Agencies, not Congress, are the primary lawmakers in the American federal legal system. By law, the public has a right to participate in the making of agency rules. With the passage of the E-Government Act, administrative agencies are now required to use information and communication technologies to promulgate their rulemakings and to afford the public the opportunity to participate via the Internet. As currently envisioned, however, the move from rulemaking to electronic rulemaking will not realize the opportunity to improve participation to the full extent. Trust is the foundation of society for without trust, we cannot cooperate. Trust, in turn, depends upon secure, reliable, and persistent identity. Cyberspace is thought to challenge our ability to build trust because the medium undermines the connection between online pseudonym and offline identity. We have no assurances of who stands behind an online avatar; it may be one person, it may be more, it may be a computer. Limit Horizons & Critique: Seductions And Perils Of The Nation, Tayyab Mahmud

This essay introduces four contributions on nation and nationalism that form a cluster in the 2005 Annual Symposium of Latina/o Critical Legal Theory (LatCrit). It puts forward the concept of "limit horizons": the hegemonic ontological categories that so imprint the imaginary of an age the even critique remains imprisoned in the normalcy of these categories - an imprisonment that curtails the transformatory potential of critique. It is argued that the modern concept of the nation is such a limit horizon. Consequently, any critical engagement with the concept of the nation must concurrently be an exercise in self-critique to ensure that …

Scholarly Profit Margins And The Legal Scholarship Network: Reflections On The Web, Lawrence A. Cunningham

Controversy surrounding scholastic rankings arises, in part, because of complexities associated with measuring academic contributions. Legal researchers use various methodologies to assess scholarly production and impact but all suffer from inherent limitations and none provides data useful to scholarly self-reflection. The 10-year old Legal Scholarship Network (LSN) offers potential to improve considerably on both scores of public and personal assessment. This Essay critically evaluates approaches to conceptualizing scholarly profit margins, explores how LSN can enhance these conceptions, and opens new frontiers for this innovative Web-based repository of legal writing.

Religion And Support Of Democracy: Protestantism, Catholicism, And The Support For Democracy In Mexico, Sara Jolly

The findings are consistent with other recent studies in Latin America. Eric Patterson found a similar pattern in Argentina and Chile in his study in 2003 (Patterson 2003). The data shows that despite Mexico’s history ofstrained Church/ State relations and a 70-year authoritarian rule, the Protestants in Mexico tend to hold similar beliefs on the support for democracy as the Protestants of other Latin American countries.

This thesis aims to prove that the arts should be a major component in every student’s education. Statistics, research findings, and case studies from throughout the years were compared and compiled together in order to make a strong argument in favor of the arts. The National Art Education Association website provided many statistics as did the National Center for Education Statistics. The global economy’s regional scale of operation, social equity concerns, and environmental degradation that transcends local governmental boundary lines propel an examination of whether twenty-first century conditions call for the creation of regional governmental structures in the United States. This article argues that the need to spur economic competitiveness and metropolitan-wide planning and growth management will impel the formation of new regional governance structures. Forging stronger connections between central cities and surrounding suburban strongholds, however, will not be easy. Intra-Guild Compensation Regulatesspecies Richness In Desert Rodents, J. Goheen, Ethan P. White, S.K. Morgan Ernest, J. H. Brown

Evidence from numerous studies suggests that species richness is an emergent property of local communities. The maintenance of species richness, despite changes in species composition and environmental conditions, requires compensatory colonization and extinction events with species coming from a regional pool. Using long-term data from a rodent community in the Chihuahuan Desert, we use randomization methods to test the null hypothesis that changes in species richness occur randomly. We find that the dynamics of species richness differ significantly from a random process, and that these nonrandom dynamics occur largely within the most speciose guild. Applying theories concerning the social construction of race, this Article borrows from the definition of disability under the Americans with Disabilities Act of 1990 (ADA) and the courts' analyses of disability discrimination cases under the "regarded as" disabled provision of the ADA, which allows a plaintiff to bring a claim against an employer who regards the plaintiff as having an impairment that substantially limits a major life activity. Problem. Ellen White’s educational philosophy and its application to the aims of education have not been systematically or thoroughly addressed within the parameters and demands of a graduate thesis. The present dissertation explores the aims of education, especially the ultimate aims of education, in the writings of Ellen G. White, one of the founders of the Seventh-day Adventist Church, and could be of value in assessing the present Seventh-day Adventist educational enterprise.

Beyond Surrender: Marian Sims, Francis B. Simkins, And Revisionism In Reconstruction South Carolina, David B. Parker

Historian Francis Butler Simkins's 1932 book 'South Carolina during Reconstruction' presented one of the earliest revisionist examinations of Reconstruction. Simkins suggested Reconstruction failed because it was not radical enough, and carpetbaggers could have succeeded had they confiscated land and destroyed the South's caste system. Simkins elaborated his views in his 1939 essay in the 'Journal of Southern History,' his paper "The Everlasting South" delivered to the 1946 meeting of the Southern Historical Association, and his 1954 presidential address to the Southern Historical Association. Simkins corresponded with novelist Marian McCamy Sims, who wrote seven novels set among the upper- and middle-class …
