Three Strategies Of Interpretation, Adrian Vermeule May 2005

Three Strategies Of Interpretation, Adrian Vermeule

San Diego Law Review

We may distinguish three styles or strategies of decisionmaking. Under a maximizing approach, the decisionmaker chooses the action whose consequences are best for the case at hand (defining "best" according to some value the decisionmaker holds). Where decisionmakers choose the action that is best relative to constraints, accounting for the direct costs and opportunity costs of decisionmaking, we may call the approach optimizing rather than maximizing. Whereas the maximizer focuses only on the case at hand, the optimizer acts so as to maximize value over an array of cases. In contrast to both approaches, satisficing permits any decision whose results …

There Is No Textualist Position, Stanley Fish May 2005

There Is No Textualist Position, Stanley Fish

San Diego Law Review

The Author argues that there is no textualist position because there is no candidate on behalf of whom a would-be textualist could argue. He argues that lexical items and grammatical structures by themselves will yield no meaning - will not even me seen as lexical items and grammatical structures - until they are seen as having been produced by some intentional agent. A text whose meaning seems perspicuous and obvious right off the bat is a text for which an intentional context has already been assumed, and it is also a text whose clarity and stability can always be troubled …

Moderate Versus Strong Intentionalism: Knapp And Michaels Revisited, Jeffrey Goldsworthy May 2005

Moderate Versus Strong Intentionalism: Knapp And Michaels Revisited, Jeffrey Goldsworthy

San Diego Law Review

In a series of articles published from 1980 to 1992, literary theorists Steven Knapp and Walter Benn Michaels advocated what the Author calls "strong intentionalism," the thesis that the meaning of a text is identical to the meaning that its author intended it to communicate. At the recent Conference on Legal Interpretation in San Diego, they vigorously defended their thesis. In this Article, the Author argues that their defense of stong intentionalism fails, and that the thesis is false.

Interpretation In Law, Dennis Patterson May 2005

Interpretation In Law, Dennis Patterson

San Diego Law Review

Interpretation is a familiar feature of law and legal practice. For some legal theorists, interpretation is a central - even foundational - aspect of law. I argue that interpretation is a parasitic activity in legal practice. In other words, I want to disagree with those who make the case for interpretation as a basic or fundamental feature of law. While interpretation is certainly an important element of legal practice, it is an activity that depends upon existing and widespread agreement among legal practitioners with respect to most features of legal practice. In short, interpretation is not the firmament of law. …

Event-Driven Document Selection For Terrorism, Zhen Sun, Ee Peng Lim, Kuiyu Chang, Teng-Kwee Ong, Rohan Kumar Gunaratna May 2005

Event-Driven Document Selection For Terrorism, Zhen Sun, Ee Peng Lim, Kuiyu Chang, Teng-Kwee Ong, Rohan Kumar Gunaratna

Research Collection School Of Computing and Information Systems

In this paper, we examine the task of extracting information about terrorism related events hidden in a large document collection. The task assumes that a terrorism related event can be described by a set of entity and relation instances. To reduce the amount of time and efforts in extracting these event related instances, one should ideally perform the task on the relevant documents only. We have therefore proposed some document selection strategies based on information extraction (IE) patterns. Each strategy attempts to select one document at a time such that the gain of event related instance information is maximized. Our …

A Pastiche Of Hope: Ethnography, Community, And Reconstructive Politics In The Performance Of Interview Texts, George Potter May 2005

A Pastiche Of Hope: Ethnography, Community, And Reconstructive Politics In The Performance Of Interview Texts, George Potter

All-Inclusive List of Electronic Theses and Dissertations

In the past fifteen years, the performance of interviews has become a pronounced theatric form, ranging from Sam Woodhouse's Nuevo California to Leigh Fondakowski's I Think I Like Girls and even, some would argue, to the postmodem deconstructions of race and ethnography found in much of Culture Clash's work. Despite all of this, Smith's Twilight: Los Angeles, 1992, Eve Ensler's The Vagina Monologues, and the Tectonic Theater's The Laramie Project remain the three interview-based plays that still receive the most attention, both through productions and academic discourse. Likewise, although not as widely discussed, Smith's newest interview-based work, House Arrest, provides …

Perceptions Of Mothers Labeled Adolescent Or Adult And Their Infants, Nichole L. Elliott May 2005

Perceptions Of Mothers Labeled Adolescent Or Adult And Their Infants, Nichole L. Elliott

Graduate Theses, Dissertations, and Problem Reports (ETD)

