Shared Experience Building Around The Family Crucible Of Cancer, W. David Robinson, Jason S. Carroll, Wendy L. Watson
Shared Experience Building Around The Family Crucible Of Cancer, W. David Robinson, Jason S. Carroll, Wendy L. Watson
Faculty Publications
This study was designed to gain a greater understanding of the effects cancer has on families while simultaneously developing family therapy interventions that are helpful for families experiencing the crucible of cancer. On the basis of an action research paradigm, the authors designed an intensive case-analysis protocol involving reflective interviewing to learn about the personal perspectives of family members who participate in therapeutic treatment for cancer. An integration of reflective insight by the families, their therapist, and the research team ultimately revealed that cancer families face an ongoing struggle (a) between feelings of isolation and connectedness, (b) to make meaning …
The Book Of Breathings In Its Place, Kerry M. Muhlestein
The Book Of Breathings In Its Place, Kerry M. Muhlestein
Faculty Publications
Michael D. Rhodes's publication on the Hor Book of Breathings is an unusual book in many ways. It is a scholarly Egyptological work, dealing with an understudied type of text from an understudied era of Egyptian history, appearing in the midst of a series that has been dedicated to the exploration of a book considered to be scripture by the Latter-day Saints. Additionally, it deals with what many have incorrectly considered to be a text that can be used to test the revelatory ability of the founder of the Church of Jesus Christ of Latterday Saints.

Ending The Exploitation Of The Vulnerable: The Promise Of The Intersection Of American Bioethics, Human Rights, And Health Law, Ruqaiijah Yearby
All Faculty Scholarship
Traditionally, American bioethics has served as a safety net for the rich and powerful, for they are not forced to act as research subjects to obtain access to general health care for themselves or their children. However, American bioethics has failed to protect the vulnerable, i.e. indigent minorities. The vulnerable are not treated the same as the rich. They do not have access to health care. They are exploited in clinical trials that promise monetary gain or access to health care and their autonomy rights are often ignored. Some of the vulnerable most affected by these disparities are African-Americans. African-Americans …

Is It Too Late For Title Vi Enforcement?: Seeking Redemption Of The Unequal Long Term Care System In The United States Through International Means, Ruqaiijah Yearby
All Faculty Scholarship
Legal and medical experts have noted continued racism in the health care system that prevents the equal distribution of quality care. Initially most racism was intentional and expressed through de jure segregation, as evidenced by federal funding of the construction of racial segregated health care facilities. Now most racism, expressed through de facto segregation, is subtly incorporated into the daily practices of institutions causing an adverse disparate impact on African-Americans. This institutional racism establishes separate and independent barriers through the neutral denial of opportunities and equal rights to individuals and groups that results from the normal operations of the institutions …
Attitudes Toward Abortion Among Religious Traditions In The United States: Change Or Continuity?, John P. Hoffmann, Sherrie Mills Johnson
Attitudes Toward Abortion Among Religious Traditions In The United States: Change Or Continuity?, John P. Hoffmann, Sherrie Mills Johnson
Faculty Publications
Abortion continues to be a highly contentious issue in the United States, with few signs of abatement. The goal of this paper is to specify how variable positions about abortion across religious traditions have led to differential shifts in attitudes among their members. Based on culturally relevant events, position papers, and other religious media, the guiding hypotheses propose that Evangelicals have become increasingly opposed to abortion for elective reasons; yet changes in attitudes regarding abortion for traumatic reasons are due primarily to cohort shifts. Data from the cumulative General Social Surveys (1972–2002) are used to test the hypotheses. The first …
Disaster Relief And Governance After The Indian Ocean Tsunami: What Role For International Law?, David P. Fidler
Disaster Relief And Governance After The Indian Ocean Tsunami: What Role For International Law?, David P. Fidler
Articles by Maurer Faculty
The tsunami in the Indian Ocean at the end of 2004 has produced heightened scrutiny of how international disaster relief is supplied and governed. This scrutiny connects to arguments by the International Federation of Red Cross and Red Crescent Societies that more effective and efficient disaster relief requires the significant development of international law on disaster relief. This commentary analyses the historical and current relationship between international law and disaster relief and challenges the arguments that more international law on disaster relief is needed.
From International Sanitary Conventions To Global Health Security: The New International Health Regulations, David P. Fidler
From International Sanitary Conventions To Global Health Security: The New International Health Regulations, David P. Fidler
Articles by Maurer Faculty
In May 2005, the World Health Organization adopted the new International Health Regulations (IHR), which constitute one of the most radical and far-reaching changes to international law on public health since the beginning of international health cooperation in the mid-nineteenth century. This article comprehensively analyses the new IHR by examining the history of international law on infectious disease control, the IHR revision process, the substantive changes contained in the new IHR and concerns regarding the future of the new IHR. The article demonstrates why the new IHR constitute a seminal event in the relationship between international law and public health …

