Shifting The Focus From The Myth Of "The Vanishing Trial" To Complex Conflict Management Systems, Or I Learned Almost Everything I Need To Know About Conflict Resolution From Marc Galanter, John Lande Jan 2005

Shifting The Focus From The Myth Of "The Vanishing Trial" To Complex Conflict Management Systems, Or I Learned Almost Everything I Need To Know About Conflict Resolution From Marc Galanter, John Lande

Cardozo Journal of Conflict Resolution

To say that "The Vanishing Trial" is a myth is not to suggest that the facts or analysis in Professor Galanter's report are fictional or inaccurate. Indeed, he marshals a massive amount of data to show that the number of trials and the trial rates have been declining for the past four decades, particularly in the federal courts. The report documents an apparent paradox: the proportion of cases going to trial has dropped sharply during the past forty years despite substantial increases in many other legal indicators including the number of lawyers, the number of cases filed, and the amount …

Bacteria Fauna From The House Fly, Musca Domestica (L.), W.A. Nazni, B. Seleena, H.L. Lee, J. Jeffery, T.A.R. Rogayah, Mohd Sofian-Azirun Jan 2005

Bacteria Fauna From The House Fly, Musca Domestica (L.), W.A. Nazni, B. Seleena, H.L. Lee, J. Jeffery, T.A.R. Rogayah, Mohd Sofian-Azirun

Research Publications (2000 to 2005)

The house fly, Musca domestica has long been considered a potential agent for disease transmission ever since its existence. The general truth of this assertion remains undisputed till the present day in spite of increasing awareness toward an improved sanitation and better hygiene. The habitual movement of house fly from filthy substrata such as human faeces, animal excreta, carcasses, garbage, etc. makes them ideal candidates for disease transmission such as cholera, shigellosis, salmonellosis and others when settling on food. Fly as a potential mechanical vector of pathogenic bacteria was elucidated in this study by examining flies from various breeding sites …

Comparison Of Beta-Glucuronidase Expression And Anatomical Localization In Bombarded Immature Embryos Of Banana Cultivar Mas Via Biolistic Transformation, W.W. Chee, M. Jalil, M.O. Abdullah, R.Y. Othman, Norzulaani Khalid Jan 2005

Comparison Of Beta-Glucuronidase Expression And Anatomical Localization In Bombarded Immature Embryos Of Banana Cultivar Mas Via Biolistic Transformation, W.W. Chee, M. Jalil, M.O. Abdullah, R.Y. Othman, Norzulaani Khalid

Research Publications (2000 to 2005)

To obtain stable expression of a foreign gene, it is important to have optimized conditions for plant genetic transformation. Here, a GUS intron-containing gene driven by CaMV 35S promoter was used to optimize the conditions of biolistic transformation of banana immature embryos and also for the study of GUS localization in the transformed cells. The GUS activity detected histochemically and fluorometrically were further analysed by microscopy. This histological study confirmed the results in the histochemical and fluorometric assay, where highest expression of GUS was achieved when the immature embryos bombarded with the helium pressure of 1350 psi and placed at …

Plasmid Dna Analysis Of Pasteurella Multocida Serotype B Isolated From Haemorrhagic Septicaemia Outbreaks In Malaysia, H. Jamal, K.H. Chua, D. Frederick, A. Mahmood Ameen, I. Salmah Jan 2005

Plasmid Dna Analysis Of Pasteurella Multocida Serotype B Isolated From Haemorrhagic Septicaemia Outbreaks In Malaysia, H. Jamal, K.H. Chua, D. Frederick, A. Mahmood Ameen, I. Salmah

Research Publications (2000 to 2005)

A total of 150 purified isolates of Pasteurella multocida serotype B were used (Salmah, 2004) for plasmid DNA curing experiment to determine hyaluronidase activity, antibiotic resistance pattern (ARP) and mice lethality test (LD50) for their role of pathogenicity. A plasmid curing experiment was carried out by using the intercalating agent; ethidium bromide and rifampicin, where it was found all the plasmids had been cured (plasmidless) from Pasteurella multocida. All of these plasmidless isolates maintained their phenotypic characteristics. They showed the same antibiotic resistancepattern as before curing, produced hyaluronidase and possessed lethality activity in mice when injected intraperitoneally(i.p). Based on this …

Theory Of Femtosecond Coherent Anti-Stokes Raman Backscattering Enhanced By Quantum Coherence For Standoff Detection Of Bacterial Spores, Chong Heng Raymond Ooi, M.O. Scully, G. Beadie, G.W. Kattawar, J.F. Reintjes, Y. Rostovtsev, M.S. Zubairy

Research Publications (2000 to 2005)

Backscattered signal of coherent anti-Stokes Raman spectroscopy can be an extremely useful tool for remote identification of airborne particles, provided the signal is sufficiently large. We formulate a semiclassical theory of nonlinear scattering to estimate the number of detectable photons from a bacterial spore at a distance. For the first time, the theory incorporates enhanced quantum coherence via femtosecond pulses and a nonlinear process into the classical scattering problem. Our result shows a large backscattered signal in the far field, using typical parameters of an anthrax spore with maximally prepared vibrational coherence. Using train pulses of 1 kHz of repetition …

Educating Teachers For Moral, Civic And Citizenship Education: Challenges Ahead, L.H. Chang Jan 2005

Educating Teachers For Moral, Civic And Citizenship Education: Challenges Ahead, L.H. Chang

Research Publications (2000 to 2005)

