Corruption: Market Reform And Technology, Murali Patibandla, Amal Sanyal
Corruption: Market Reform And Technology, Murali Patibandla, Amal Sanyal
Working Papers
The paper provides a taxonomy of corrupt activities in terms of the source of illegal rent involved. It identifies two types of deterrent policies: discouraging and monitoring. Using these as tools, it analyses the probable effects of India's ongoing reforms and of her resourceful information and communication technology on the future incidence of corruption. It argues that illegal rents on scarcity outside governance will experience perceptible fall, while significant contribution from the technology sector will be required to reduce corruption in governance. The paper also examines their possible roles in corruption based on information and strategic position.

National Security And U.S. Child Health Policy: The Origins And Continuing Role Of Medicaid And Epsdt, Sara J. Rosenbaum, D. Richard Mauery, Peter Shin, Julia Hidalgo
Health Policy and Management Issue Briefs
Medicaid has touched the lives of half of all of the low income young adults of prime military service age. The roots of Medicaid's unique child health eligibility and coverage policies can be traced to a seminal, 1964 government study entitled One Third of a Nation: A Report on Young Men Found Unqualified for Military Service. This study analyzed the underlying causes of the astounding 50 percent rejection rate among the young men drafted into the military in 1962. It documented pervasive evidence of treatable and correctable physical, mental, and developmental conditions, and its findings influenced the course of Medicaid …

Ethical Standards Of Japanese Lawyers: Translation Of The Ethics Codes For Six Categories Of Legal Service Providers, Kyoko Ishida
Ethical Standards Of Japanese Lawyers: Translation Of The Ethics Codes For Six Categories Of Legal Service Providers, Kyoko Ishida
Washington International Law Journal
Today, Japanese attorneys and so-called "quasi-lawyers" (jun hōritsuka) face significant regulatory reforms to the legal services they provide. The justice system reform (shihō seido kaikaku) significantly expanded the scope of practice for quasi-lawyers in order to meet the country's growing need for legal assistance. Also, in November 2004 attorneys established new ethical standards which also apply to registered foreign business attorneys for the preparation of upcoming increase of population of attorneys. In contrast to the United States, where attorneys provide legal services almost exclusively, there are several licensed legal service providers other than attorneys (bengoshi …

Faculty Ethics In Law School: Shirking, Capture, And "The Matrix", Jeffrey L. Harrison
Faculty Ethics In Law School: Shirking, Capture, And "The Matrix", Jeffrey L. Harrison
UF Law Faculty Publications
The primary focus of this essay is the ethical dimension of the decisions faculty governance requires law professors to make. This essay is devoted to the proposition that conditions are ideal for most law schools to be governed for the benefit of the faculty at the expense of the welfare of students and others (stakeholders) who expect to be served by the law school. This section also suggests that faculty shirking, if it occurs, stems primarily from a lack of respect for those whom the law school serves. Section II addresses the second step. Having described shirking and capture in …

Women In Prison In Massachusetts: Maintaining Family Connections, Erika Kates, Paige Ransford, Carol Cardozo
Publications from the Center for Women in Politics and Public Policy
This report first provides an overview of the statistical data on women in prisons in the U.S. over the past two decades. It pays particular attention to the literature on the effects of mothers' incarceration on their children and the gradual recognition of the emotional, economic, and legal consequences for families when parents, especially mothers, are incarcerated. When viewed in this broad context it becomes clear that the concerns and challenges families face extend beyond the perimeters of a single agency or policy area. We then present the comprehensive Family Connections Policy Framework we created for assessing the status of …

Computer Crime And Control In Hong Kong, Kam C. Wong
Computer Crime And Control In Hong Kong, Kam C. Wong
Washington International Law Journal
This Article is a first attempt to study cyberspace governance and computer crime control in Hong Kong. It begins with a discussion of how computer crime was "discovered" as a cognizable object of control. Next, it explores the nature, prevalence and distribution of computer crime in Hong Kong before embarking on a comprehensive review and critical analysis of the Hong Kong government's cyberspace governance philosophy and computer crime control policy. The Article closes with a number of recommendations for improving Hong Kong cyberspace governance, which focus on developing a broad, overarching policy that both meets the public's goals and addresses …
Are You A Fleeing Felon? A Call For The Social Security Administration To Adhere To Its Fugitive Felon Provision's Plain Meaning To Prevent Unfair And Unsuspecting Benefit Suspensions Of Non-Fleeing Ssi Recipients, Brandon G. Myers
Utah Law Review
In 1996, Congress adopted fugitive felon provisions as part of a comprehensive welfare overhaul to ensure that public funds are not employed to fuel a fugitive's escape from the law. Subsequently, the SSA incorporated the provision into its administrative bylaws with language that suspends the SSI benefits of disabled individuals who have warrants out for their arrest and are fleeing to avoid prosecution. Indeed, the SSA has worked successfully with the FBI and local law enforcement agencies to both apprehend fugitive felons and suspend SSI benefits, thereby fulfilling the provision's measure. However, the SSA has interpreted the provision's phrase "fleeing …

The Limits Of Multiple Rights And Remedies: A Call For Revisiting The Law Of The Workplace, Ann C. Hodges
Law Faculty Publications
The IBM decision illustrates two major problems with current workplace regulation. First, there are two distinct but overlapping systems - the individual and the collective - which often collide. The result is, at best, an imperfect realization of rights under both systems, and perhaps more often, the sacrifice of rights under one to rights under the other. Second, the multitude of forums available for litigation results in multiple claims arising out of the same action, as well as tribunals deciding issues outside their expertise. After analyzing the IBM decision, I will consider the costs and benefits of the current regulatory …