Trade And Special Interest Politics, Enforcement Policy And Illegal Drugs: Three Essays., Suryadipta Roy
Graduate Theses, Dissertations, and Problem Reports (ETD)
The objective of this dissertation is to investigate the implications of government policy in trade of legal goods and illegal drugs, and to comment on government policy towards illegal drugs in the United States. To this end, importance of the role of special interest groups in shaping public policy is discussed in general and for the US in particular. Chapter 2 lays out a theoretical model explaining the effect of political asymmetry in tariff setting in preferential trading agreements. Using a three-good, three-nation version of the Meade-model, endogenous tariff setting in a preferential-trading agreement (PTA) is analyzed. Using Nash bargaining …
The Determinants Of State Work Attachment Strategy Choices And The Effects Of Work Attachment Strategies On Welfare Recipients, Former Recipients, And Poverty., Kyoung Hag Lee
Graduate Theses, Dissertations, and Problem Reports (ETD)
This study explores how national factors such as the high performance bonus, work participation rate penalty, and caseload reduction credits from federal government influence state work attachment strategy choices. In addition, this study examines the effects of state work attachment strategies, such as lifetime limits, sanctions, and work requirements, on the employment and earning outcomes for welfare recipients in various states, along with the poverty rates in those states and the employment and economic status of former welfare recipients. Using three multivariate regression methods such as OLS regression, logistic regression, and ordered logistic regression using SPSS, this study analyzes administrative …

The Effects Of Uv-B Radiation On The Growth And Physiology Of Non-Agricultural Plant Species Under Changing Environmental Conditions., Chintamani S. Manish
Graduate Theses, Dissertations, and Problem Reports (ETD)
I investigated whether seedlings of non-agricultural plants exposed to varying levels of UV-B exposure had altered growth, physiological, and tissue chemistry responses under changing environmental conditions. In a field experiment, using a modulated UV-B lamp bank system, elevated UV-B did not significantly alter the total biomass of the 6 plant species that were studied, and only Quercus rubra showed a trend towards some sensitivity to UV-B. In two species—Platanus occidentalis and Setaria faberii—I found an increase in the production of UV-B absorbing compounds under elevated UV-B while two grasses—S. faberii and Elymus virginicus—had significantly decreased C:N ratios under elevated UV-B. …

Agenda Setting And Denial In The States. Nonprofit Hospital Tax Exemptions: A North Carolina Case Study., Linda Struyk Millsaps
Graduate Theses, Dissertations, and Problem Reports (ETD)
This research has two objectives. First, it examines the nature of state-level agenda setting, comparing it to the prevailing federal level theories of agenda setting and agenda denial. Specifically it examines state tax exemptions for nonprofit hospitals in North Carolina to determine if this policy arena follows acknowledged theories of agenda setting and denial, or if there is something unique about tax policy that creates a different agenda setting dynamic. Areas of focus included the status of nonprofit hospital property tax exemptions on the policy agenda and how the issue came to that position. Interviews with legislators, lobbyists, hospital and …

