Toward A Reform-Minded Model For Securities Law Enforcement, Cristie Ford

This paper examines a significant shift in enforcement practice at the United States Securities and Exchange Commission, originating under the Chairmanship of William Donaldson but likely to continue beyond it. This shift is a response to a crisis of corporate governance, exemplified by recent scandals among various public corporations and financial services institutions, and to the demonstrated inadequacy of SEC enforcement tools to respond to that crisis. While the SEC's new approach, which I call the Reform Undertaking, is incomplete, I argue that if properly implemented it may have the potential to spur institutional reform not only in corporate governance, …

When I go in a bookstore, I always head in the same direction: first, new paperbacks (because the heft of a hardback makes reading in bed awkward); then the sale tables and mysteries; followed by adult fiction, occasionally history, then finally, the children's department.

Multicultural Lawyering: Teaching Psychology To Develop Cultural Self-Awareness, Carwina Weng

Much of the current literature in multicultural lawyering focuses on learning substantive information about clients who are culturally different from the lawyer, such as how the client's culture perceives eye contact or reacts to science-based world views. This article notes that such a focus sidesteps the human reality that every person reacts to people who are different from him- or herself unconsciously in ways that may be culturally insensitive and discriminatory and that this human reaction occurs despite awareness of the general values, attitudes, and beliefs of the client's culture. It therefore suggests that multicultural lawyering training should begin with …

At the intersection of new weapon technologies and international humanitarian law, so-called "non-lethal" weapons have become an area of particular interest. This article analyses the relationship between "non-lethal" weapons and international law in the early 21st century by focusing on the most seminal incident to date in the short history of the "non-lethal" weapons debate, the use of an incapacitating chemical to end a terrorist attack on a Moscow theatre in October 2002. This tragic incident has shown that rapid technological change will continue to stress international law on the development and use of weaponry but in ways more politically …

White Washed: The Representation Of Hispanics In Television National News Coverage., Matthew P. Gallagher

This study analyzed Hispanics and national television news coverage. The quantitative portion of the study examined four separate weeks of television news coverage on six networks over a one year period. From the 1,106 stories examined, Hispanics were viewed in only 18 stories. And from the results it was concluded that television news networks are “white washed,” meaning that the news is based around Caucasians.

Recent surveys have indicated that populations of fishes and crayfish are small in the Stony River, Grant Co., WV. The Stony River is influenced by thermal enrichment and acid mine drainage (AMD) within a 13 km stream reach, downstream of Mt. Storm Lake. In an attempt to determine the influence of each anthropogenic disturbance on these affected taxa, studies of their distribution and survival were undertaken. A crayfish trapping survey was conducted along a gradient of thermal and AMD influences in the Stony River system. The present study examined the relation between the development of PTSD and coping, posttraumatic cognitions, resilience, spirituality, and religiosity. A total of 91 participants (out of 304 screened) were divided into three groups—Control, Trauma Exposed, and PTSD. Participants completed the Posttraumatic Stress Diagnostic Scale (PDS), Ways of Coping Questionnaire (WOCQ), Posttraumatic Cognitions Inventory (PTCI), ConnorDavidson Resilience Scale (CD-RISC), Spiritual Involvement and Beliefs Scale (SIBS), and Religiosity Measures Questionnaire (RMQ). Results indicated that the Trauma Exposed group scored the lowest on the Self-Controlling, Accepting Responsibility, and Escape-Avoidance subscales of the WOCQ while the PTSD group scored the highest. This paper presents the findings of an investigation to determine whether of not there is a difference in hospitalized adolescents and non-hospitalized adolescents. The participants were 60 adolescents between the ages of 12 to 18 years. Their fears, stressors, and coping skills were evaluated by using three instruments: a 35-item self-report test on coping; a 108-item self-report test on fears; and a 15-item self-report test on stress. The results revealed that on specific measures hospitalized adolescents exhibited a statistically significantly less degree of emotional upset during hospitalization than did the community sample. Consumer confidence impacts agricultural markets. In response, many food industries have adopted cost-effective programs to reduce risk and offer third party verification of product quality. The purpose of this project was to implement the West Virginia Dairy Quality Assurance Program (WVDQAP) which promotes best management practices to produce high quality milk and meat products. This study surveyed dairy producers throughout the state, to establish the most effective method of program implementation. A manual was constructed and presented to producers at one of five meeting across the state. The manual focuses on the requirements a producer must follow to receive certification. …

This thesis examines the causes of the 1994-1996 Chechen War by analyzing the policies of the Russian and Chechen governments between 1991 and 1994. The development of Chechen separatism in the late 1980s and the creation of a secessionist Chechen government in 1990-1991 are extensively examined. Through the use of Russian and Chechen government documents as well as contemporary reports in the Russian press, I present in detail the negotiation process between Moscow and Grozny in 1992-1994 and I examine why these negotiations failed to reach a peaceful settlement. Osteoarthritis is a type of arthritis marked by degeneration of the cartilage and bone in joints, which causes severe joint pain associated with daily activities. Articular cartilage is one of the major load bearing tissue that transfers load across joints and with synovial fluid provides a bearing surface for the diarthrodial joints. It is made up of highly specialized cells called chondrocytes that are responsible for its growth and maintenance. Mechanical loading and cell-matrix interactions have been shown experimentally to influence the biological behavior of chondrocytes. The Effects Of Roads And Culverts On Stream And Stream-Side Salamander Communities In Eastern West Virginia., Ryan Lee Ward

