Mental Disorder As An Exemption From The Death Penalty: The Aba-Irr Task Force Recommendations, Christopher Slobogin Jul 2005

Mental Disorder As An Exemption From The Death Penalty: The Aba-Irr Task Force Recommendations, Christopher Slobogin

Vanderbilt Law School Faculty Publications

The Task Force on Mental Disability and the Death Penalty (Task Force) established by the Individual Rights and Responsibilities Section of the American Bar Association (ABA-IRR) has proposed that the ABA adopt three recommendations concerning the role of mental disability in capital cases. The first two recommendations call for a prohibition on execution of offenders whose mental disorder rendered them less culpable at the time of the offense, and the third would prohibit execution of those whose mental disability currently renders them incompetent to pursue appeals or to be executed. This Article discusses the first two, culpability-related, recommendations. With respect …

An Evaluation Of Wetland No Net Loss And Mitigation Under Section 404 Of The Clean Water Act On The Santa Rosa Plain, Sonoma County, California., Teresa M. Silence

Student Work

The Santa Rosa Plain (Plain), Sonoma County, California, has lost 85% of its vernal pools, affecting the survival of four threatened and endangered species. The ability of Section 404 of the Clean Water Act to achieve the goal of no net loss is a particular importance in areas, such as the Plain, where wetland resources have become severely impacted. The objective of the study was to determine if a no net loss of wetland area occurred on the Plain, to evaluate the implementation of the Santa Rosa Plain programmatic permit, and to examine trends associated with compensatory medication. Fifty-two Section …

Instructions In Inequality: Development, Human Rights, Capabilities, And Gender Violence In Schools, Erika George Jul 2005

Instructions In Inequality: Development, Human Rights, Capabilities, And Gender Violence In Schools, Erika George

Faculty Scholarship

This Article argues that the international community's gender equality targets will not be realized by 2015 because the problems associated with sexual violence against girls in schools are situated at an intersection of contested conceptual divides between human rights (civil and political liberties) and development aims (social and economic needs). Cracks in the conceptual foundations of both the liberal and utilitarian theories of justice and equality, which support traditional human rights advocacy and economic development plans, respectively render each approach inadequate to fully identify and address the grave danger sexual violence and harassment in schools pose to educational equality. In …

Conflict Of Laws (2005), James P. George, Anna K. Teller Jul 2005

Conflict Of Laws (2005), James P. George, Anna K. Teller

Faculty Scholarship

States' and nations' laws collide when foreign factors appear in a lawsuit. Nonresident litigants, incidents outside the forum, parallel lawsuits, and judgments from other jurisdictions can create problems with personal jurisdiction, choice of law, and the recognition of foreign judgments. This article reviews Texas conflicts cases from Texas state and federal courts during the Survey period from October 1, 2003 through November 31, 2004. The article excludes cases involving federal-state conflicts; intrastate issues such as subject matter jurisdiction and venue; and conflicts in time, such as the applicability of prior or subsequent law within a state. State and federal cases …

Section of Otolaryngology, Head & Neck Surgery

Leiomyosarcoma of the larynx is an extremely rare neoplasm; only about 50 cases have been reported in the English-language literature. We report a new case of laryngeal leiomyosarcoma in a 65-year-old man. The metastatic work-up was negative, and the patient underwent total laryngectomy. He remained disease-free 12 months postoperatively.

Accountability Of Transnational Corporations Under International Standards, Lea Hanakova Jul 2005

Accountability Of Transnational Corporations Under International Standards, Lea Hanakova

LLM Theses and Essays

Due to the process of globalization and rapid economic evolution in the last several years, transnational corporations have become extremely powerful. There is an evident disproportion between the numerous rights enjoyed by transnational corporations and the scarce obligations undertaken by them. Given their transnational nature, transnational corporations have been successfully avoiding national regulations of both their home and host states, and they are seeking to operate in countries with the lowest standards so as to increase their profits. This has resulted in the violation of basic human rights. Therefore, there is an increasing need for the creation of international instruments …

Modular Neural Network To Predict The Distribution Of Nitrate In Ground Water Using On-Ground Nitrogen Loading And Recharge Data, M. Almasri, Jagath J. Kaluarachchi Jul 2005

Modular Neural Network To Predict The Distribution Of Nitrate In Ground Water Using On-Ground Nitrogen Loading And Recharge Data, M. Almasri, Jagath J. Kaluarachchi

Civil and Environmental Engineering Faculty Publications

Artificial neural networks have proven to be an attractive mathematical tool to represent complex relationships in many branches of hydrology. Due to this attractive feature, neural networks are increasingly being applied in subsurface modeling where intricate physical processes and lack of detailed field data prevail. In this paper, a methodology using modular neural networks (MNN) is proposed to simulate the nitrate concentrations in an agriculture-dominated aquifer. The methodology relies on geographic information system (GIS) tools in the preparation and processing of the MNN input–output data. The basic premise followed in developing the MNN input–output response patterns is to designate the …

Lady Caroline Lamb Before Byron: The Godfrey Vassal Webster Affair, Paul Douglass

Faculty Publications, English and Comparative Literature

This article provides an overview of the love affairs of Lady Caroline Lamb. Before she met Lord Byron, she had a long messy affair with Godfrey Vassal Webster. Their affair was known through letters which was held in the British library, the public records office in Chichester, and the like. Caroline cannot or will not adapt to the complicated social milieu of regency London.

