A Regression Analysis Of Predictors On The Productivity Indices Of Major League Baseball: 1985 – 2003, Jeremy Daniel Stick May 2005

A Regression Analysis Of Predictors On The Productivity Indices Of Major League Baseball: 1985 – 2003, Jeremy Daniel Stick

College of Education and Human Sciences: Dissertations, Theses, and Student Research

This ex post facto nonexperimental constructive replication study revisited earlier work by Grusky (1961, 1963), Gamson and Scotch (1964), and Gordon and Becker (1964) on whether Major League Baseball (MLB) managerial succession reflected scapegoating behaviors. Also there was interest in learning if selected independent variables were predictive of a team’s won-loss record, termed the productivity index.

Nineteen-years of relevant data was collected from 26 of the 30 MLB teams. The four excluded were relatively new expansion teams. The dependent variable of team efficiency, a productivity index, was the won-loss records during the tenure of a specific manager with a given …

This article examines social presence in virtual asynchronous learning communities among foreign language teachers. We present the findings of two studies investigating cross-institutional asynchronous forums created to engage participants in online dialogues regarding their foreign language teacher preparation experiences in and out of the classroom. Both studies took place during Fall 2003 and were conducted between first-time teacher/graduate students in four methodology courses at three large state universities. In the first study, students participated in weekly online exchanges in the form of dialogue journals for reflective teaching. In the second study, students were provided with specific topics to address using …

Consonant Cluster Simplification In Korean Codas: Language-Internal And Language-External Constraints Interface With Reference To Optimality Theory, Youn-Jeoung Choi May 2005

Consonant Cluster Simplification In Korean Codas: Language-Internal And Language-External Constraints Interface With Reference To Optimality Theory, Youn-Jeoung Choi

Linguistics & TESOL Dissertations - Archive

In Korean, when a morpheme contains a coda cluster in its underlying form (such as /salm/‘life,’ /hulk/‘soil’), we observe two outcomes in its surface representation. In cases when the morpheme followed by either another consonant or by a word boundary, the cluster is simplified by deleting one consonant. However, if a vowel-initial morpheme follows the underlying cluster, the second member of the cluster assumes the role of a syllable onset. Contrary to prescriptive accounts in which both the deleted consonant and the results of resyllabification are claimed to be completely predictable, observation of contemporary Korean usage suggest that there is …

A Linguistic Analysis Of Negative Stereotypes In African American Sitcoms And Their Effects In The Professional African American Female, Tamara D. Allen May 2005

A Linguistic Analysis Of Negative Stereotypes In African American Sitcoms And Their Effects In The Professional African American Female, Tamara D. Allen

Theses (Pre-2016)

For decades white writers, producers and directors have controlled African American sitcoms and they decide what information is decimated to the public about African Americans. The perceptions of white writers, producers, and directors of African Americans have filtered racial misconceptions harming the African American community. Previous research shows that African Americans have been portrayed as clowns, servants, and buffoons in African American sitcoms, thus creating negative stereotypes. This study researches behavior and the language used in African American sitcoms and the affect they have on the professional African American woman in the workplace and in public settings. One hundred and …

Two survey instruments were used to collect data for this study: the Intelligence Survey (IS), and the MI-Inspired Teaching Strategy Index (MITSI). This study was delimited to ESL teachers who had been enrolled in the ESL endorsement program at the University of Nebraska at Omaha (UNO). Results indicated that the …

The True Patron Of Ireland : Saint Brigit And The Rise Of Celtic Christianity, Autumn Dolan May 2005

The True Patron Of Ireland : Saint Brigit And The Rise Of Celtic Christianity, Autumn Dolan

Honors Theses

When Saint Patrick landed in Ireland in 432 AD, history says that he brought Christianity to the Irish. In actuality, though, Patrick's arrival was the beginning of a religious struggle between Rome and Ireland. Patrick's Church was based on Roman traditions and his mission in Ireland was not just to defeat paganism, but to intercede in the foundations of an already developing Celtic Church. To challenge Patrick and his Roman ways, Ireland exalted a saint of its own. Saint Brigit ( 452-525 AD) and the characteristics she represented in Irish hagiography clearly illustrated the ideal Irish saint. Ireland's reverence for …

