Benchmark Studies For Structural Health Monitoring Using Analytical And Experimental Models, Jason Lee Burkett Jan 2005

Benchmark Studies For Structural Health Monitoring Using Analytical And Experimental Models, Jason Lee Burkett

Electronic Theses and Dissertations

The latest bridge inventory report for the United States indicates that 25% of the highway bridges are structurally deficient or functionally obsolete. With such a large number of bridges in this condition, safety and serviceability concerns become increasingly relevant along with the associated increase in user costs and delays. Biennial inspections have proven subjective and need to be coupled with standardized non-destructive testing methods to accurately assess a bridge's condition for decision making purposes. Structural health monitoring is typically used to track and evaluate performance, symptoms of operational incidents, anomalies due to deterioration and damage during regular operation as well …

Stormwater Irrigation Of Saint Augustine Grass: Nitrogen Balance And Evapotranspiration, Ewoud Hulstein Jan 2005

Stormwater Irrigation Of Saint Augustine Grass: Nitrogen Balance And Evapotranspiration, Ewoud Hulstein

Electronic Theses and Dissertations

A change in surface condition of a watershed, which is usually caused by development, can have measured effects on the naturally occurring hydrologic cycle and nitrogen cycle. This could result in environmental problems, such as reduced springflow and eutrophication. In an effort to address these issues, a combination of best management practices (BMPs) can be adhered to. The practice of using excess stormwater as a source for irrigation is proposed as a BMP for the minimization of impacts by development to the hydrologic and nitrogen cycles. To study the proposed BMP, a field experiment was installed in an outdoor location …

Domestic Violence Resources For Women Receiving Intensive Family Preservation Services, Marianne Berry, Joan Letendre, Jody Brook Jan 2005

Domestic Violence Resources For Women Receiving Intensive Family Preservation Services, Marianne Berry, Joan Letendre, Jody Brook

Journal of Family Strengths

Intimate partner violence is a common correlate of child abuse and neglect and often is not addressed in family preservation services. In many cases, the ideologies of family preservationists and advocates for women 's safety can be at odds. This article presents a study of a collaborative model of intervention, utilizing family preservation workers and community resource practitioners working with domestic violence as group facilitators. The study utilizes a pretest, post-test design to evaluate a domestic violence resource group for women who were concurrently receiving intensive family preservation services. The study examines the effect of the program on participants' self-perceptions …

Creating A Family-Centered Plan: Family Negotiation In Child Welfare, Margaret Severson, Kim Burns Jan 2005

Creating A Family-Centered Plan: Family Negotiation In Child Welfare, Margaret Severson, Kim Burns

Journal of Family Strengths

In this article, the conceptual and theoretical underpinnings for child welfare negotiations, assessment strategies useful in preparing for such negotiations, and practice implications for child protective service workers involved in the process are explored. Particular emphasis is given to the benefits of employing negotiation techniques in child welfare matters. The opportunities to use negotiation strategies are numerous in the child welfare arena. They range from formal mediation of an adoption plan, to family group conferencing of a placement issue, to negotiating a visitation and access plan with a parent. Common to all of these situations is the recognition that families …

Preserving Family: Themes From A Qualitative Study Of Kin Caregivers, Don Cohon, Lisa Hines, Bruce A. Cooper, Wendy Packman, Elizabeth Siggins Jan 2005

Preserving Family: Themes From A Qualitative Study Of Kin Caregivers, Don Cohon, Lisa Hines, Bruce A. Cooper, Wendy Packman, Elizabeth Siggins

Journal of Family Strengths

This article presents themes from a qualitative study of 58 African American female kinship caregivers in San Francisco. Core concepts that emerged describe various paths along which children move into kin homes, and caregivers' mixed emotional reactions to becoming surrogate parents. Women also discussed multiple family roles they assumed after taking in children. Responses highlight three primary reasons for becoming caregivers that center on providing for and protecting these children—particularly from the perceived threat of the public foster care system—and ultimately preserving the family unit. Paradoxically, caregivers' reasons mirror the stated goals of the public foster care system, which they …

Family Preservation: Perceptions Of Effectiveness, Frank G. Kauffman Jan 2005

Family Preservation: Perceptions Of Effectiveness, Frank G. Kauffman

Journal of Family Strengths

This qualitative study examines the attributes or perceptions of service providers and overseers as to the effectiveness of intensive family preservation services provided by a social services agency in Tucson, Arizona. The services provided are patterned after the Homebuilders' model developed in 1974 in Tacoma, Washington. Data collection was generated from interviews and focus groups with the in-home service providers, the program supervisor, and investigators and case managers with Child Protective Services (CPS). Although placement prevention rates (PPR) are the dependent variable in most studies on this form of intervention, this study seeks to understand those characteristics of the model …