What Lord Byron Learned From Lady Caroline Lamb, Paul Douglass Jul 2005

What Lord Byron Learned From Lady Caroline Lamb, Paul Douglass

Faculty Publications, English and Comparative Literature

Lady Caroline Lamb fictionalized the Byronic persona in Glenarvon (1816) and gave voice to the female characters that remain largely silent in Byron’s early work. Byron responded to her mimicry and to the female perspective of Glenarvon by creating a feminized hero and strong speaking roles for women in Don Juan, though his stated purpose was to undermine, not uphold, feminine power.

Poverty And Communitarianism: Toward A Community Based Welfare System, Michele E. Gilman Jul 2005

Poverty And Communitarianism: Toward A Community Based Welfare System, Michele E. Gilman

All Faculty Scholarship

This Article analyzes how communitarian political theory addresses poverty and impacts American social welfare programs. For several decades, communitarian and liberal philosophers have debated how best to achieve justice through their competing notions of personhood. Whereas liberal theorists stress the values of individual autonomy and state neutrality, communitarians assert that people are socially constituted and that liberalism therefore pays too little attention to the value of community. Yet despite their attempts to articulate a superior form of justice, communitarian theorists either ignore or misunderstand issues related to poverty, as this Article explains. Nevertheless, their insights are helpful in thinking about …

To Lend Or Not To Lend: What The Cra Ought To Say About Sub-Prime And Predatory Lending, Cassandra Jones Havard Jul 2005

To Lend Or Not To Lend: What The Cra Ought To Say About Sub-Prime And Predatory Lending, Cassandra Jones Havard

All Faculty Scholarship

Policies that support the expansion of affordable housing for low- and moderate-income persons must be reconciled with those policies that undercut the sustainability of home ownership. The sub-prime market represents a much needed expansion of credit markets to those who have been denied access to credit though they are creditworthy. The high failure rate of the sub-prime market indicates that market forces are ineffective in halting this economic abuse. This article argues that the public policy choices and justifications for certain practices have marginalized the concerns of particular consumer classes. It challenges the premise that the free market can and …

Preserving The Exceptional Republic: Political Economy, Race, And The Federalization Of American Immigration Law, Matthew Lindsay Jul 2005

Preserving The Exceptional Republic: Political Economy, Race, And The Federalization Of American Immigration Law, Matthew Lindsay

All Faculty Scholarship

Between 1882 and 1891, the U.S. Congress enacted a spate of immigration laws though which the federal government assumed virtually exclusive control over a regulatory sphere that historically had been the province of the states. This Article argues that this federalization of immigration regulation represented an attempt to reconcile the nation’s most cherished ideological commitment - the notion that the U.S. would forever remain an exceptional, “free labor” republic - with the unprecedented social and economic convulsions of the 1870s and 1880s.

The meaning of both immigrants and immigration was fundamentally transformed during the Gilded Age due to two successive …

Sex Differences In Stroke Recovery, Sue-Min Lai, Pamela W. Duncan, Paul C. Dew, John Keighley

Faculty and Staff Publications

Introduction: This study examined differences between men and women in the ability to perform basic activities of daily living, instrumental activities of daily living, and higher physical functioning after stroke. The objective of the study was to determine whether sex differences in stroke recovery can be explained by depressive status beyond older age, stroke severity, prestroke physical functioning, and other medical comorbidities.

Methods: A total of 459 stroke patients were recruited from acute and subacute facilities in an urban midwestern community. These patients were followed prospectively from stroke onset until 6 months poststroke. All study participants were assessed using standardized …

The correlation between cholinergic sensitivity and the level of stratification for ganglion cells was examined in the rabbit retina. As examples, we have used ON or OFF alpha ganglion cells and ON/OFF directionally selective (DS) ganglion cells. Nicotine, a cholinergic agonist, depolarized ON/OFF DS ganglion cells and greatly enhanced their firing rates but it had modest excitatory effects on ON or OFF alpha ganglion cells. As previously reported, we conclude that DS ganglion cells are the most sensitive to cholinergic drugs. Confocal imaging showed that ON/OFF DS ganglion cells ramify precisely at the level of the cholinergic amacrine cell dendrites, …

Availability Of Emotional Support, Conflictual Interactions, And Coping As Predictors Of Adherence And Affect In Individuals With Diabetes, Misty D. Hixon Jul 2005

Availability Of Emotional Support, Conflictual Interactions, And Coping As Predictors Of Adherence And Affect In Individuals With Diabetes, Misty D. Hixon

Psychology Theses & Dissertations

Although the treatment of diabetes is often complex and demanding, it is necessary. Unfortunately studies show that current adherence rates are at a disappointingly low level. Additionally, individuals diagnosed with diabetes often report high levels of negative mood, depression, and anxiety. The purpose of this study was to contribute to the understanding of adherence to diabetes treatment regimens and mood states in individuals with diabetes by examining the associations among availability of social support, conflictual social interactions, coping, mood states, and adherence. One hundred and fourteen individuals with types 1 and 2 diabetes were recruited and completed either an online …
