No aspect of the Bush Administration's foreign policy has caused greater consternation in Europe, at the United Nations, and among the Academy than the doctrine of "preemption." As the President has made clear, both in the 2002 National Security Strategy of the United States of America ("NSS") and in numerous other public statements, the United States claims the legal right to take military action to preempt gathering threats to its national security, with or without the sanction of the UN Security Council. Aaron Mackler’s agenda is to provide an orientation to ethical reasoning in the Roman Catholic and Jewish traditions, explore Roman Catholic and Jewish deliberations in five areas of bioethics, and identify and examine the traditions’ divergent and convergent methodologies. Mackler’s spirit is to learn more about his own religious traditions by studying the traditions of others. Accomplishing his agenda while remaining true to his spirit, Mackler shows just how much Jewish and Catholic thinkers can learn from one another.

The purpose of this paper is to address the doubts that surround the intention/foresight distinction of the Doctrine of Double Effect (DDE). The claim is made by some that this distinction is merely a semantic one or if real, it is morally irrelevant. It will be argued that this is the result of doubts that surround the contributions of theory in applied ethics and the double think that sometimes results from the misuse of the DDE. In September 1979 President Jimmy Carter publicly announced his decision to support the deployment of the MX missile and mobile basing scheme in Utah and Nevada. Despite local opposition and the close proximity of the proposed base to its headquarters, The Church of Jesus Christ of Latter-day Saints (Mormons) remained silent until 5 May 1981, when the First Presidency issued a statement opposing the MX plans. Much has been written on the question of ordaining women in the Roman Catholic Church. Catholic scholars of all stripes have debated issues such as the biblical sources for a theology of ordination; the relationship between sacramental and non-sacramental ministries; the limits of papal authority and the development of doctrine; and, more recently, the relationship between the elevation of an all-male, celibate clergy and the failure of Catholic bishops to address reported sexual abuse by priests. The Priest-Penitent Privilege – An Hibernocentric Exercise In Postcolonial Jurisprudence, Walter J. Walsh

Although much has been written on the history of the priest-penitent privilege, this Article will show that such writing tends toward an unconscious, but strong, anglocentric tilt. It seems that no scholar has tried to locate and interpret all the Irish and American sources that inspired this initially hibernocentric, later more generally American, postcolonial deviation from the English common law. Since the Second World War, the significance of Philips and its 1828 New York codification have gained widespread recognition, but the scholarly inquiry has never advanced in any truly historical fashion. “The Wil Of His Wif:” Discourse, Power, And Gender In Chaucer’S The Tale Of Melibee, Sara D. Jenkins

In the Tale of Melibee, Chaucer gives us an excellent illustration of a point French theorist Michel Foucault would make centuries later: That power is something that moves and shifts between people and within institutions, that it is not fixed nor permanent, that it is used as needed toward specific ends, and that it is enacted through the medium of discourse. In Melibee, Melibee’s wife Prudence achieves a place of authority and influence in her marriage via her use of discourse, and specifically by using a more “male” way of speaking. “The Indispensable Basis Of Democracy”: American Catholicism, The Church-State Debate, And The Soul Of American Liberalism, 1920–1929, Zachary R. Calo

Several recent works of scholarship explore how Establishment Clause jurisprudence has been shaped by broader political debates over the role of religion in public life. This literature focuses on the politics of anti-Catholicism, particularly during the early years of Establishment Clause jurisprudence in the1940s and 1950s. While not questioning the centrality of this period to the historical narrative, this Note argues that the political contest over church and state took shape in an earlier debate over the compatibility of Catholicism and the Constitution during the 1920s. The Church’s response to the anti-Catholicism of this period was of particular importance. Catholic …