Equality, Objectivity, And Neutrality, Alafair S. Burke May 2005

Equality, Objectivity, And Neutrality, Alafair S. Burke

Michigan Law Review

When is homicide reasonable? That familiar, yet unanswered question continues to intrigue both courts and criminal law scholars, in large part because any response must first address the question, "reasonable to whom?" The standard story about why that threshold question is both difficult and interesting usually involves a juxtaposition of "objective" and "subjective" standards for judging claims of reasonableness. On the one hand, the story goes, is a "subjective" standard of reasonableness under which jurors evaluate the reasonableness of a criminal defendant's beliefs and actions by comparing them to those of a hypothetical reasonable person sharing all of the individual …

An Examination Of The Minority Organ And Tissue Donor Crisis, Therisa Yvonne Callier May 2005

An Examination Of The Minority Organ And Tissue Donor Crisis, Therisa Yvonne Callier

Theses (Pre-2016)

The importance of organ and tissue donation in the minority community has been very slow in gaining acceptance. The communicative challenge in the minority community has been historically hampered by fear of such drastic medical procedures. Information regarding organ and tissue donation has only recently begun to emerge in minority communities. In these communities, the shortage of organs is incredibly critical. The ineffective communications of the life saving benefits of organ and tissue transplantation in the minority community can be attributed to many factors. This thesis examined three critical factors regarding the reasons why communication has not been successful in …

The Effect Of Teaching With Acoustical Guidance (Tag) On The Mastery Of A Grand Rond De Jambe (En Dehors) And A Ballotte, Heidi Dutch Schneider

Theses and Dissertations

This study examined the effect of Teaching with Acoustical Guidance (TAG) on the mastery of two ballet skills, the Grand Rond de Jambe (en dehors) and a Ballotte'. Dance technique classes still follow traditional methods of teaching and mastering skills without much integration of motor learning concepts. TAG Teach is a method that uses positive reinforcement, shaping, and a hand held device that produces an acoustic sound to mark correct behaviors at the moment they occur. The purpose of this study was to determine if TAG was a faster and more effective technique to aid in the mastery of two …

Judging The Law Of Politics, Guy-Uriel Charles May 2005

Judging The Law Of Politics, Guy-Uriel Charles

Michigan Law Review

Election law scholars are currently engaged in a vigorous debate regarding the wisdom of judicial supervision of democratic politics. Ever since the Court's 1962 decision in Baker v. Carr, the Court has increasingly supervised a dizzying array of election-related matters. These include the regulation of political parties, access to electoral ballots, partisanship in electoral institutions, the role of race in the design of electoral structures, campaign financing, and the justifications for limiting the franchise. In particular, and as a consequence of the Court's involvement in the 2000 presidential elections in Bush v. Gore, a central task of election …

National Identity In A Multicultural Nation: The Challenge Of Immigration Law And Immigrants, Kevin R. Johnson, Bill Ong Hing May 2005

National Identity In A Multicultural Nation: The Challenge Of Immigration Law And Immigrants, Kevin R. Johnson, Bill Ong Hing

Michigan Law Review

Samuel Huntington's provocative new book Who Are We?: The Challenges to National Identity is rich with insights about the negative impacts of globalization and the burgeoning estrangement of people and businesses in the United States from a truly American identity. The daunting question posed by the title of the book is well worth asking. After commencing the new millennium with wars in Afghanistan and Iraq, U.S. military torture of Iraqi prisoners, indefinite detentions of U.S. citizens declared by the President to be "enemy combatants," and a massive domestic "war on terror" that has punished and frightened Arab, Muslim, and other …

Legislative Intentions, Legislative Supremacy, And Legal Positivism, Jeffrey Goldsworthy May 2005

Legislative Intentions, Legislative Supremacy, And Legal Positivism, Jeffrey Goldsworthy

San Diego Law Review

In this Article, the Author argues that the debate about the reality of legislative intentions and their utility in statutory interpretation is much more important than is generally realized. Its outcome could affect both the constitutional doctrine of legislative supremacy and the philosophy of legal positivism. Briefly stated, his argument will be that, for practical reasons, skepticism about legislative intentions threatens to undermine the doctrine of legislative supremacy.