Roads and culverts have many effects on stream salamanders. We examined 120 culvert crossings in the Shavers Fork and Dry Fork watersheds in eastern West Virginia. Complete barriers to salamander passage occurred at 55.0% of the sites visited and partial barriers at 34.2%. Analyses showed that 20.6% of the total stream length in the Dry Fork watershed and 18.4% in the Shavers Fork watershed were isolated by barriers. We conducted salamander sampling at 16 streams and used Akaikeís Information Criterion to select the best a priori models explaining salamander diversity, richness, and abundance. Roads benefited disturbance tolerant species while negatively …

The purpose of this study was to examine the relationship between offense-specific neutralizations and delinquency. Analysis of data from the final wave of the Evaluation of the Gang Resistance Education and Training (GREAT) Program in the United States (1995-1999) reveals that youth are likely to accept neutralizations for behaviors they have committed. For example, when controlling for other variables theoretically linked to delinquency, neutralization of lying was found to be significantly associated with lying, while neutralization of stealing was found to be significantly associated with stealing and neutralization of violence was found to be significantly associated with violent behavior. Component based development is gaining popularity in the software engineering community. The reliability of components affects the reliability of the system. Different models and theories have been developed to estimate system reliability given the information about system architecture and the quality of the components. Almost always in these models, one of the key attributes of component-based systems, the error propagation between the components, is overlooked or not taken into account in reliability calculation. Regression analysis suggests that district-to-district differences in high school completion rates are positively related to post-high school economic and educational opportunities. High school completion rates are negatively related to the costs of schools. Dropping out of high school is the students’ attempt to rationally respond to their environment and social circumstances. Thus, dropping out can be interpreted as a rational phenomenon. Students are calculating, often unself-consciously, the costs of staying in school versus the returns to education. Students are acting rational in responding to the constraints and opportunities of their social circumstances. District-level high school completion rates were regressed on …

A study was conducted to evaluate the accuracy of an air-to-fuel ratio derived exhaust flow rate for emissions testing. The Mobile Emissions Measurement System (MEMS) was developed by West Virginia University to perform in-use emissions testing for several heavy-duty diesel engine manufactures. The MEMS was modified to complete this study. A review of literature describing different on-board systems and flow measurement techniques was performed to aid in the completion of this project. A new movement has begun. Spirituality and religion are being integrated into racial-cultural psychology and counseling. This chapter will review the literature that is the basis of that movement. We first describe the historical forces alluded to by Trimble (2000) that until only recently have minimized the relevance of religion and spirituality to psychological research and practice. We then summarize the potential benefits and concerns about incorporating spiritual and religious perspectives into research and practice that have been suggested in publications of the past 30 years. This study of persuasive and propagandistic messages explores the differences and similarities among the two, as well as elements necessary for success, using previous research in the field. In addition, this report includes an analysis of the diffusion, framing, placement within newspaper articles, and effects of news content relating to the Swift Boat Veterans for Truth disseminated during the 2004 Presidential campaign. The results of this study suggest a need for greater scrutiny among reporters regarding messages distributed by interest groups.

Background: Studies suggest obstructive sleep apnea syndrome (OSAS) frequently manifests in patients with gastroesophageal reflux disease (GERD) and that there may be a causal relationship.
Aim: To determine the relationship between OSAS and symptoms of GERD.
Methods: Consecutive patients referred to the Sleep Disorders Center (SDC) 18 years and older with polysomnographically defined OSAS were evaluated prospectively for GERD using a validated symptoms questionnaire. The GERD and OSAS relationship was assessed by 1) determining frequency of GERD in patients with and without OSAS; 2) ascertaining the relationship between OSAS severity categories and presence of GERD; 3) examining GERD score in …

Adults who were fluent in English, and who grew up speaking English or one of 21 other languages listened to words spoken with angry or neutral intonation. We measured the accuracy with which the listeners identified the intended emotion. English mother tongue (EMT) polyglots scored higher than other mother tongue (OMT) listeners, whereas EMT monoglots did not. Women were significantly more accurate than men across the three listener groups. There was a modest inverse correlation between accuracy and age. The learning of a second language may have helped the EMT polyglots develop additional perceptual skills in decoding speech emotion in …

Since its inception in the 1920s, research on marriage relationships has attracted widespread attention within a variety of disciplines and has held a central position in the scientific study of families. However, despite marriage scholarship's long tradition and broad interdisciplinary base, a number of scholars believe that this area of research has reached a crossroads at the beginning of the 21st century. This study was designed to gain a greater understanding of the effects cancer has on families while simultaneously developing family therapy interventions that are helpful for families experiencing the crucible of cancer. On the basis of an action research paradigm, the authors designed an intensive case-analysis protocol involving reflective interviewing to learn about the personal perspectives of family members who participate in therapeutic treatment for cancer. An integration of reflective insight by the families, their therapist, and the research team ultimately revealed that cancer families face an ongoing struggle (a) between feelings of isolation and connectedness, (b) to make meaning …
