Moran, Kentucky Ass'n Of Health Plans, And Davila: The (R)Evolution Of Erisa Preemption, Michael E. Nitardy

St. Thomas Law Review

This article chronicles the Supreme Court's recent pronouncements on the issue of ERISA preemption and attempts to assess what impact the varied pronouncements will have on the legal landscape. Specifically, the article analyzes the impact of Rush Prudential HMO, Inc. v. Moran, Kentucky Ass'n of Health Plans, Inc. v. Miller ("KAHP") and Davila. Although the cases address different aspects of preemption, together, the three provide a panoramic landscape of what the Supreme Court believes the appropriate emphasis of ERISA preemption should be. Part II of this article explores the background of ERISA and its preemption provisions. Part III recounts the …

Gay And Lesbian Adoption: Banishing The Pied Piper, Amy D. Ronner Jan 2005

Gay And Lesbian Adoption: Banishing The Pied Piper, Amy D. Ronner

St. Thomas Law Review

In my recent book, Homophobia and the Law, Robert Browning's Pied Piper, "the strangest figure" with a "queer long coat from heal to head, inducts a core chapter, the one on Children. After all, it is this notorious Pied Piper, who absconds with the town's children, leads them through a "wondrous portal" into the mountain-side cave, and renders their laughter inaudible forever. The Pied Piper has evolved into a menacing conceit that perpetuates discrimination against gay and lesbian couples. It is predicated on an irrational notion that homosexuals will, by coaxing children toward their own sexual orientation, seal them in …

The Evolution Of The Legal Concepts Of Family And Marriage In The Eu Legal System And Its Impact On Society, Jonathan Curci Jan 2005

The Evolution Of The Legal Concepts Of Family And Marriage In The Eu Legal System And Its Impact On Society, Jonathan Curci

St. Thomas Law Review

One particular aspect that we will examine is the emergence of new family forms in same-sex marriages. If the fundamental concepts of "marriage" are redefined, "other unions" or "family types" would be placed on par with heterosexual marriages, enjoying the same benefits the traditional family has provided over the course of humanity. This redefinition of marriage would undermine the concept of the traditional family and ignore its necessity for the benefit to mankind.

A Search For Reason In Fairy Tales, John F. Fernandez Jan 2005

A Search For Reason In Fairy Tales, John F. Fernandez

St. Thomas Law Review

A fairy1 tale: Once upon at time (not so very long ago), in a land (not so far away) lived a beautiful queen (well, actually a "runner up ") with a golden voice. The beautiful queen reined over her people and sang of sunshine. Some of the queen's subjects had felt that they were not treated fairly by the laws of the land and sought to have their unfair treatment prohibited. Apparently, this caused the queen to develop a fear and hatred for these subjects. These subjects had done nothing to the queen. Yet, the queen made it her mission …

St. Thomas Law Review

Part I more clearly describes children with special needs. Part II discusses who may adopt special needs children. Part III briefly covers gay and lesbian adoption statistics. Part IV sets forth general and specific factors that may be used in determining whether a particular gay man or lesbian is suitable for adopting children in Florida. This section also enumerates and discusses reasons that are offered to support bans on same-sex adoption. …

Bovine Tuberculosis Eradication: Uniform Methods And Rules, Effective January 1, 2005

Michigan Bovine Tuberculosis Bibliography and Database

These Uniform Methods and Rules (UM&R) are the minimum standards adopted and approved by the Deputy Administrator, Veterinary Services (VS), Animal and Plant Health Inspection Service (APHIS), on January 20, 2005. They were established for the maintenance of tuberculosis-free accredited herds of cattle and bison and the maintenance of State or zone status in the U.S. Department of Agriculture’s (USDA) tuberculosis eradication program.

These minimum standards do not preclude the adoption of more stringent standards by any State or zone.

Influence Of A Hailstreak On Boundary Layer Evolution, Zewdu T. Segele, David J. Stensrub, Ian C. Ratcliffe, Geoffrey M. Henebry Jan 2005

Influence Of A Hailstreak On Boundary Layer Evolution, Zewdu T. Segele, David J. Stensrub, Ian C. Ratcliffe, Geoffrey M. Henebry

School of Natural Resources: Faculty Publications

Severe thunderstorms developed on 20 June 1997 and produced heavy precipitation, damaging winds, and large hail over two swaths in southeastern South Dakota. Calculations of fractional vegetation coverage (scaled from 0 to 1) based upon composite satellite data indicate that, within the hailstreak region, vegetation coverage decreased from 0.50 to near 0.25 owing to the damaging effects of hail on the growing vegetation. The northern edge of the larger hailstreak was located a few kilometers south of Chamberlain, South Dakota, a National Weather Service surface observation site. Hourly observations from Chamberlain and several nearby surface sites in South Dakota are …

Also this year for the first time, we are including web sites which will lead you to additional research citations, applications and implications.

Becoming A Teacher Of Literacy: The Struggle Between Authoritative Discourses, Mindy Legard Larson, Donna Kalmbach Phillips Jan 2005

Becoming A Teacher Of Literacy: The Struggle Between Authoritative Discourses, Mindy Legard Larson, Donna Kalmbach Phillips

Faculty Publications

This study describes and analyzes the influence of an ideological conflict between a teacher education program and a school district upon one pre-service teacher’s emerging identity as a teacher of literacy. Using poststructural feminism as the theoretical framework and a single case study analysis, the study illustrates how the discourse of the school district’s scripted reading program and the discourse of the university’s comprehensive literacy positions Claire, the pre-service teacher. The data analysis demonstrates how being positioned between these two competing and authoritative discourses conflicts with her understanding of reading and reading instruction. Reflecting upon the data, the research becomes …

Five-Year Review Of Executive Order 13112 On Invasive Species Jan 2005

Five-Year Review Of Executive Order 13112 On Invasive Species

National Invasive Species Council

Invasive species inhabit all regions of the United States and every nation. The price society pays for invasives is reflected not only in significant economic damage but also in high level of environmental degradation, loss of recreational opportunities, and harm to animal, plant, and human health. Executive Order 13112 (EO) was issued in 1999 to enhance federal coordination and response to the complex and accelerating problem of invasive species. As directed by the EO, the National Invasive Species Council has approved this report for the Office of Management and Budget to assess the effectiveness of the EO and evaluate whether …