Political Economy Of Railway Extensions In Kenya: The Case Of The Uasin Gishu Railway 1901-1930, John Mwaniki Mwaruvie
Graduate Theses, Dissertations, and Problem Reports (ETD)
The history of the construction of the Uasin Gishu railway demonstrates the complexity of formulating and implementing a colonial development project. It involved an array of actors with divergent interests. As result, the project became the most controversial railway extension in Kenya, which some critics have called a "colonial scandal." The main areas of controversy involved the altering of the original route for the Kisumu to Mumias railway, which was meant to serve the most productive African district in favor of a line starting from Nakuru via Uasin Gishu to Mumias to cater for the interests of European settlers who …
Understanding The Coach -Athlete Dyad: The Impact Of Educational Interventions On Perceptions And Psychosocial Variables., Lindsey C. Blom
Understanding The Coach -Athlete Dyad: The Impact Of Educational Interventions On Perceptions And Psychosocial Variables., Lindsey C. Blom
Graduate Theses, Dissertations, and Problem Reports (ETD)
With the understanding that coaches have a direct impact on the athletes with whom they work (Libman, 1998) and with the knowledge that this influence is complex (Weiss & Hayashi, 1996), it can be assumed that coaching education is of the utmost importance. The purpose of this study was to evaluate the PASS IT Back program developed to help coaches address their specific players' perceptions and preferences for the coach-athlete relationship. Nine boys' high school soccer coaches and their respective teams were randomly placed in one of three categories: (1) control group, (2) feedback group receiving information about players' perceptions …
Video Games As A Protected Form Of Expression, Paul E. Salamanca
Video Games As A Protected Form Of Expression, Paul E. Salamanca
Georgia Law Review
Video games, like motion pictures, failed to qualify for First Amendment protection until well after they emerged as a medium. Today, a number of courts have held that such games constitute a form of expression and do not fall into any recognized category of unprotected speech. Nevertheless, a number of commentators have called for limited constitutional protection for video games, predicating their arguments on a variety of grounds, including the alleged deleterious effects of such games on children. This Article responds to these commentators and defends recent decisions extending protection to video games.
Data Matching, Data Mining, And Due Process, Daniel J. Steinbock
Data Matching, Data Mining, And Due Process, Daniel J. Steinbock
Georgia Law Review
The Article concerns the governmental use of computerized data matching (comparison of records) and data mining (profiling),which increasingly are aimed at locating potential terrorists. The most striking aspect of virtually all anti-terrorist data matching and data mining decisions is the total absence of even the most rudimentary procedures for notice, hearing, or other opportunities for meaningful participation before, or even after, the deprivation is imposed. The Article evaluates under Fourth Amendment and due process standards a variety of law enforcement activities data matching or data mining might instigate. After reviewing these activities' potential effects on private, governmental, and accuracy interests, …
Laying Down The Law: Bringing Down The Legal Cartel In Real Estate Settlement Services And Beyond, Margaret O. Rentz
Laying Down The Law: Bringing Down The Legal Cartel In Real Estate Settlement Services And Beyond, Margaret O. Rentz
Georgia Law Review
America is in the midst of an explosion in the demand for legal services, yet few Americans can afford to pay the ever-increasing cost of legal fees and are thus continually deprived of access to the legal system. Non lawyers have responded to this problem by entering the market and attempting to provide basic legal services at deeply discounted rates. Under the guise of "consumer protection," the bar has responded by blocking non lawyers from 'practicing law" with unauthorized practice statutes. A debate has emerged over whether UPL statutes actually serve American consumers or merely guard the legal cartel's economic …
Pricing In The New Economy: Lessons From The Period Of The E-Commerce Bubble, Phillip J. Bryson
Pricing In The New Economy: Lessons From The Period Of The E-Commerce Bubble, Phillip J. Bryson
Faculty Publications
The New Economy increased U.S. productivity sharply after 1995. The latest economics literature on the topic, which generally forecasts a secure future for the information economy, is reviewed. The down side of the New Economy were the strategies, especially the pricing strategies of NASDAQ and virtual firms. The critique of Michael Porter regarding the non-strategic price cutting common to those firms is reviewed. Traditional models by Sweezy and Baumol, which focus on pricing in imperfectly competitive industries, are applied to provide a cogent theory as to why those firms made mistakes that were once viewed as common for neophyte industries.