Not A Matter Of Interpretation, Steven Knapp, Walter Benn Michaels May 2005

Not A Matter Of Interpretation, Steven Knapp, Walter Benn Michaels

San Diego Law Review

This Article explores the basic question of statutory interpretation. The disagreement among scholars is a theoretical one - it is a dispute about what the proper object of interpretation should be, about whether it should be what Scalia calls "the objective indication of the words" (what the authors said), or whether it should be "the intent of the legislature" (what the authors meant).

All Peer-Reviewed Publications

Rhabditis (Oscheius) colombiana n. sp. is described as a necromenic associate of the burrower bug Cyrtomenus bergi (Hemiptera: Cydnidae) collected in the Cauca Valley, Colombia. The new species resembles others of the insectivora-group, viz, Rhabditis (O.) insectivora Körner, 1954 and Rhabditis (O.) lucianii Maupas, 1919, in a number of morphological and life history traits, but can be separated by a combination of morphological and morphometric characters. The most distinctive morphological features that separate R. (O.) colombiana n. sp. from these two Rhabditis species are the total size of both males and females, which are much shorter and slimmer in the …

Becoming Multicultural Teachers: An Exploration Of Transformation In White Female Elementary Educators, Lee Woodham Digiovanni May 2005

Becoming Multicultural Teachers: An Exploration Of Transformation In White Female Elementary Educators, Lee Woodham Digiovanni

College of Graduate Studies: Theses & Dissertations

As the population of the United States becomes more diverse, and the teaching force remains predominantly White, multicultural education becomes more and more important. Many White elementary educators, however, treat multicultural education in a very cursory, shallow way. Some educators, however, have moved beyond a cursory approach to multicultural education. Utilizing feminist standpoint theory informed by postpositivist realism and critical race theory, this study examines the experiences of three White female elementary educators in the same school system in the Metropolitan Atlanta area who have moved beyond cursory implementation of multiculutral teaching. Potential participants were screened using the White Racial …

The European Neighborhood Policy And Its Impact On The Israel - European Union - United States Triangle, Guy Harpaz May 2005

The European Neighborhood Policy And Its Impact On The Israel - European Union - United States Triangle, Guy Harpaz

San Diego International Law Journal

This Article is not intended to deal with the feasibility of successfully implementing the [European Neighbourhood Policy] ENP, nor does it address its normative aspects from the European perspective. Instead, this article assumes that the parties will successfully implement the ENP, and on the basis of that assumption, attempts to provide a first, critical and interdisciplinary examination of the potentially significant impact of the ENP on the legal, economic, social, and trade landscape of the State of Israel, her citizens, economy, and on her relations with the EU and the United States.

Word Meaning In Legal Interpretation, Walter Sinnott-Armstrong May 2005

Word Meaning In Legal Interpretation, Walter Sinnott-Armstrong

San Diego Law Review

Professor Sinnott-Armstrong argues against the arguments published by Professor Prakash and Professor Alexander in an article on legal interpretation in which they defended the thesis that all interpretation properly so-called seeks to uncover the intended meaning of the author(s). Against their arguments, the Author defends coherence and importance of word meaning. In Part I, he more precisely defines the these that Alexander and Prakash deny and Professor Sinnott-Armstrong defends. In Part II, he will show why Alexander and Prakash's arguments fail to rule out word meanings. In PArt III, he will put these debates in a larger theoretical context and …

A Synthetic Approach To Legal Adjudication, Samuel C. Rickless May 2005

A Synthetic Approach To Legal Adjudication, Samuel C. Rickless

San Diego Law Review

Almost every interesting dispute that arises under the law is the product of disagreement among reasonable and competent speakers of the language of the relevant provision. If the meaning of the provision is not clear, then, even if the facts are fixed, how the judge should proceed is a matter of controversy. The Author offers three main suggestions.

A Pluralist Approach To Interpretation: Wills And Contracts, Kent Greenawalt May 2005

A Pluralist Approach To Interpretation: Wills And Contracts, Kent Greenawalt

San Diego Law Review

This account of legal interpretation focuses mainly on wills and contracts. It adopts a pluralist approach, one that treats a number of factors as potentially relevant and does not assume that all relevant factors necessarily reduce to one overarching inquiry that is the same whatever legal text is being interpreted.
