Metaphysics For The Marriage Debate, Janet Radcliffe Richards Aug 2005

Metaphysics For The Marriage Debate, Janet Radcliffe Richards

San Diego Law Review

The debate concerning what marriage is and what marriage ought to be is confused by conflicting ideas of natural law. John Stuart Mill sees law as a means by which to improve a universe with no natural moral order, whereas James Fitzjames Stephen views law as a means to correct that which is morally against nature. This article focuses on understanding a morally neutral working of nature, which requires looking past something's moral desirability, and devising what form social arrangements, like marriage, should take. Once the ideas of natural law, together with moral goodness, are abandoned, and ideas discussing the …

International Law: A Welfarist Approach, Eric A. Posner Aug 2005

International Law: A Welfarist Approach, Eric A. Posner

Coase-Sandor Institute for Law & Economics Research Paper Series

This paper evaluates international law from a welfarist perspective. Global welfarism requires that international law advance the well being of everyone in the world, and scholars influenced by global welfarism and similar cosmopolitan principles have advocated radical restructuring of international law. But global welfarism is subject to several constraints, including (1) heterogeneity of preferences of the world population, which produces the state system; (2) agency costs, which produce imperfect governments; and (3) the problem of collective action. These constraints place limits on what policies motivated by global welfarism can achieve, and explain some broad features of international law that otherwise …

Error Management Theory And The Hostile Attribution Bias, Felix J. Thoemmes Aug 2005

Error Management Theory And The Hostile Attribution Bias, Felix J. Thoemmes

All-Inclusive List of Electronic Theses and Dissertations

Error Management Theory (Haselton & Buss, 2000) proposes that certain human biases evolved as an adaptation to cost differentials between certain types of errors that can be committed in social situations. This study examined whether the hostile attribution bias (Dodge, 1980), a tendency in aggressive children and adults to over-perceive aggressive intent in others, could be accounted for by Error Management Theory. In a vignette study, participants rated their perceived aggression of a potential perpetrator in a car accident. Different vignettes depicted the same situation under various conditions in terms of who accompanied the "participant". Conditions were changed in order …

Effects Of Differential Consequences On Responding In The Analog Functional Analysis, Theresa M. V. Hedrick Aug 2005

Effects Of Differential Consequences On Responding In The Analog Functional Analysis, Theresa M. V. Hedrick

Graduate Theses, Dissertations, and Problem Reports (ETD)

Direct methods of functional assessment consist of descriptive observations and experimental assessments. Descriptive observations are conducted in non-laboratory settings and consist of recording instances of target responses and environmental events that precede or follow occurrences of problem behavior, whereas experimental assessments most often are conducted in laboratory settings and involve manipulation of only a few predetermined environmental events. Results of recent studies suggest that discrepant hypotheses often are developed based on outcomes of different methods of functional assessment. As intervention efficacy depends on the accuracy of the functional assessment, it is important to determine why discrepant hypotheses often result from …

Counseling And Clinical Psychology Doctoral Students' Perceptions Of Their Faculty's Ethical Behavior, Philip W. Cromer Aug 2005

Counseling And Clinical Psychology Doctoral Students' Perceptions Of Their Faculty's Ethical Behavior, Philip W. Cromer

Graduate Theses, Dissertations, and Problem Reports (ETD)

The purpose of this study was to examine the perceptions of psychology doctoral students with regard to their faculty's ethical behavior. A review of the literature suggested that research on the perception of ethical behavior in academia has been narrowly focused on undergraduate students. Furthermore, many of the studies did not convey a comprehensive picture of the students' perceptions of their faculty's ethical behavior. A survey instrument was adapted from a survey used in a study of students' view of their undergraduate professors' actions (Keith-Spiegel, Tabachnick, & Allen, 1993). A randomized sample of 50 accredited counseling psychology doctoral programs and …

The objectives of this study were to compare the performance of two feed treatments on a population of rainbow trout, Oncorhynchus mykiss, reared in a linear raceway system, which utilized mine water from a mine water treatment facility (MWTF); to measure and compare waste outputs; to monitor the water quality of the system; and to identify the impacts, if any, of the water quality on the fish population. Toward the end of the study, a spike in the turbidity of the water source led to additional objectives. First, the water quality was characterized during the events to determine the extent …

Exploring Differences In Level Of Involvement, Educational Outcomes, And Satisfaction Of Resident Students And Commuter Students At A Rural Community College, Richard Wayne Layman Aug 2005

Exploring Differences In Level Of Involvement, Educational Outcomes, And Satisfaction Of Resident Students And Commuter Students At A Rural Community College, Richard Wayne Layman

Graduate Theses, Dissertations, and Problem Reports (ETD)

