May the federal government require local governments to cooperate with the enforcement of immigration law or other federal scheme? Or may local governments constitutionally refuse to provide that cooperation?

I use immigration law enforcement as a case study to argue that the current legal framework, which allows the federal government to mandate local cooperation, ignores the significant federalism harms that federal cooperation laws impose. And these federalism harms are not simply limited to the immigration field. In other areas where federal and local governments disagree (e.g., medical marijuana, stem cell research, and physician-assisted suicide), there is similar potential for conflict …

Wiley Rutledge And Executive Detention: A Judicial Conscience For His Time And Ours, Craig Green

Wiley Rutledge is a Justice whom biographers forgot -- until John Ferren's recent book. This Review of Ferren's work shows that Rutledge was uniquely important in WWII cases concerning executive detention. Comparing cases from that era to Rasul, Hamdi, and Hamdan, I suggest that Rutledge's legal approach (and the continuation of such efforts on today's Court) uncover two novel arguments for judicial review of military commissions. Rutledge's story also invites us to rethink how we evaluate judicial "heroes," and which judicial biographies are truly worth reading.

Teaching Legal Research And Writing With Actual Legal Work: Extending Clinical Education Into The First Year, Steven D. Schwinn

In this article, we advocate using actual legal work to teach legal research and writing courses, including first year courses. By “actual legal work,” we mean work that is part of an ongoing or planned lawsuit, transaction, negotiation or other form of legal representation. We offer an overview and critique of the traditional legal writing curriculum, and we describe our initiatives to build upon and enhance that curriculum with the use of actual legal work. We conclude with some thoughts on the relative merits of our approach and ideas for following our model.

The Lawyer As A Portfolio Manager: How Does The Fee System Influence On The Lawyer's Decision Of Handling Legal Claim?, Christian At, Nathalie Chappe

We use the portfolio theory to analyze the lawyer's decision regarding the type of case the lawyer will handle. We offer some insights into the widespread idea that contingency lawyers are providing a risk sharing service. We demonstrate that a contingent fee lawyer diversifies his portfolio. We show that reputation induces more, but not fully, concentration, since a lawyer with greater reputation or expertise selects more risky cases. The size of the law firm has the same result.

Looking Beyond The Shipyard: Economic Development Challenges Of Southern Maine And Seacoast New Hampshire, Charles S. Colgan

Regional Studies

The threatened closure of the Portsmouth Naval Shipyard has spurred an intense examination of the future economic prospects for York County, Maine and Rockingham County, New Hampshire. This report provides the first integrated analysis of the shipyard’s effects on both the Maine and New Hampshire economies. The shipyard accounts for more than 10,000 direct and indirect jobs across the two-state region. Over 80% of these jobs are in York County, with an additional 10% in Rockingham County and the balance spread through the rest of Maine and New Hampshire. The total jobs associated with the shipyard account for 3.5% of …

I would like to start by stating a proposition that may strike you as either simple-minded or self-evident, but, more likely, will simply seem strange because of the way in which I state it. My proposition is this: In a democratic society, the legal profession, its rights and privileges, exist to serve public purposes. The legal profession serves two principal public purposes: to provide representation to those who lack the specialized training to represent themselves, that is, non-lawyers, and to promote justice in society.