Like any other formal subjects such as History or Mathematics, both Moral Education and Civic and Citizenship Education subjects have set or structured curriculum aims, objectives and content. These subjects would thus need teachers who have professional knowledge and expertise to conduct the most appropriate instructions and guidance in learning the subjects This paper will focus on the pre-service programme conducted at University of Malaya and the in-service orientation conducted by the Ministry of Education on educating teachers for teaching Moral Education that would have some implications to educating teachers for teaching Civic and Citizenship Education. However, due to lack …

Diversity: A Fundamental American Principle, David Orentlicher Jan 2005

Diversity: A Fundamental American Principle, David Orentlicher

Scholarly Works

In this article, Professor David Orentlicher argues that following the U.S. Supreme Court's affirmative action decisions in June 2003, both the Court in its defense of diversity and the commentators in their critiques of the diversity rationale have misjudged the public interest in diversity . Rather than having insufficient weight to justify affirmative action or reflecting a limited educational interest, diversity is a critical principle for much of American constitutional and social structure. In particular, the federalist system of government rests in large part on the belief that a diversity of approaches by the fifty states will lead to better …

North American Free Trade Agreement As A Two-Level Game And Implications For The Free Trade Area Of The Americas, Nicole E. Neubauer Jan 2005

North American Free Trade Agreement As A Two-Level Game And Implications For The Free Trade Area Of The Americas, Nicole E. Neubauer

Harriet L Wilkes Honors College Theses 2003 - 2009

The purpose of this paper is to break through the complexity of the NAFTA negotiations in order to reveal some of the contentious issues from three stages of the NAFTA bargaining process: the fast track agreement, the negotiations under President Bush, Sr., and the side payments under President Clinton. Putnam's two-level game theory will help describe how the interests of business, environmental groups, and labor unions influenced the outcome of the NAFTA through their respective win-sets, domestic and international power relations, and side agreements. Extrapolating from Putnam's model and the success in NAFTA bargaining, we can predict that the ongoing …

Ritual For Revolution, Michael Degani Jan 2005

Ritual For Revolution, Michael Degani

Harriet L Wilkes Honors College Theses 2003 - 2009

In the last 15 to 20 years, the failure of Communism as a viable revolutionary project has turned many on the Left to its historical rival: Anarchism. Merging with environmental discourses like deep ecology and the struggle for indigenous rights, Anarcho-Primitivism models its utopian discourse on ethnographic descriptions of hunter gatherer societies and mythologized notions of the "Noble Savage." Furthermore, its adherents retain high rates of visibility in the burgeoning antiglobalization movement, notorious for their black uniform and tactics of property destruction. My paper critically and pragmatically engages their attempts to invoke "the Primitive" as a metaphor for resisting the …

Teacher Learning: Documentation, Collaboration, And Reflection, William A. Parnell Jan 2005

Teacher Learning: Documentation, Collaboration, And Reflection, William A. Parnell

Dissertations and Theses

Inspired by the Municipal preprimary schools of Reggio Emilia, Italy, two art studio teachers and a researcher have explored experiences and meaning in the atelier. When studio teachers document children's thinking through digital photographs. transcribed audio tapes, quotations of a child's verbal thoughts, and copies of their work, an indescribable moment in teacher thinking interweaves with the child's learning, As teachers capture children's representations, investigate, interpret, and share their ideas with colleagues and community-an underlying question emerges. What are studio teachers' experiences o/teaching-learning in the atelier as they utilize documentation, collaboration, and reflection as a way to inform their practices? …

Progress And Economy: The Clash Of Values Over Oregon's Trojan Nuclear Plant, Gregory Nipper Jan 2005

Progress And Economy: The Clash Of Values Over Oregon's Trojan Nuclear Plant, Gregory Nipper

Dissertations and Theses

From 1976 to 1992 Portland General Electric (PGE) -- a private utility based in Portland, Oregon -- operated the Trojan Nuclear Plant near Rainier, Oregon, on the bank of the Columbia River. Trojan was the first commercial nuclear facility in the Pacific Northwest and was the largest such facility in U.S. history. From its origins, Trojan was the focus of growing conflict over atomic energy facilities and their environmental effects, risks, and costs. This thesis traces the history of Trojan, including the conditions in which PGE decided to build the plant as well as the changing conditions in which the …

Linking The Rule Of Law And Trade Liberalization In Jamaica, Rachel J. Anderson Jan 2005

Linking The Rule Of Law And Trade Liberalization In Jamaica, Rachel J. Anderson

Scholarly Works

Jamaica is one of several smaller countries that hope to improve their position in the global market, raise living standards, and strengthen democracy through trade liberalization. Adapting David Dollar's cycles of good governance, this article argues that sustainable trade liberalization, rule of law, and democracy are linked and that sustainable success in one area requires contemporaneous progress in the other two. It concludes that improving the rule of law in Jamaica is necessary for sustainable trade liberalization.

When You Wish Upon Dastar: Creative Provenance And The Lanham Act, Mary Lafrance Jan 2005

When You Wish Upon Dastar: Creative Provenance And The Lanham Act, Mary Lafrance

Scholarly Works

This Article examines the application of section 43(a) of the Lanham Act to claims of reverse passing off through the lens of the Supreme Court's unpersuasive effort in Dastar Corp. v. Twentieth Century Fox Film Corp. to exclude a single class of reverse passing off-claims - those involving “expressive” works as opposed to physical commodities - from the scope of section 43(a). The Article critiques the Court's analysis of section 43(a) in light of case law and the pertinent legislative history, including, the Trademark Law Revision Act of 1988, the Berne Convention Implementation Act of 1988, and the Visual Artists …
