Constitutional Adjudication, Civil Rights, And Social Change, Suzanne B. Goldberg Sep 2005

Constitutional Adjudication, Civil Rights, And Social Change, Suzanne B. Goldberg

Rutgers Law School (Newark) Faculty Papers

Judicial opinions typically rely on “facts” about a social group to justify or reject limitations on group members’ rights, especially when traditional views about the status or capacity of group members are in contest. Yet the fact-based approach to decision-making obscures the normative judgments that actually determine whether restrictions on individual rights are reasonable. This article offers an account of how and why courts intervene in social conflicts by focusing on facts rather than declaring norms. In part, it argues that this approach preserves judicial power to retain traditional justifications for restricting group members’ rights in some settings but not …

Easy's Gettin' Harder All The Time: The Computational Theory And Affective States, Jason Megill, Jon Cogburn Sep 2005

Easy's Gettin' Harder All The Time: The Computational Theory And Affective States, Jason Megill, Jon Cogburn

Faculty Publications

We argue that A. Damasio's (1994) Somatic Marker hypothesis can explain why humans don't generally suffer from the frame problem, arguably the greatest obstacle facing the Computational Theory of Mind. This involves showing how humans with damaged emotional centers are best understood as actually suffering from the frame problem. We are then able to show that, paradoxically, these results provide evidence for the Computational Theory of Mind, and in addition call into question the very distinction between easy and hard problems in the contemporary philosophy of mind. © Blackwell Publishing Ltd. 2005.

The Relationship Between Student Perceptions Of Parental Involvement And Grade Eight Reading And Math Achievement In A Rural Georgia Middle School, Wayne A. Hickman Sep 2005

The Relationship Between Student Perceptions Of Parental Involvement And Grade Eight Reading And Math Achievement In A Rural Georgia Middle School, Wayne A. Hickman

Doctoral Dissertations and Projects

The purpose of this study was to examine the relationship between students' perceptions of parental involvement and grade 8 reading and math achievement as measured by the Georgia Criterion Reference Competency Test (CRCT). This study relied on a theoretical framework developed by Epstein (1987). This framework includes a six-part categorization of parent involvement typologies (Type 1—parenting, Type 2—communication, Type 3—volunteering, Type 4—learning at home, Type 5—decision-making, and Type 6—collaborating), which were used as the basis for data collection and analysis. The High School and Family Partnerships: Questionnaires for Teachers, Parents, and Students were developed by Epstein and Salinas (1993) for …

An Artificial Neural Network That Utilizes Hip Joint Actuations To Control Bifurcations And Chaos In A Passive Dynamic Bipedal Walking Model, Max J. Kurz, Nikolaos Stergiou Sep 2005

An Artificial Neural Network That Utilizes Hip Joint Actuations To Control Bifurcations And Chaos In A Passive Dynamic Bipedal Walking Model, Max J. Kurz, Nikolaos Stergiou

Journal Articles

Chaos is a central feature of human locomotion and has been suggested to be a window to the control mechanisms of locomotion. In this investigation, we explored how the principles of chaos can be used to control locomotion with a passive dynamic bipedal walking model that has a chaotic gait pattern. Our control scheme was based on the scientific evidence that slight perturbations to the unstable manifolds of points in a chaotic system will promote the transition to new stable behaviors embedded in the rich chaotic attractor. Here we demonstrate that hip joint actuations during the swing phase can provide …

The Implications Of Conjunctive And Disjunctive Forgiveness For Sexual Abuse, Herbert W. Helm, Jonathan R. Cook, John M. Berecz Sep 2005

The Implications Of Conjunctive And Disjunctive Forgiveness For Sexual Abuse, Herbert W. Helm, Jonathan R. Cook, John M. Berecz

Faculty Publications

This article examines the relationship between forgiveness styles (conjunctive and disjunctive models) and sexual abuse. Surveys from 114 university students were analyzed for differences between non-sexually abused and sexually abused subjects on a number of psychological and physical well-being variables. A number of differences were found including higher levels of reported verbal and physical abuse for the sexually abused subjects. Only one sexually abused subject was found that fit the pattern of conjunctive forgiveness (one of reconciliation) towards the offender. The majority of sexually abused subjects preferred to keep their distance from the abuser, regardless of the extent to which …

The Role Of Adult Expectations On The Recovery Of Sexually Abused Children, Haig Kouyoumdjian, Andrea R. Perry, David J. Hansen Sep 2005

The Role Of Adult Expectations On The Recovery Of Sexually Abused Children, Haig Kouyoumdjian, Andrea R. Perry, David J. Hansen

