The Counter-Reformation Of The Security Council, Mary Ellen O'Connell Jan 2005

The Counter-Reformation Of The Security Council, Mary Ellen O'Connell

Journal Articles

This article examines the 2003-2005 reform initiative relative to the Security Council's authority over the use of force. It looks at why the reform discussion began, what proposals grew out of the discussion, and the legal situation following the 2005 World Summit. The conclusion here is that the reform process has had positive results for the international legal regulation of the use of force, human rights protection, and international law generally. International law scholars are in a position to build on these results, supporting the revival and renewal of Charter law, explaining what exactly that law requires and why, and …

Shopping For Law In A Coasean Market, G. Marcus Cole Jan 2005

Shopping For Law In A Coasean Market, G. Marcus Cole

Journal Articles

In the twentieth century, two Nobel-Prize winning economists wrote two seemingly unrelated characterizations of the processes constraining human behavior. One, Ronald Coase, wrote a short article entitled The Nature of the Firm,1 in which he reduced all managerial decision-making to a fundamental choice between making the factors of production, or buying them. This article and the idea of the "make or buy" decision for which it has come to be known, have proven to be among the most seminal in the history of financial economics and organizational behavior.

The second economist, Friedrich Hayek, wrote what he thought to be a …

Response To Endicott: The Case Of The Wise Electrician, Gerard V. Bradley Jan 2005

Response To Endicott: The Case Of The Wise Electrician, Gerard V. Bradley

Journal Articles

Timothy Endicott tells the tale of the "wise electrician." The main activities of the Wise Electrician are two. One is that he installs legally required Grade 5 insulation in everyone's home save one. The second is that on his own ceiling light circuits he uses Grade 4 insulation, which cheaper to acquire and, in his professional judgment, it is safe. In fact, the Wise Electrician would install Grade 4 in those houses, too, but for one fact: it would be illegal. What makes our man so interesting is that it is illegal to install Grade 4 in his house too. …

Medical Malpractice Crisis: A Problem With No Answer, The, Chandler Gregg Jan 2005

Medical Malpractice Crisis: A Problem With No Answer, The, Chandler Gregg

Missouri Law Review

The current “medical malpractice crisis” can be solved by examining and solving the several factors that are the root cause. This Comment looks at the changes that have been made in the way of tort reform and will analyze the problems that past tort reform efforts have ignored. It will also suggest alternative remedies to get the health care system on its way to becoming a system where fewer medical mistakes are made, injured plaintiffs are adequately compensated, and doctors can most effectively and efficiently operate.

Language Use And The Oral Tradition In Aaya (African American Young Adult) Literature, Kaavonia Hinton-Johnson Jan 2005

Language Use And The Oral Tradition In Aaya (African American Young Adult) Literature, Kaavonia Hinton-Johnson

Teaching & Learning Faculty Publications

(First paragraph) In elementary school my favorite teachers taught me that the language used in my home was incorrect, incoherent, and inappropriate. My second grade teacher Ms. Hull, a tall, thin, dark-skinned woman, stands out among the others. I can still see her hovering over us. “Was!” Ms. Hull shouted, “not wuz. Your tongue is lazy.” “You be what?” she’d ask in disgust with one hand on her hip. When this happened, I was sure to get yelled at and lectured. To avoid such humiliation, I quickly learned to, as we said in my neighborhood, “talk proper.” Shame nagged at …

Influence Of Sub-Cultures On Planned Organizational Change In A Community College: An Exploratory Case Study, Mary G. Locke

Electronic Theses and Dissertations 2000 - 2009

The purpose of this research study was to explore and increase understanding of the ways in which sub-cultural groups within a community college may differently experience, respond to, and influence the organization's efforts to engage in purposeful change. To accomplish this purpose, an exploratory case study was conducted focusing on a medium-sized community college which was engaged in a multi-faceted institution-wide planned change initiative throughout the duration of the study. Qualitative research methods, including focus groups, individual interviews, an anonymous open-ended questionnaire, participant observations and review of archival documentation were utilized to identify, analyze, contrast and compare the perceptions, beliefs …

