Natural Allies? Regional Security In Asia And Prospects For Indo-American Strategic Cooperation, Stephen J. Blank Dr. Oct 2005

Natural Allies? Regional Security In Asia And Prospects For Indo-American Strategic Cooperation, Stephen J. Blank Dr.

Books, Monographs & Collaborative Studies

One of the hallmarks of the two Bush administrations' foreign and defense policies has been a growing rapprochement with India. Indeed, in June 2005 the U.S. Government signed a defense agreement with that country. In part, this rapprochement is driven by and coincides with India's increasingly visible role as a major Asian power. This monograph seeks to illuminate India's rising power and capabilities with regard to the key regions on its periphery: the Persian Gulf, Central Asia, and Southeast Asia. The author also considers the major issues pertaining to India's bilateral defense agenda with the United States. By revealing the …

Does Choice Of Estimators Influence Conclusions From True Metabolizable Energy Feeding Trials?, Mark H. Sherfy, Roy L. Kirkpatrick, Kenneth E. Webb Jr. Oct 2005

Does Choice Of Estimators Influence Conclusions From True Metabolizable Energy Feeding Trials?, Mark H. Sherfy, Roy L. Kirkpatrick, Kenneth E. Webb Jr.

United States Geological Survey, Northern Prairie Wildlife Research Center: Publications

True metabolizable energy (TME) is a measure of avian dietary quality that accounts for metabolic fecal and endogenous urinary energy losses (EL) of non-dietary origin. The TME is calculated using a bird fed the test diet and an estimate of EL derived from another bird (Paired Bird Correction), the same bird (Self Correction), or several other birds (Group Mean Correction). We evaluated precision of these estimators by using each to calculate TME of three seed diets in blue-winged teal (Anas discors). The TME varied by <2% among estimators for all three diets, and Self Correction produced the least variable TMEs for each. The TME did not differ between estimators in nine paired comparisons within diets, but variation between estimators within individual birds was sufficient to be of practical consequence. Although differences in precision among methods were slight, Self Correction required the lowest sample size to achieve a given precision. Feeding trial methods that minimize variation among individuals have several desirable properties, including higher precision of TME estimates and more rigorous experimental control. Consequently, we believe that Self Correction is most likely to accurately represent nutritional value of food items and should be considered the standard method for TME feeding trials.

A Multi-Forest Comparison Of Dietary Preferences And Seed Dispersal By Ateles Spp., Sabrina E. Russo, Christina J. Campbell, J. Lawrence Dew, Pablo R. Stevenson, Scott A. Suarez Oct 2005

A Multi-Forest Comparison Of Dietary Preferences And Seed Dispersal By Ateles Spp., Sabrina E. Russo, Christina J. Campbell, J. Lawrence Dew, Pablo R. Stevenson, Scott A. Suarez

School of Biological Sciences: Faculty Publications

Investigations of coevolutionary relationships between plants and the animals that disperse their seeds suggest that disperser-plant interactions are likely shaped by diffuse, rather than species-to-species, coevolution. We studied the role of dietary plasticity in shaping the potential for diffuse coevolution by comparing dietary fruit preferences and seed dispersal by 3 species of spider monkeys (Ateles spp.) in 4 moist forests in Colombia, Ecuador, Panama, and Surinam. In all forests, spider monkeys were highly frugivorous and preyed upon seeds of few species. We estimated dietary use of fruiting taxa based on absolute consumption and preference, which accounts for resource availability. …

The Symmetry Of Longevity, Lawrence G. Harshman, Hans-Georg Müller, Xueli Liu, Yue Wang, James R. Carey Oct 2005

The Symmetry Of Longevity, Lawrence G. Harshman, Hans-Georg Müller, Xueli Liu, Yue Wang, James R. Carey

Lawrence G. Harshman Publications

We tested the hypothesis that relatively symmetrical flies live longer. Vein measurements on the left and right wings from the same individual were used to characterize bilateral symmetry in relationship to age-specific survival in defined cohorts. A longitudinal cohort study supported the hypothesis of a correlation between bilateral symmetry and longevity. For another type of experiment, wings were removed from females and males at approximately the beginning of adult life. Thus, there would be no effect of wings per se on adult survival. These wings were measured to characterize bilateral asymmetry, and the day of death of each dewinged individual …

No Small Matter: Leadership For Institutional Culture In Vincentian Higher Education, Dennis H. Holtschneider C.M., Ed.D. Oct 2005

No Small Matter: Leadership For Institutional Culture In Vincentian Higher Education, Dennis H. Holtschneider C.M., Ed.D.