Because the vast majority of community colleges were founded to serve commuter students who live within a local and regional area, student residential housing at two-year institutions has been seen as unnecessary. However, an increasing number of community colleges are opening student resident housing. In contrast to all the research available about the impact at four-year institutions of residence (resident students and commuter students), the literature review revealed there has been little research on resident students and commuter students on community college campuses (Murrell, 1998).;This study can be characterized as a preliminary investigation into whether resident students' and commuter students' …

Search And Persuasion In Trademark Law, Barton Beebe Aug 2005

Search And Persuasion In Trademark Law, Barton Beebe

Michigan Law Review

The consumer, we are led to believe, is the measure of all things in trademark law. Trademarks exist only to the extent that consumers perceive them as designations of source. Infringement occurs only to the extent that consumers perceive one trademark as referring to the source of another. The most "intellectual" of the intellectual properties, trademarks are a property purely of consumers' minds. The simple idealist ontology underlying trademark law is largely responsible for the law's characteristic instability. Since 1992, the Supreme Court has considered - and in some cases, reconsidered - seven trademark cases. The Court's copyright cases garner …

The Effectiveness Of Valdecoxib On Post-Endodontic Pain, Lora Beth Ford Aug 2005

The Effectiveness Of Valdecoxib On Post-Endodontic Pain, Lora Beth Ford

Graduate Theses, Dissertations, and Problem Reports (ETD)

Pain is often associated with teeth that need endodontic therapy. This pain results from inflammation. Non-Steroidal Anti-Inflammatory Drugs are useful in managing acute post-operative dental pain. NSAIDS specific for only blocking the COX-2 enzyme cause less stomach irritation and bleeding. The purpose of this clinical study was to determine if pre-operative administration of valdecoxib would significantly reduce post-endodontic pain, when compared to ibuprofen. Sixteen patients were evaluated. The patients consented to a random, one-time, pre-operative oral administration of either 600 mg ibuprofen or 20 mg valdecoxib. Each patient rated their pain on a visual analog scale at initial, immediately after, …

The Effects Of Contextual Factors On Dyadic Everyday Problem Solving In Adulthood, Tara L. Neely Aug 2005

The Effects Of Contextual Factors On Dyadic Everyday Problem Solving In Adulthood, Tara L. Neely

Graduate Theses, Dissertations, and Problem Reports (ETD)

The present study examined individual and dyadic everyday problem solving in 45 younger, middle-aged, and older adult married couples. The goal of the study was to investigate the effects of age, gender, collaboration, marital characteristics, and basic cognition on everyday problem-solving. Two research questions were addressed. First, were there group differences across three phases of problem solving? Second, what was the frequency of individual change, and which factors predicted improvement, stability, or decline? When addressing the first question, there was a significant four-way interaction, F (4, 78) = 2.83, p < .05, eta = .12, between participant age, gender, problem-solving condition, and problem-solving phase, emphasizing the multidimensionality of everyday cognition. When addressing the second question, a larger percentage of individuals who collaborated reliably improved compared to individuals who worked alone. Furthermore, basic cognitive abilities, education, and marital factors significantly accounted for individual reliable change in everyday problem solving.

Risk And Resilience In Youth: An Examination Of Moderating Factors, Beverly L. Fortson Aug 2005

Risk And Resilience In Youth: An Examination Of Moderating Factors, Beverly L. Fortson

Graduate Theses, Dissertations, and Problem Reports (ETD)

Child maltreatment (i.e., emotional abuse, physical abuse, sexual abuse, emotional neglect, physical neglect) poses a significant risk for psychological difficulties to millions of children annually. Some children develop posttraumatic stress disorder (PTSD) or other anxiety disorders (e.g., generalized anxiety disorder, panic disorder, social anxiety disorder), depressive disorders (e.g., major depressive disorder), and substance abuse/dependence as a result of maltreatment. Fortunately, many other children, who have been termed "resilient," escape such incidents relatively unscathed. This study explored the unique associations between child maltreatment and several outcome variables (e.g., substance use, sexualized behavior, depression, generalized anxiety, and social anxiety) as well as …

Competing Fictions: Eighteenth-Century Domestic Novels, Women Writers, And The Trope Of Female Rivalry, Elizabeth Johnston Aug 2005

Competing Fictions: Eighteenth-Century Domestic Novels, Women Writers, And The Trope Of Female Rivalry, Elizabeth Johnston

Graduate Theses, Dissertations, and Problem Reports (ETD)

This dissertation focuses on mid to late eighteenth-century domestic fiction by Samuel Richardson, Sarah Scott, Frances Burney, and Maria Edgeworth, arguing that female rivalry in the novel performs a complex double function, both reinscribing domestic ideology and undermining it. I begin with the premise that Richardson's depiction of female rivalry differs significantly from those of the women writers who follow him. My chapter on Richardson's Clarissa examines his depiction of rivalry between Clarissa and all the other women of the novel, arguing that the "bad" women work to overshadow Lovelace's abuses; in other words, female rivalry effectively displaces a critique …