Magnetic Appeal Of Nurse Informaticians: Caring Attractor For Emergence, Todd D. Swinderman

Electronic Theses and Dissertations 2000 - 2009

The purpose of this phenomenological study was to understand the meaning of transition from the art of handwritten nursing documentation to electronic documentation from the lived experiences of nurse informaticians. Chaos Theory within Complexity Sciences and Ray's Bureaucratic Caring Theory informed the study. The Swinderman Research Model was created to visualize the tension between order and chaos in nursing practice. Twelve nurse informaticians were interviewed about their experiences in designing, building, implementing and supporting electronic nursing documentation systems using van Marten's human science phenomenological method. Descriptive themes where illuminated and metathemes were interpreted from the research data. The universal whole …

Mate Retention And Copulation Frequency In Humans: Complementary Anti-Cuckoldry Tactics, Faith E. Guta Jan 2005

Mate Retention And Copulation Frequency In Humans: Complementary Anti-Cuckoldry Tactics, Faith E. Guta

Electronic Theses and Dissertations 2000 - 2009

Guarding oneself from cuckoldry can be a challenging task for males of socially monogamous species. Accordingly, human males may possess evolved psychological mechanisms designed to prevent their partner's infidelity, and to "correct" that infidelity if it occurs. Because preventative tactics are not failsafe, I hypothesized that men's reports of their mate-retention behaviors and copulation frequency would function as complimentary tactics (Study 1). Research has suggested that men's reports of their own anti-cuckoldry behaviors can be flawed, and that women may be more accurate. Therefore, Study 2 analyzed reports made by women of copulation frequency and their partner's mate-retention behaviors. In …

Monique Wittig And The Queer Theory Movement: Descendents And Disputes, Arthur F. Tang Jan 2005

Monique Wittig And The Queer Theory Movement: Descendents And Disputes, Arthur F. Tang

Electronic Theses and Dissertations 2000 - 2009

French feminist writer and theorist, Monique Wittig, theorizes from a nonessentialist, materialist lesbian position to posit categories of sex and gender as social constructions, thereby contesting what she terms the heterosexual regime. Because her social theory and literary praxis inform the thinking of leading figures associated with Queer theory, such as Judith Butler, Eve Kosofsky Sedgwick, and Teresa de Lauretis, Wittig is often considered a precursor to the Queer theory movement. As Queer studies gain purchase in academic curricula, it is timely to assess Wittig's historical contribution to the Queer theory movement and her future pertinence to it as a …

Obstruction Of Chloride Diffusion In Concrete By Embedded Reinforcing Bars, Pascal. Cros Jan 2005

Obstruction Of Chloride Diffusion In Concrete By Embedded Reinforcing Bars, Pascal. Cros

Electronic Theses and Dissertations 2000 - 2009

A study was performed of the effect of reinforcing bars on chloride diffusion into concrete. These bars act as obstacles to chloride movement, and this obstruction allows the chloride concentration to build-up faster along the top of the reinforcing bar than elsewhere. As a consequence, the critical chloride threshold to initiate corrosion of the steel is reached sooner than otherwise expected. This research was performed using two different methods. First, chloride analyses were performed on chloride exposed concrete blocks by taking cores in the concrete and drillings along the trace of the top bars. Second, concrete blocks models were analyzed …

On Financing With Convertible Debt Over The Last Two Decades, Camelia S. Rotaru Jan 2005

On Financing With Convertible Debt Over The Last Two Decades, Camelia S. Rotaru

Electronic Theses and Dissertations 2000 - 2009

Despite extensive research, the rationale behind firms' decision to issue convertible debt is still unknown. On average, results indicate that the market reacts more negatively to new convertible debt issues of companies with higher cash ratios. Hence, I test whether convertible issuers are companies with limited access to the debt and equity markets. I find that pre-1990 issuers have a propensity to accumulate cash out of their cash flows prior to the convertible debt issue. Moreover, I provide strong evidence that convertible issuers substitute cash for both short-term debt and non-cash net working capital. I also test the pricing of …