Family Reunification Among Two Groups Of Runaway Adolescents Utilizing Emergency Shelters, Sanna J. Thompson, Liliane Cambraia Windsor, Kim Zittel-Palamara

Journal of Family Strengths

Limited research has addressed reunification of runaway youths with their families following an emergency shelter stay; however, recent studies have shown that those who reunify with their families following a shelter stay have more positive outcomes than those relocated to other residences. This study evaluated differences between two samples of runaway youth utilizing youth emergency shelters in New York (n = 155) and Texas (n = 195) and identified factors associated with reunification among these two groups of adolescents. Less than half (43.7%) of the youths were reunited with their families. Among New York runaway youths, those who had lived …

Heart And Soul: A New Rhythm For Clinical Externships, Leslie Larkin Cooney Jan 2005

Heart And Soul: A New Rhythm For Clinical Externships, Leslie Larkin Cooney

St. Thomas Law Review

The message of Therapeutic Jurisprudence is simple - focus on emotional life and psychological well-being and practice law as a healing profession - but the application of Therapeutic Jurisprudence to clinical teaching can have far ranging results. "Lawyers trained to be professionals have not been trained in how to respond to the anxiety, hurt feelings, and other emotions ... ," Law students arriving today in our clinical education settings require extra attention to the development of interpersonal skills for a variety of reasons. This article explores the concepts and development of Therapeutic Jurisprudence and outlines the benefits derived from incorporating …

Practicing (And Teaching) Therapeutic Jurisprudence: Importing Social Work Principles And Techniques Into Clinical Legal Education, Susan L. Brooks Jan 2005

Practicing (And Teaching) Therapeutic Jurisprudence: Importing Social Work Principles And Techniques Into Clinical Legal Education, Susan L. Brooks

St. Thomas Law Review

Practicing Therapeutic Jurisprudence ("TJ") requires proponents to advance a particular normative framework. As a clinical social worker turned lawyer, who is now also a clinical law teacher, I believe strongly that the field of social work provides a useful framework for legal education and practice. As I will demonstrate through examples from my teaching and my students' practice experiences, the role of the clinical law teacher is uniquely and well suited to apply social work values, principles, concepts, and techniques. By importing these core social work elements into the clinical legal education, faculty can truly teach future lawyers to practice …

St. Thomas Law Review

Gertrude Smith phones the SixtyPlus, Inc., Elderlaw Clinic ("Clinic") to schedule an appointment. She informs the receptionist that she wants to come to the Clinic so she can "get a trust." Ms. Smith is scheduled for an intake appointment to meet with two student legal interns ("interns"). Ms. Smith arrives for her appointment, is introduced to the interns, and agrees to be interviewed. The senior intern (a student in her second term at the Clinic) begins the interview by asking Ms. Smith what brought her to the Clinic. Ms. Smith reiterates that she "wants a trust because it is the …

From Violence And Victimization To Voice And Validation: Incorporating Therapeutic Jurisprudence In A Children's Law Clinic, Carolyn S. Salisbury Jan 2005

From Violence And Victimization To Voice And Validation: Incorporating Therapeutic Jurisprudence In A Children's Law Clinic, Carolyn S. Salisbury

St. Thomas Law Review

This article discusses our Clinic's Voice Project and examines the application of Therapeutic Jurisprudence principles to the group of foster children who created the Trapped mural: girls who are victims of abuse and who are committed to psychiatric facilities. In their self-expression, an overwhelming number of the girls focused on their experiences of being sexually abused and feeling re-victimized within the psychiatric and legal systems. Unfortunately, "[u]nlike most victims of other sexualized violence, the victims of child sexual abuse have had little or no voice, creating a literal as well as figurative absence of narrative about the harm." In this …

Making The Case: Therapeutic Jurisprudence And Problem-Solving Practices Positively Impact Clients, Justice Systems And Communities They Serve, Cait Clarke, James Neuhard Jan 2005

Making The Case: Therapeutic Jurisprudence And Problem-Solving Practices Positively Impact Clients, Justice Systems And Communities They Serve, Cait Clarke, James Neuhard

St. Thomas Law Review

What is becoming known as Therapeutic Jurisprudence or client-centered representation is new to most line-lawyers or leaders of traditional public defense programs. However, many of these practices have been incorporated into the daily practices within defender offices for decades. Strategies that secure better bonds or sentences lead many public defense programs to seek early entry into the jails and to verify client information. Efforts to learn about "beds" for their clients that were unknown to swamped probation programs have lead offices and individual defenders to actively participate and create alternative treatment programs. Overworked offices hire less expensive sentencing specialists or …