Vincentian Studies

The consideration of “Vincentian leadership” exists within the larger context of the loss of religious personnel from Catholic universities across the United States. For the religious mission and identity to remain strong at these institutions, Vincentian leaders must leverage a primarily lay-led, self-sustaining culture.

Vincentian Leadership—Advocating For Justice, Craig B. Mousin Oct 2005

Vincentian Leadership—Advocating For Justice, Craig B. Mousin

Vincentian Studies

DePaul University employs thousands of people. As Craig Mousin writes, “To do justice to those we seek to serve necessitates that we do justice to those who engage in our work.” He explores “the centrality of work to life and mission” (including the personal and individual missions employees have for themselves) and what justice in the workplace means. He “examine[s] historical concepts of justice to understand what an advocate of justice works toward in a Vincentian institution.” Mousin also discusses how Vincentian leadership principles and “understandings of justice” should be applied in employment situations, especially when the law might advise …

Bond Yield Compression In The Countries Converging To The Euro, Lucjan T. Orlowski, Kirsten Lommatzsch Oct 2005

Bond Yield Compression In The Countries Converging To The Euro, Lucjan T. Orlowski, Kirsten Lommatzsch

WCBT Faculty Publications

We demonstrate that bond yield compression is under way in the countries converging to the euro and that German yields are significant drivers of local currency yields. Based on the evidence from Poland, Hungary and the Czech Republic, we conclude that these new ...Member States of the European Union are ready to adopt the euro without risking a disruptive shock to their financial stability. This message transpires from investigating the daily volatility dynamics of local bond yields as a function of German yields, conditional on changes in local term spreads, exchange rates and adjustments to central bank reference rates. How To Understand China: The Dangers And Opportunities Of Being A Rising Power, William A. Callahan

Research Collection School of Social Sciences

china’s situation lends itself to hyperbole. the people’s republic of china (prc) has the largest population in the world, the fastest growing economy in the world, the largest army in the world, the largest middle class in the world, a permanent seat on the united nations security council, a manned space programme, a nuclear arsenal, and so on. but analysts, commentators and policymakers have yet to decide just how to understand china.

Transaction Surveillance By The Government, Christopher Slobogin Oct 2005

Transaction Surveillance By The Government, Christopher Slobogin

Vanderbilt Law School Faculty Publications

This symposium article is the second of two on regulation of government efforts to obtain recorded information for criminal prosecutions. More specifically, it explores the scope and regulation of "transaction surveillance," which it defines as government attempts to access already existing records, either physically or through data banks, and government efforts to obtain, in real-time or otherwise, "catalogic data" (the identifying signals of a transaction, such as the address of an email recipient). Transaction surveillance is a potent way of discovering and making inferences about a person's activities, character and identity. Yet, despite a bewildering array of statutorily created authorization …

Adverse Possession Of Identity: Radical Theory, Conventional Practice, Jessica A. Clarke Oct 2005

Adverse Possession Of Identity: Radical Theory, Conventional Practice, Jessica A. Clarke

Vanderbilt Law School Faculty Publications

This Article examines the conditions under which acting as if one has a particular legal status is sufficient to secure that status in the eyes of the law. Legal determinations of common-law marriage, functional parenthood, and racial identity share striking similarities to adverse possession law – these doctrines confer legal status on those who are merely acting as if they have that legal status. In each case, the elements of a legal claim are strikingly similar: physical proximity, notoriety and publicity, a claim of right, consistent and continuous behavior, and public acquiescence. The reason public performance is critical is that …

Dynamic Voltage Scaling Techniques For Power Efficient Video Decoding, Ben Lee, Eriko Nurvitadhi, Reshma Dixit, Chansu Yu, Myungchul Kim Oct 2005

Dynamic Voltage Scaling Techniques For Power Efficient Video Decoding, Ben Lee, Eriko Nurvitadhi, Reshma Dixit, Chansu Yu, Myungchul Kim

Electrical and Computer Engineering Faculty Publications

This paper presents a comparison of power-aware video decoding techniques that utilize dynamic voltage scaling (DVS). These techniques reduce the power consumption of a processor by exploiting high frame variability within a video stream. This is done through scaling of the voltage and frequency of the processor during the video decoding process. However, DVS causes frame deadline misses due to inaccuracies in decoding time predictions and granularity of processor settings used. Four techniques were simulated and compared in terms of power consumption, accuracy, and deadline misses. In addition, this paper proposes the frame-data computation aware (FDCA) technique, which is …