Peacemakers On The Home Front: Clemenceau, Lloyd George, Wilson And The Treaty Of Versailles Ratification Debates, Laurie W. Cotton Jan 2005

Peacemakers On The Home Front: Clemenceau, Lloyd George, Wilson And The Treaty Of Versailles Ratification Debates, Laurie W. Cotton

Electronic Theses and Dissertations 2000 - 2009

This inquiry considers the nature of the treaty ratification debates in France, England, and the United States from the June 28, 1919 signing of the Versailles Treaty until its final repudiation by the U.S. Senate in March 1920. It has two main linked objectives: to examine the agendas of Clemenceau, Lloyd George, and Wilson and the strategies each employed in their attempts to convince their constituents to accept the treaty package, and to argue that the peace these executives negotiated was by no means a foregone conclusion at the treaty signing since legislative approval was required in each case. In …

Politics, Citizenry, And Tabloid-Style Journalism: The Case Of The Clinton/Lewinsky Scandal, Stein Amber Nicole Pradines Jan 2005

Politics, Citizenry, And Tabloid-Style Journalism: The Case Of The Clinton/Lewinsky Scandal, Stein Amber Nicole Pradines

Electronic Theses and Dissertations 2000 - 2009

Tabloids, often defined by the half-broadsheet size of regular newspapers, feature titillating, sensationalized stories of crime and/or scandal offered in a piquant manner. The exploratory study asks how the tabloid style was manifested in the coverage of the Clinton/Lewinsky scandal of 1998 and related news, thereby fostering a hegemony in which the citizenry was distracted from more important political issues and events. The study also assesses how a critique of such tabloidization developed among journalists and scholars during the scandal. The print media analyzed are the tabloids Star magazine, The National Enquirer, and Globe , and mainstream media The New …

Reproductive Success, Territory Size, And Predation Pressures Of The Florida Scrub-Jay (Aphelocoma Coerulescens) At Savannas Preserve State Park, Ernest M. Cowan

Electronic Theses and Dissertations 2000 - 2009

The Florida Scrub-jay is found only in the fire-dependent xeric oak communities of Florida. The number of scrub-jays statewide has been in steady decline over the past century due to the habitat loss resulting from urban development and the aging of xeric oak scrub caused by fire suppression policies. This study looks how aging of the scrub has affected scrub-jays at the Savannas Preserve State Park in Port St. Lucie, Florida. The population of scrub-jays at Savannas has been in decline over the past eight years. This study revealed that they are occupying territories that are much smaller than the …

Relationship Experience As A Predictor Of Jealousy, Samantha M. Murphy Jan 2005

Relationship Experience As A Predictor Of Jealousy, Samantha M. Murphy

Electronic Theses and Dissertations 2000 - 2009

This study examined sex differences in jealousy over sexual and emotional infidelity. I was interested in replicating Buss et al. (1992, 1999), testing the double-shot hypothesis, and investigating a potential trigger for within-sex differences in jealousy. It was hypothesized that males will be more distressed by sexual infidelity and females will be more distressed by emotional infidelity and that relationship experience will trigger males and females to respond in predictable ways. This study replicated Buss et al. (1992/1999) original findings, found no support for the double shot hypothesis, and found that relationship experience plays a partial role in the impact …

Sex Differences And Similarities In Preferred Mating Arrangements, Emily A. Stone Jan 2005

Sex Differences And Similarities In Preferred Mating Arrangements, Emily A. Stone

Electronic Theses and Dissertations 2000 - 2009

Over 90% of men and women marry, but as many as 50% of married men and women have affairs. Thus, in a self-report study of ideal mating arrangements, in which costs associated with infidelity are eliminated, it was hypothesized that men and women would prefer a mating arrangement of monogamy with the option of casual, extra-pair sex. Unexpectedly, men and women (N = 463) overwhelmingly preferred strictly monogamous mating arrangements when forced to select one such ideal arrangement. A hypothesized sex difference did emerge, however, with men more than women rating as more interesting those arrangements that included casual sex …
