Policing The Border Between Trademarks And Free Speech: Protecting Unauthorized Trademark Use In Expressive Works, Pratheepan Gulasekaram

Washington Law Review

Artists and other creators of expressive works often include trademarks and trademarked products as part of their works. They do so for a number of reasons, including lighthearted humor, critical cultural commentary, parody, or even simply to shock. In instances where such use is both unauthorized by and perceived as disparaging to the mark owner or the trademarked product, owners have attempted to sue under trademark law to enjoin the expressive use. Solomon's Choice: The Spending Clause And First Amendment Rights In Forum For Academic & Institutional Rights V. Rumsfeld, Emily R. Hutchinson

Washington Law Review

The Solomon Amendment denies federal funding to institutions of higher education that interfere with military recruiting on campus. In Forum for Academic & Institutional Rights v. Rumsfeld, the United States Court of Appeals for the Third Circuit examined the constitutionality of the Solomon Amendment using traditional First Amendment analysis. The court applied strict scrutiny and held that it was reasonably likely that the Solomon Amendment impermissibly infringed the First Amendment rights of an association of law schools and law faculty. Introduction To Gendering Modern Japanese History, Barbara Molony

History

Gender, as Joan Scott asserted in 1986, is a useful category of historical analysis.1 In the last quarter century, gender has emerged as a lively area of inquiry for historians and other scholars. Gender analysis has suggested some important revisions of the "master narratives" of national histories-that is, the dominant, often celebratory, tales of the successes of a nation and its leaders.2 These narratives, like all histories, are provisional and incomplete and, to varying degrees, reflect the changing material, discursive, and ideological contexts of their times.3 To mention just two of the fields of history that had …

On November 11, 2004, a 33-year-old male dump truck driver died when he was crushed between the driver’s side of the dump truck and the swinging counter-weight of an excavator (trackhoe). His dump truck became stuck in mud after the trackhoe loaded dirt into it so he walked to the on-site office and informed the owner. The owner located a bulldozer on site and drove it to the dump truck while the driver retrieved a chain from his personal pickup truck. In Vitro And In Vivo Two-Photon Luminescence Imaging Of Single Gold Nanorods, Haifeng Weng, Terry B. Huff, Daniel A. Zweifel, Wei He, Philip S. Low, Alexander Wei, Ji-Xin Cheng

Gold nanorods excited at 830 nm on a far-field laser-scanning microscope produced strong two-photon luminescence (TPL) intensities, with a cos(4) dependence on the incident polarization. The TPL excitation spectrum can be superimposed onto the longitudinal plasmon band, indicating a plasmon-enhanced two-photon absorption cross section. The TPL signal from a single nanorod is 58 times that of the two-photon fluorescence signal from a single rhodamine molecule. The application of gold nanorods as TPL imaging agents is demonstrated by in vivo imaging of single nanorods flowing in mouse ear blood vessels.

The Incidence And Management Of Footrot In Dairy Cattle In Monteverde, Costa Rica, November 2005, Allison Brown

Monteverde Institute: Tropical Ecology and Conservation

This study investigates the frequency of, and factors leading to or preventing, footrot in diary cattle in the Monteverde area of Costa Rica. Owners of 23 farms were interviewed about their property characteristics, management practices, and incidence of footrot. Then the farms were visually inspected. Ten farms were found to currently have infected cattle and 18 had infected cattle this year. The percent of currently infected cattle had a significant positive correlation with both herd size and hours spent in daily milking rotation. Larger herds showed a greater incidence of infection. Objective: To analyze the pattern of the first author's institutional affiliation and the distribution of different article types published in the students' corner of the Journal of Pakistan Medical Association.Methods: This cross-sectional study was carried out in July 2005 and analyzed the students' corner (whenever present) of the Journal of Pakistan Medical Association from January 1998 to June 2005.Results: For the 90 issues of the journal in the stipulated period, 96 articles were published in the students' corner. Original studies 46 (47.9%) were the most commonly published article category followed by personal opinion/review category (43.8%) and case-reports 8 (8.3%). The …

The starting point of any discussion of the public perception of the United States Supreme Court is the liklihood that no public perception exists. By and large, the Supreme Court operates at the very outer edges of public awareness; for years, polls have indicated that many more Americans know the names of the three Stooges than any three Supreme Court justices.