The aim was to examine how adolescent and/or unmarried mothers and their infants are perceived. Negative appraisals by others of adolescent and/or unmarried mothers and their infants may contribute to the difficulties they encounter. Psychology students viewed videotapes of adult mothers labeled as adolescent or adult and as unmarried or married interacting with their infants. Participants were asked to rate the infants, the mothers and their interactions. Results show that there were cases in which those labeled adolescent and unmarried were seen less positively than those labeled adult and married. There were also instances of counterintuitive findings of lower ratings …

Journey From Home, Benjamin P. Varela May 2005

Journey From Home, Benjamin P. Varela

Theses and Dissertations - UTB/UTPA

My art Is built on a foundation of personal experiences: First, as a child In New York City and Puerto Rico, and second, as a man learning his craft in universities and workshops in Wisconsin, Illinois, Texas, and Mexico. I categorize this deductive process as the emergence of the personal "Me,” because most artists develop a visual language of signs and symbols that has been shaped by the artist’s family, education, and personal experiences. It is also a deductive process that has shaped the personal “Me” through an analysis of my movement away from pernicious generalities, characterized by living under …

Do Principals Make A Difference? An Analysis Of Leadership Behaviors Of Elementary Principals In Effective Schools, Rosemarie Gomez Maciel May 2005

Do Principals Make A Difference? An Analysis Of Leadership Behaviors Of Elementary Principals In Effective Schools, Rosemarie Gomez Maciel

Theses and Dissertations - UTB/UTPA

Studies have shown principal instructional leadership behaviors to be a factor in student achievement. There has been little research on principal leadership instructional behavior in schools where the principal and student body are predominately Mexican-American.

This causal-comparative study examined the relationships among the school, the achievement scores of third grade students as measured by the reading portion of the Texas Assessment of Academic Skills (TAAS) and leadership behaviors of elementary school principals. A key variation in this study is that the sample is entirely comprised of Mexican-American leaders of schools that have undergone (within three years after the naming of …

Factors Of Placement Decisions Of Students With Learning Disabilities, April C. Yetsko

Theses and Dissertations - UTB/UTPA

This study looked at the factors that are involved in determining the placement decision of a child with a learning disability. Reading level, previous placement, initial placement, intelligence quotient, English proficiency and behavior were the factors examined in the study. Data was collected by examining the school files of children labeled as learning disabled in two school districts in south Texas. The different placement factors were studied to see which ones were most predictive of the number of hours a week that a student spent in a special education classroom. The research design utilized was a descriptive analysis, a correlation …

Bilingual Consumer Memory In The Advergaming Context: A Cross-Script Comparison, Monica D. Hernandez May 2005

Bilingual Consumer Memory In The Advergaming Context: A Cross-Script Comparison, Monica D. Hernandez

Theses and Dissertations - UTB/UTPA

Written language is the core of culture and central to marketing communications. The differences in language processing exhibited by Eastern/Western bilingual consumers are of great concern for global and multinational companies wishing to effectively promote their products through the Internet. Advergaming is a promotional method consisting of the delivery of advertising messages through electronic games. Despite recent scholarly interest, no previous research has compared brand memory across groups of bilinguals of different writing systems or scripts in the advergaming context.

The dissertation investigated differences in brand memory of bilinguals of languages based on different scripts. Specifically, a logographic-based language (Chinese), …

The Death Of The Subject-Impossible: An Analysis Of The Subject In Deconstruction And Psychoanalysis, Melinda Mejia

Theses and Dissertations - UTB/UTPA

It also addresses prevailing arguments which call into question the political dynamism of poststructuralist theories of the subject.

The Perceived Competency Of Hispanic Teachers In Teaching Classes Of Diversity Is A Function Of Demographic And Personality Traits, Melissa C. Martinez May 2005

The Perceived Competency Of Hispanic Teachers In Teaching Classes Of Diversity Is A Function Of Demographic And Personality Traits, Melissa C. Martinez

Theses and Dissertations - UTB/UTPA

For the past three decades, multicultural education has remained a focal point in the culture wars that United States education has encountered. Multicultural education is an educational reform movement that continues to evolve as ethnic minorities make their educational concerns and needs known. The forces driving the reform effort extend beyond linguistic and cultural diversity to include issues of academic diversity, gender, social class and sexual orientation (Wilhelm, 1998). How do educators address these needs, and how does the interaction among these diverse groups impact students and society?

