dynamics is offered. Results on normative data and validity are reviewed, followed by a summary of, and rebuttal to, arguments made by Rorschach advocates. We argue that the current controversy can be traced, at least in part, to two unwarranted beliefs. First is the belief that informal impressions and popularity provide dependeable evidence for evaluating test validity. Second is the belief that Rorschach scores with low individual validity are likely to yield much higher levels of validity if they are interpreted in combination with each other, or with …

Red Lake, White Earth And ‘Blackgowns’: The Indian Industrial Schools Of St. John’S Abbey And St. Benedict’S Monastery, 1884-1896, Thomas Reichert

Honors Theses, 1963-2015

How and more importantly, why did the Benedictines become involved in off-reservation Industrial Schools? In this thesis, it is my goal to answer these questions. The opening of the schools was the result of three factors. First, the Benedictines subscribed to the popular beliefs and stereotypes about the Indians and what should be done with them. Second, the material situation of the mission, as well as the relationship between the Benedictines and the other involved parties on the reservation, created a situation where an off-reservation venture would seem desirable. Third, the financial situation of St. John's and St. Benedict's would …
