Scholarly Articles in Law Reviews & Journals
Among the more than 100 jurisdictions with active competition policy regimes today, the United States has the distinction of starting first, creating the most extensive set of judicial precedents, and possessing the largest and most experienced enforcement institutions. Antitrust institutions in the United States have long stood at the summit on any scale of international prestige and influence in the competition policy field. Yet any such ranking would also undoubtedly indicate that during the last decade or so, the antitrust institutions of the European Union have grown in size and sophistication to the point where they are comparably respected and …

Reforming Welfare Reform Postsecondary Education Policy: Two State Case Studies In Political Culture, Organizing, And Advocacy, Charles Price
Reforming Welfare Reform Postsecondary Education Policy: Two State Case Studies In Political Culture, Organizing, And Advocacy, Charles Price
The Journal of Sociology & Social Welfare
Welfare reform had the unforeseen effect of causing large numbers of public assistance recipients to drop out of college, discouraging their pursuit and acquisition of postsecondary education (PSE) credentials. There is a growing body of research that shows the value of postsecondary education in getting public assistance recipients onto a path toward occupational and social mobility. The restrictions of Temporary Assistance to Needy Families PSE policy, coupled with the recognition that college participation should be an option for qualified welfare recipients, influenced the emergence of many successful state and county-level movements focused on reforming welfare reform PSE policy. Their work …

Is Forum-Shopping Corrupting America's Bankruptcy Courts? Review Of Lynn M. Lopucki, "Courting Failure: How Competition For Big Cases Is Corrupting The Bankruptcy Courts", Todd J. Zywicki
George Mason University School of Law Working Papers Series
In his new book, Courting Failure: How Competition for Big Cases is Corrupting the Bankruptcy Courts, Professor Lynn LoPucki’s book argues that that current bankruptcy venue rules have spawned an improper “competition for big cases” that has “corrupted” America’s bankruptcy courts. LoPucki argues that this competition has harmed the bankruptcy system and the economy, transferring wealth from creditors and employees to incumbent management and bankruptcy professionals. He also argues that the competition that has corrupted the American bankruptcy system is being replicated internationally, resulting in a similar competition and similar harm on the global stage.
This essay reviews LoPucki’s book …

Healthcare Resources For Older Adults In A Medium Sized Community, Ashley Nielson
Healthcare Resources For Older Adults In A Medium Sized Community, Ashley Nielson
Undergraduate Honors Capstone Projects
Healthcare has become a large concern for a number of older Americans. With increases in healthcare costs and complex programs such as, Medicare, Medicaid, Medigap insurance policies and community programs, many older Americans are left worrying where they will find the money and resources to provide for themselves and their healthcare needs. Medicare, Medicaid and community care resources help to offset individual healthcare costs, but they are often not enough. The programs are complex and confusing and are limited in the care they provide.

Broadening The Holistic Mindset: Incorporating Collateral Consequences And Reentry Into Criminal Defense Lawyering, Michael Pinard
Broadening The Holistic Mindset: Incorporating Collateral Consequences And Reentry Into Criminal Defense Lawyering, Michael Pinard
Faculty Scholarship
In this article, Professor Michael Pinard highlights the holistic model of criminal defense representation, which seeks to address the myriad issues that often lead to the client’s involvement with the criminal justice system with the overarching goal of providing a comprehensive solution to those underlying factors. While lauding these developments, however, Professor Pinard argues that the holistic model has largely overlooked two facets of the criminal justice system that impact greatly the client’s life once the formal representation has concluded: the collateral consequences of criminal convictions and reentry. Professor Pinard explores the emerging attention devoted to these two components, but …