Two Charleston, West Virginia, brothers, Robert C. and Henry E. Payne, III, and Charleston lawyer Fred F. Holroyd established The State Journal in October 1984 as a weekly newspaper to serve a statewide business readership. The newspaper evolved through difficult early years and eventually became profitable through the sales leadership of Lorenelle White, who would purchase the newspaper with her husband in 1997. She eventually would re-establish the newspaper’s weekly publishing cycle. The Whites would sell The State Journal in 2001 to a newly formed media business, West Virginia Media Holdings, which would increase in the newspaper’s editorial resources. Since …

Graduate Theses, Dissertations, and Problem Reports (ETD)
Institutions of higher education are facing more challenges today than ever regarding student retention and graduation rates. Graduation rates in higher education have been declining over the past several years. Because of this, many institutions are becoming increasingly interested in the needs of special populations in an effort to retain them at higher rates. One of these special populations is first-generation, low-income college students. The federal TRIO grant, Student Support Services (SSS) program is funded by the United States Department of Education to serve this population to increase their graduation rates. The purpose of this study was to examine the …
Para-Verbal Avoidance During Public Speaking: The Relationship Between Self -Disclosure And Social Anxiety., Michael F. Detweiler
Para-Verbal Avoidance During Public Speaking: The Relationship Between Self -Disclosure And Social Anxiety., Michael F. Detweiler
Graduate Theses, Dissertations, and Problem Reports (ETD)
Unlike dyadic conversation where the social burden of conversation can be shared, the quantity and quality of speech produced during a public speaking challenge is primarily dependent upon the speaker. This study examined whether differences in disclosure patterns reflect a form of subtle avoidance during public speaking challenges. Termed para-verbal avoidance, it was hypothesized individuals with increased anxiety would refrain from talking about themselves for fear of revealing potentially embarrassing personal information. Also, it was proposed individuals with increased anxiety would avoid discussing subjective information, as it can be debated by others and used as the basis for forming a …

It is an unquestionable fact that the economic development and subsistence of nations depend highly on the health and adequate nutritional status of their economically active population. The concern arises in the light of evidence on adult nutritional deficiencies in some social strata of our country. Malnutrition is the pathological state that results from the inadequate consumption of one or more essential nutrients. Clinically it is manifested by biochemical tests and anthropometric indicators, and affects the response of the individual to different processes of disease as well as to the established therapies. Malnutrition is associated to loss of corporal fat …

Inhibition Modifies The Effects Of Slow Calcium-Activated Potassium Channels On Epileptiform Activity In A Neuronal Network Model, Keun-Hang Susan Yang, Piotr J. Franaszczuk, Gregory K. Bergey
Mathematics, Physics, and Computer Science Faculty Articles and Research
Generation of epileptiform activity typically results from a change in the balance between network excitation and inhibition. Experimental evidence indicates that alterations of either synaptic activity or intrinsic membrane properties can produce increased network excitation. The slow Ca2+-activated K+ currents (sI AHP) are important modulators of neuronal firing rate and excitability and have important established and potential roles in epileptogenesis. While the effects of changes in sI AHP on individual neuronal excitability are readily studied and well established, the effects of such changes on network behavior are less well known. The experiments here utilize a defined small network model of …
Why Print And Electronic Resources Are Essential To The Academic Law Library, Michelle M. Wu
Why Print And Electronic Resources Are Essential To The Academic Law Library, Michelle M. Wu
Georgetown Law Faculty Publications and Other Works
Libraries have supported multiple formats for decades, from paper and microforms to audiovisual tapes and CDs. However, the newest medium, digital transmission, has presented a wider scope of challenges and caused library patrons to question the established and recognized multiformat library. Within the many questions posed, two distinct ones echo repeatedly. The first doubts the need to sustain print in an increasingly digital world, and the second warns of the dangers of relying on a still-developing technology. This article examines both of these positions and concludes that abandoning either format would translate into a failure of service to patrons, both …
