A Tale Of Two Jurisdictions And An Orphan Case: Antitrust, Intellectual Property And Refusals To Deal, Eleanor M. Fox Jan 2005

A Tale Of Two Jurisdictions And An Orphan Case: Antitrust, Intellectual Property And Refusals To Deal, Eleanor M. Fox

Faculty Articles

This Essay examines both the U.S. law and the EU law through the window of a recent U.S. case: New York Mercantile Exchange v. Intercontinental Exchange (“NYMEX”). The NYMEX facts are similar in concept to the facts in IMS but present a stronger case for liability. The Essay argues that the opinion in NYMEX, along with a growing set of U.S. cases, interprets Trinko to impose rigid requirements on a Section 2 plaintiff, not all of which are inherent in Trinko. It argues that the formalistic post-Trinko analysis, which would require dismissal of cases that do not fit within one …

The City And The Poet, Kenji Yoshino Jan 2005

The City And The Poet, Kenji Yoshino

Faculty Articles

This article presents information on the struggle between the law and literature. Greek philosopher Plato's banishment of the poet is one of his most reviled ideas. Yet it is time to revisit his framework, which illuminates many of the contemporary debates about law and literature. Contemporary evictions of literature from law frame literature in negative particularizing terms. The temptation for those who defend literature will always be to respond with an ineradicability defense, which stretches the particularizing definition of literature into a generalizing one. The Platonic paradigm suggests that one should resist this move because it is both wrong and …

Administering Crime, Rachel E. Barkow Jan 2005

Administering Crime, Rachel E. Barkow

Faculty Articles

Although agencies are the dominant force in criminal law today, existing scholarship has largely failed to analyze how these bodies perform as agencies. We know little about how the institutional design of these agencies affects their output or whether the politics of regulation are different when an agency is responsible for the regulation of criminal justice issues as opposed to traditional regulatory areas. This Article takes up that task by evaluating the agencies charged with regulating one of the most important aspects of criminal law: sentencing. Many reformers turned to agencies to regulate sentencing because they did not trust the …

Why Equality? How Equality?: The Desirability Of A Focus On Income Distribution, Arthur Macewan Jan 2005

Why Equality? How Equality?: The Desirability Of A Focus On Income Distribution, Arthur Macewan

Economics Faculty Publication Series

Much of the discussion of economic development in low and middle income countries and of poverty reduction has either ignored the issue of income distribution or has tended to view income distribution only in terms of its impact on economic growth. In this paper I argue that such an approach is misguided. I will explain, first, why I believe that it is desirable to give a great deal of attention to income distribution in the analysis of economic development and poverty reduction. My argument includes conceptual, political and practical elements. Second, I will suggest some of the ways in which …

Governmental Resistance In International Intellectual Property Rights, Emily Honig Jan 2005

Governmental Resistance In International Intellectual Property Rights, Emily Honig

Honors Theses

The field of intellectual property, roughly defined as "a product of the intellect that has commercial value," is one of the growing fields of international legal debate, as the economies of the world become increasingly interconnected and the world's corporations operate overseas with increasing frequency. The literature in the field of international law and intellectual property rights (IPRs) tends to suggest that states, for political or economic reasons, have little choice but to bow to the wishes of multinational corporations (MNCs) and provide increased protection for IPRs. However, there are a number of cases that show that under certain circumstances, …

‘We’Re Just Like The Irish’: Narratives Of Assimilation, Belonging, And Citizenship Among Arab American Activists, Caroline R. Nagel, Lynn A. Staeheli Jan 2005

‘We’Re Just Like The Irish’: Narratives Of Assimilation, Belonging, And Citizenship Among Arab American Activists, Caroline R. Nagel, Lynn A. Staeheli

Faculty Publications

This paper examines narratives of assimilation and belonging as activists attempt to position Arab-Americans as citizens and full members of the American polity. In interviews with activists, the experience of the Irish as immigrants and citizens was often invoked as the paradigmatic example of how immigrants are incorporated as citizens—an example that activists promoted as one that Arabs would follow. By invoking the Irish experience, activists hope to remind Americans that immigration history is not one of effortless assimilation, but is rather characterized by systematic exclusion and marginalization. In so doing, they articulate narratives of assimilation and belonging that draw …