The purpose of this paper is to determine the perceived competency of …

"Into The Light Of Christian Civilization": St. Elizabeth's Boarding School For Indian Children (1886-1967), Carole A. Barrett May 2005

"Into The Light Of Christian Civilization": St. Elizabeth's Boarding School For Indian Children (1886-1967), Carole A. Barrett

Theses and Dissertations

This study uses archival sources and oral history interviews to construct a history of St. Elizabeth’s Boarding School for Indian Children an institution sponsored by the Protestant Episcopal Church and located on the South Dakota side of the Standing Rock Reservation. St. Elizabeth’s opened in 1886 and closed in 1967. In the 1930s the school closed, and students attended a local public school; however, the mission continued to board children. Essentially the goals of the school, first set down by Bishop William Hobart Hare, continued to shape St. Elizabeth’s after it became a mission home. The major goal of this …

Consciousness And Inspiration In The Delsartean Theory, Elena Randi Apr 2005

Consciousness And Inspiration In The Delsartean Theory, Elena Randi

Mime Journal

Elena Randi observes how the analysis of the relationships between the moral and the physique constitutes a main theme in Delsarte’s theory. As far as the general subject of his study is concerned, Delsarte draws inspiration from the thought of the French idéologues . But as regards the nature of the intérieur , he takes a similar position to Degérando’s or Maine de Biran’s. These intellectuals, after participating in the movement of the idéologues , started investigating the same issues, but argued against their conclusions. Combining some views of Biran’s with concepts taken from the late eighteenth century debate on …

Iklan Lampau Indonesia Dalam Wujud Komik Analisis Bahasa Dan Grafis, Zeffry Alkatiri Apr 2005

Iklan Lampau Indonesia Dalam Wujud Komik Analisis Bahasa Dan Grafis, Zeffry Alkatiri

Wacana, Journal of the Humanities of Indonesia

As a powerful medium to persuade people to buy a product or service, ads have long been used in many forms. This study attempts to understand the language use and graphic design of comic as one of the ads forms in Jakarta-based Indonesian media, particularly in the period of 1940-1960s. By employing different approaches in Linguistic Anthropology, Mass Communication and Graphic Design, the findings show a close relationship between the language and the graphic design of the ads with the society who consumed them as well as a trend towards informal language use and popular culture.

Partikel Fatis Dalam Bahasa Mandarin; Sebuah Telaah Awal, Hermina Sutami Apr 2005

Partikel Fatis Dalam Bahasa Mandarin; Sebuah Telaah Awal, Hermina Sutami

Wacana, Journal of the Humanities of Indonesia

Phatic particles are rarely discussed, especially in the scope of syntax, even though the notion of phatic communion had been proposed by Malinowski in 1923. In Indonesian language, Harimurti (1986) had pioneered the inclusion of phatic expression into the Indonesian parts of speech. In Mandarin language, there has not been any special interest to discuss it. Generally phatic particles overlap with interjections and interrogatives. However, this article discusses about some evidences about the differences among them.

The Meno, Recollection, And The Role Of Hypothesis, Joseph A. Novak Apr 2005

The Meno, Recollection, And The Role Of Hypothesis, Joseph A. Novak

The Society for Ancient Greek Philosophy Newsletter

The aim of this paper is to present Plato's doctrine within a perspective that will both explain why Plato found himself prompted to formulate it, as well as explore some enduring insights exhibited in its applications. First, the paper will argue that Plato was prompted to adopt the doctrine given the difficulties that had arisen from the employment of the Socratic elenchus. Second, it will argue that hypothesis, already implicit in the elenchic method, will begin to be developed into a more complex and refined method that Plato sees necessary for the whole learning process. The retention of a hypothesis …

Moving From Impunity To Accountability In Post-War Liberia: Possibilities, Cautions, And Challenges, Rena L. Scott Apr 2005

Moving From Impunity To Accountability In Post-War Liberia: Possibilities, Cautions, And Challenges, Rena L. Scott

ExpressO

Liberia has become the quintessential example of an African failed state. Though Liberia’s civil war is officially over, war criminals are free and some are even helping run the transitional government under the authority of Liberia’s Comprehensive Peace Agreement (CPA). This peace agreement calls for the consideration of a general amnesty for those involved in the Liberian civil war alongside the parceling of governmental functions among members of various rebel groups. The drafters of the agreement claim that this was the only viable solution for sustainable peace in Liberia. Meanwhile, Charles Taylor relaxes in Nigeria’s resort city of Calabar. To …