Department of Psychology: Faculty Publications

Child sexual abuse is a disturbingly prevalent problem that has continued to receive increased attention in the United States. Because there is substantial variability in how sexual abuse impacts children, it is important to examine potential mediating variables, including the ways in which child and family factors contribute to children’s recovery. One of the most extensively researched family variables has been parental support, and this research has demonstrated a positive relationship between parental support and children’s functioning following sexual abuse. Another family variable that likely infl uences parent–child interactions and children’s recovery is parental expectations. Although adults’ expectations about children …

Moral Development In Adolescence, Daniel Hart, Gustavo Carlo

Department of Psychology: Faculty Publications

Themes in the papers in this special issue of the JRA on moral development are identified. We discuss the intersection of moral development research with policy concerns, the distinctive qualities of moral life in adolescence that warrant investigation, the multiple connotations of "moral," the methods typical of moral development research, and the influences that shape adolescent moral development. Suggestions are made for new methods and new directions in the study of moral development.

Moral development in adolescence has reached maturity as an area of research. This essay introduces a special issue of the Journal of Research on Adolescence, which …

Pathway Curvature And Border Visibility As Predictors Of Preference And Danger In Forest Settings, Thomas R. Herzog, Kristin M. Kirk Sep 2005

Pathway Curvature And Border Visibility As Predictors Of Preference And Danger In Forest Settings, Thomas R. Herzog, Kristin M. Kirk

Peer Reviewed Articles

The authors investigated pathway curvature and pathway border visibility as predictors of preference and perceived danger in forest settings. Participants rated 56 forest settings containing pathways for one of four variables—mystery, visual access, pathway length, and pathway width—or for one of four additional predictors. Pathway curvature was unrelated to preference, danger, or mystery. Border visibility and visual access were positively related to preference, negatively related to danger, and positively related to each other. Preference and danger were negatively related. Danger was more strongly related to the predictors than was preference. Mystery had a modest negative relation with preference and substantial …

International Relations Theory And The Case Against Unilateralism, Stephen Brooks, William C. Wohlforth Sep 2005

International Relations Theory And The Case Against Unilateralism, Stephen Brooks, William C. Wohlforth

Dartmouth Scholarship

What are the general costs associated with a U.S. shift toward unilateralism? According to the overwhelming majority of international relations (IR) scholars, the costs are very high. We evaluate the key arguments that underlie this assessment, namely that increased U.S. unilateralism will: (1) spur the formation of a coalition to check U.S. power; (2) reduce efficiency gains through lost opportunities for institutionalized cooperation; and (3) undermine the legitimacy of the American-led international order. We conclude that the theoretical arguments that IR scholars advance do not show that a shift toward unilateralism necessarily has high costs. Our analysis reveals the need …

In this brief comment, I apply behavioral decision theory to the question of the enforcement in transnational sales of super-compensatory agreed damages. I conclude that a good case can be made that such damages provisions should be enforced.

Strategic Predictors Of Successful Enterprise Systems Deployment, John E. Ettlie, Victor J. Perotti, David A. Joseph, Mark Cotteleer Sep 2005

Strategic Predictors Of Successful Enterprise Systems Deployment, John E. Ettlie, Victor J. Perotti, David A. Joseph, Mark Cotteleer

Management Faculty Research and Publications

Purpose The delivered wisdom to date has enterprise system purchase and implementation as one of the most hazardous projects any organization can undertake. The aim was to reduce this risk by both theoretically and empirically finding those key predictors of a successful enterprise system deployment.

Design/methodology/approach A representative sample of 60 firms drawn from the Fortune 1000 that had recently (1999-2000) adopted enterprise resource planning (ERP) systems was used to test a model of adoption performance with significant results.

Findings Leadership (social learning theory), business process re-engineering (change the company not the technology) and acquisition strategy (buy, do not make) …

Multiculturalisms Past, Present, And Future, Marilyn Edelstein Sep 2005

Multiculturalisms Past, Present, And Future, Marilyn Edelstein

English

Once upon a time, most classes, in both schools and universities, focused on historical events shaped by white men, scientific discoveries made by white men, philosophies constructed by white men, and literary and artistic works created by white men. This time was not so long ago-and during some of our lifetimes. Since at least the late 1960s, this normative maleness and whiteness-which always claimed to be universal-has been challenged by the development of ethnic studies, women's and gender studies, and multiculturalism. Especially in literary studies-and nowhere more than in the field of American literature-the canon has exploded, as more works …