Melting In A Low Gravity Environment With Applied Electromagnetic Fields, Douglas L. Veilleux Ii Jan 2005

Melting In A Low Gravity Environment With Applied Electromagnetic Fields, Douglas L. Veilleux Ii

Open Access Dissertations

The transport phenomenon associated with the melting of an electrically conducting phase change material (PCM), subjected to either an applied static or oscillating electromagnetic field inside a rectangular enclosure, has been numerically studied. The electromagnetic fields have been configured in such a way that the resulting Lorentz force can either damp or increase the convective mechanisms due to the influence of gravity. Computational experiments have been conducted for both fixed (sidewall heating) and unfixed (topwall heating) PCMs. The governing equations were discretized using a control-volume based finite difference scheme. Numerical solutions have been obtained for a true low-gravity environment, simulated …

Minority Threat And Police Strength From 1980 To 2000: A Fixed-Effects Analysis Of Nonlinear And Interactive Effects In Large U.S. Cities, Stephanie L. Kent, David Jacobs Jan 2005

Minority Threat And Police Strength From 1980 To 2000: A Fixed-Effects Analysis Of Nonlinear And Interactive Effects In Large U.S. Cities, Stephanie L. Kent, David Jacobs

Sociology & Criminology Faculty Publications

Many studies have assessed threat theory by investigating the relationships between the size of minority populations and police strength. Yet these investigations analyzed older data with cross-sectional designs. This study uses a fixed-effects panel design to detect nonlinear and interactive relationships between minority presence and the per capita number of police in large U.S. cities in the last three census years. The findings show that the relationship between racial threat and the population-corrected number of police officers has recently become considerably stronger. In accord with theoretically based expectations, tests for interactions show that segregated cities with larger African American populations …

The Effects Of Sfas 131 Geographic Segment Disclosures On The Valuation Of Foreign Earnings, Ole-Kristian Hope, Tony Kang, Wayne Thomas, Florin Vasvari Jan 2005

The Effects Of Sfas 131 Geographic Segment Disclosures On The Valuation Of Foreign Earnings, Ole-Kristian Hope, Tony Kang, Wayne Thomas, Florin Vasvari

Research Collection School Of Accountancy

Foreign operations are becoming increasingly important for U.S. companies. We investigate whether the market’s valuation of foreign earnings is a function of the firm’s geographic segment disclosures. Specifically, we examine the effects of an increase in the number of geographic segments disclosed and the inclusion of earnings measures in geographic segment disclosures following the adoption of SFAS 131. We find strong evidence that our proxies for increased disclosure are positively associated with the valuation of foreign earnings. Our results are robust to a number of sensitivity analyses. Taken together, our results suggest that the pricing of foreign earnings is associated …

Legal And Ethical Implications Of Employee Location Monitoring, Gundars Kaupins, Robert Minch Jan 2005

Legal And Ethical Implications Of Employee Location Monitoring, Gundars Kaupins, Robert Minch

Management Faculty Publications and Presentations

Location technologies allow employers to monitor the location of employees. The technologies range from global positioning systems able to determine outdoor locations worldwide to sensor networks able to determine locations within buildings. Few international laws and no American laws directly address location monitoring. International privacy laws, the Electronic Communications Privacy Act, the USA Patriot Act and other laws involving Internet and e-mail monitoring might provide the pattern for future location monitoring legislation. Ethical considerations such as privacy, accuracy, inconsistency, security, and reputation also may affect future legislation. In writing corporate policies governing location monitoring, the employer’s business interests may outweigh …

College of Journalism and Mass Communications: Student Media

This year [2005] marks the 40th anniversary of the publication of Truman Capote’s In Cold Blood, considered one of the 20th century’s great works of literature. It also was among the first books in which the reporting techniques of journalism were assembled with the flair of traditional fiction writing.

The book is set in the community of Holcomb in 1959, when four members of a prominent farming family were killed in a fruitless robbery. Herbert and Bonnie Clutter and their children Nancy, 16, and Kenyon, 15, were shot by Perry Smith and Richard Hickock. The book details the crime, …
