Judicial Impartiality In The Supreme Court: The Troubling Case Of Justice Stephen Breyer, Monroe H. Freedman

Supreme Court Justices have been ignoring the mandates of both the Due Process Clause and the Federal Disqualification Statute, repeatedly refusing to recuse themselves in cases in which their impartiality might reasonably be questioned. Further, in response to widespread criticism of these recusal failures, Chief Justice Rehnquist appointed a committee with a skewed composition, which might well weaken recusal requirements. The committee is chaired by Justice Stephen Breyer. Breyer is a particularly inappropriate choice to head up such a committee because, both in the First Circuit and in recent cases in the Supreme Court, he has conspicuously disregarded his own …

The use of customary international law ("CIL") by courts in the United States, long the subject of debate among scholars, has finally come to the attention of the Supreme Court. In the last few years, the Court has interpreted and applied CIL to interpret provisions of the U.S. Constitution, to interpret statutes and treaties, and as a substantive rule of decision. While the Supreme Court's renewed interest in customary international law has drawn much praise, it has also sparked sharp criticism. This dissertation proposes an approach and methodology for the utilization of the fundamentals of systems theory as an aid to national security decision-making. At its core is an examination of the elements of nations' or non-state actor's power resources. The product of the analysis is the compilation of a set of nodes, and the relationships between these, upon which actions may be taken to achieve desired effects. Under the Internal Revenue Code of 1986, taxpayers are permitted a federal gift tax exemption and an estate tax exemption. Although technically not exemptions but more in the nature of exemption "equivalents" that entitle taxpayers to a credit, each is more easily understood as an exemption. The gift tax exemption, as so understood, is $1 million for each taxpayer and is not scheduled to increase. The estate tax exemption, as also so understood, is $1 million for 2005 and is scheduled to become $2 million in 2006, 2007, and 2008 and reach $3.5 million in 2009. There will be no …

Flood pulse inundation of riparian forests alters rates of nutrient retention and organic matter processing in the aquatic ecosystems formed in the forest interior. Along the Middle Rio Grande (New Mexico, USA), impoundment and levee construction have created riparian forests that differ in their inter-flood intervals (IFIs) because some floodplains are still regularly inundated by the flood pulse (i.e., connected), while other floodplains remain isolated from flooding (i.e., disconnected). In the era of market and workforce globalisation, engineers need a solid understanding of the impact that their products have locally, as well as globally. This is why the US Accreditation Board for Engineering and Technology (ABET) recently put a new spin on this requirement in engineering education. Specifically, outcome 3h of Engineering Criteria 2000 states that engineering graduates must have the broad education to understand the impact of engineering solutions in a global/ societal context. The Persistence Of Earnings And Corporate Governance In Ipo Firms, Mary F. Calegari, H. A. Maretno

In this study, we investigate the earnings persistence in IPO firms by examining the two components of earnings: accruals and cash flows. We also analyze the impact of corporate governance on earnings and the two earnings components. In our comparison of the top and bottom quartiles based on the firms' earnings at the IPO year, we find that although the top quartile firms have a significantly positive accrual component in the IPO year, they eventually have the same negative accrual component of earnings as the bottom quartile firms in the second year after the IPO. Flow state refers to an optimal psychological experience and is associated with a number of experiential qualities one of which is complete absorption in the task at hand. Self-determination theory provides a framework for examining the relation between different types of motivation and flow because it distinguishes among different forms of motivation based on the degree that they can be considered self-determined. Although flow has been studied among athletes and, to a lesser degree, exercisers, no studies have focused on the flow experiences of yoga practitioners.