Therapeutic Jurisprudence And The Law School Asylum Clinic, Ingrid Loreen Jan 2005

Therapeutic Jurisprudence And The Law School Asylum Clinic, Ingrid Loreen

St. Thomas Law Review

This paper will explore how law school clinics in general, and asylum clinics in particular, can prepare students for healthier, more satisfied careers in the law by introducing them to one of the comprehensive law movements which has gained popularity in the last decades. By understanding the effects of trauma on their clients and by explicitly addressing issues of empathy, emotional intelligence, and cross-cultural communication, law school clinics, which already complement the traditional legal curriculum in significant ways, will improve and enrich the experience for both the client and the law student.

An Empirically-Supported Rational Basis For Prohibiting Adoption, Foster Parenting, And Contested Child Custody By Any Person Residing In A Household That Includes A Homosexually-Behaving Member, George A. Rekers Jan 2005

An Empirically-Supported Rational Basis For Prohibiting Adoption, Foster Parenting, And Contested Child Custody By Any Person Residing In A Household That Includes A Homosexually-Behaving Member, George A. Rekers

St. Thomas Law Review

Representative empirical evidence and common sense reasoning are reviewed below which necessitate the logical conclusion that households with one or more homosexually-behaving adults or adolescents should be prohibited from adoption and from foster parenting, and were found to be less capable of providing the best family structure in cases of contested child custody. Hundreds of additional scientific studies also support these three reasons for this rational basis, but space limitations necessitate the presentation of only a number of representative sources of supporting evidence here.

Trends On (Inter-Country) Adoption By Gay And Lesbian Couples In Western Europe, Paul Vlaardingerbroek Jan 2005

Trends On (Inter-Country) Adoption By Gay And Lesbian Couples In Western Europe, Paul Vlaardingerbroek

St. Thomas Law Review

In this article I will analyze Western European developments in the field of (inter-country) adoption by homosexuals. Some countries have accepted the legal possibility of adoption by homosexual individuals and/or couples, although this does not mean that in all cases children can be adopted by lesbian and gay persons. There are several restrictions on intercountry adoption. The jurisprudence of the European Court on Human Rights with regard to adoption by homosexuals is still rather restrictive. In this article, I will analyze the following questions: whether it is a human right to adopt or to be adopted; and, if adoption should …

The Inner Lives Of Children In Lesbigay Adoption: Narratives And Other Concerns, Lynn D. Wardle Jan 2005

The Inner Lives Of Children In Lesbigay Adoption: Narratives And Other Concerns, Lynn D. Wardle

St. Thomas Law Review

This article attempts to review some of the serious, non-stereotyped concerns that underlie some of the objections of thoughtful legal commentators to adoption of children by gay and lesbian couples or partners. These objections fall into four categories of significant concern: (1) the best interests of children, (2) the integrity of the legal institution of adoption, (3) inappropriate judicial behavior, including manifestation of bias and animus, and the exercise of (legislative) policy-making prerogatives, and (4) the failure to explore, much less carefully consider, alternative solutions (and the hasty abandonment of processes of careful, incremental change to embrace a radical, but …

Family Norms In Adoption Law: Safeguarding The Best Interests Of The Adopted Child, Camille S. Williams Jan 2005

Family Norms In Adoption Law: Safeguarding The Best Interests Of The Adopted Child, Camille S. Williams

St. Thomas Law Review

Because a number of negative circumstances or outcomes correlate with non-conjugal couple household structures and alternative sexualities, 6 lowering the high standard for adoptive parents that has been the hallmark of best adoption practices in the U.S. may not be the best option for addressing the needs of children whose biological parents cannot care for them.

Adult Sexual Desire And The Best Interest Of The Child, Richard G. Wilkins, Trent Christensen, Eric Selden Jan 2005

Adult Sexual Desire And The Best Interest Of The Child, Richard G. Wilkins, Trent Christensen, Eric Selden

St. Thomas Law Review

In Lofton v. Secretary of the Department of Children and Family Services, the United States Court of Appeals for the 11th Circuit sustained Florida's legislative decision to restrict adoption to heterosexual married couples or unmarried individuals not engaged in homosexual conduct. The court rejected claims by prospective homosexual parents that Florida had impermissibly intruded upon their familial privacy rights, unconstitutionally burdened their right to private sexual intimacy, and - by treating homosexual applicants for adoption differently than heterosexual applicants - transgressed the commands of the Equal Protection Clause. The court properly rejected these contentions. All of the plaintiffs' claims ultimately …