It's Not Easy Being A Cast Iron Bitch: Sexual Difference And The Female Action Hero, Diana Dominguez Oct 2005

It's Not Easy Being A Cast Iron Bitch: Sexual Difference And The Female Action Hero, Diana Dominguez

Reconstruction: Studies in Contemporary Culture

Lt. Ellen Ripley of the Alien series of films, Sarah Connor of the Terminator series, and Lindsey Brigman of The Abyss are examples of a special category of female role in Hollywood – the female action hero. To varying degrees of success, the three characters mentioned above defy the principal dilemma filmmakers seem to have in creating a character that can reconcile the presumably mutually exclusive aspects of cast iron bitch and traditional patriarchal societal views of femininity. Ripley, Connor, and Brigman infiltrate the male-dominated category of the action hero, but they are not a direct feminine challenge to the …

The Trouble With Trills: Gender And Consciousness In Star Trek, Susan J. Wolfe Oct 2005

The Trouble With Trills: Gender And Consciousness In Star Trek, Susan J. Wolfe

Reconstruction: Studies in Contemporary Culture

The Star Trek series, which have been both praised for radical inclusiveness and criticized for their neo-conservative agendas, de-essentialize identity, gender, and sexual orientation through their depictions of the Trill, an alien race in which humanoids join with symbionts, slug-like creatures each of which lives in the abdominal cavity of its host, with whom it then shares a single fused consciousness. Hosts are selected independently of their sex, so that a symbiont dwells alternatively inside males and females; each new host, as well as the symbiont, is heir to the memories of all previous hosts.

The notions of unified selves …

How "Mead" Has Muddled Judicial Review Of Agency Action, Lisa Schultz Bressman Oct 2005

How "Mead" Has Muddled Judicial Review Of Agency Action, Lisa Schultz Bressman

Vanderbilt Law School Faculty Publications

In "United States v. Mead Corp.", the Supreme Court held that an agency is entitled to Chevron deference for interpretations of ambiguous statutory provisions only if Congress delegates, and the agency exercises, authority to issue such interpretations with "the force of law." The Court did not define "force of law," and thus did not determine what type of agency procedures fit within Mead. Four years have passed since the Court decided Mead, and despite numerous Court of Appeals decisions, we still do not know when an agency is entitled to Chevron deference for interpretations issued through procedures less formal than …

Testing Jury Reforms, Valerie P. Hans, B. Michael Dann, David H. Kaye, Erin J. Farley, Stephanie Albertson

Cornell Law Faculty Publications

DNA evidence has become a key law enforcement tool and is increasingly presented in criminal trials in Delaware and elsewhere. The integrity of the criminal trial process turns upon the jury's ability to understand DNA evidence and to evaluate properly the testimony of experts. How well do they do? Can we assist them in the process?

Insecure Retirement Income, Wrongful Plan Administration And Other Employee Benefits Woes — Evaluating Erisa At Age Thirty, Maria O'Brien Oct 2005

Insecure Retirement Income, Wrongful Plan Administration And Other Employee Benefits Woes — Evaluating Erisa At Age Thirty, Maria O'Brien

Faculty Scholarship

Book Review of The Employee Retirement Income Security Act of 1974: A Political History by James A. Wooten.

Goeres and the many other recent cases like it10 are remarkable after Mertens and Great West, both for the persistence of the ERISA plaintiff's bar in trying to find ways to obtain make-whole relief in egregious cases and for the continued refusal of Congress to amend ERISA to provide adequate make-whole remedies."11 A patently unjust and inefficient legal regime continues to replicate itself again and again. Conduct that clearly constitutes breach of fiduciary duty, negligent plan administration or worse, …

How "Mead" Has Muddled Judicial Review Of Agency Action, Lisa S. Bressman

Vanderbilt Law Review

When the Supreme Court decided United States v. Mead Corp. four years ago, Justice Scalia predicted that judicial review of agency action would devolve into chaos. This Article puts that prediction to the test by examining the court of appeals decisions applying the decision. Justice Scalia actually understated the effect of Mead. This Article suggests a remedy for the mess.

In Mead, the Court held that an agency is entitled to deference under Chevron, U.S.A., Inc. v. NRDC only if Congress has delegated to that agency the authority to issue interpretations that carry the force of law, and the agency …
