Forty Years After Title Vii: Creating An Atmosphere Conducive To Diversity In The Corporate Boardroom, Donald J. Polden

Faculty Publications

This article analyzes affirmative action in employment: one of the most controversial government policies of the last decade, and one that continues to divide the passions and sensibilities of Americans. This article also addresses the effects of Title VII on employment opportunities for women. In particular, the article considers how successful the fundamental policies of Title VII have been in increasing diversity on corporate boards of directors, and investigates whether increased diversity will improve the performance of publicly traded companies.

Fit 2-B Fathers: The Effectiveness Of Extension Programming With Incarcerated Fathers, Joseph J. Maiorano, Ted G. Futris Oct 2005

Fit 2-B Fathers: The Effectiveness Of Extension Programming With Incarcerated Fathers, Joseph J. Maiorano, Ted G. Futris

Journal of Extension

Incarceration and recidivism negatively affect offenders, their children, families, and communities. Fit 2-B FATHERS, a social and parenting skills program for males in the corrections system, has been found to improve participants attitudes about themselves, their role as fathers, and their understanding of positive parenting practices. This program can help participants become less of a security risk during the remainder of their sentence and have reduced rates of recidivism following their release. When participants positively engage in the lives of their children, their children may be less likely to engage in at-risk behaviors that could lead to imprisonment.

Illegal File-Sharing In The Academy: Assessment, Implications, And Policy Responses, Eric S. Linden Oct 2005

Illegal File-Sharing In The Academy: Assessment, Implications, And Policy Responses, Eric S. Linden

Theses

This thesis explores the Federal Government's role and prospects for combating illegal file-sharing by examining the problem from a classic three prong approach: technology development, enforcement, and ethics reform through education. Original survey data was used to assess the current state of the problem, and the analytic hierarchy process was used to examine the current state of technology development. The thesis concludes with policy recommendations for government action. The author found that enforcement is the most effective method of lowering the music, movie, and software file-sharing rates.

A Constitutional Court In The Absence Of A Formal Constitution? On The Ramifications Of Appointing The Israeli Supreme Court As The Only Tribunal For Judicial Review, Guy E. Carmi Oct 2005

A Constitutional Court In The Absence Of A Formal Constitution? On The Ramifications Of Appointing The Israeli Supreme Court As The Only Tribunal For Judicial Review, Guy E. Carmi

Connecticut Journal of International Law

Israel does not have a formal Constitution. Nonetheless, recent developments over the last decade in the arena of Israeli constitutional law, which are widely referred to as the "Constitutional Revolution," have ushered in dramatic and fundamental change. In 1995, the set of Basic Laws, which were enacted in piecemeal fashion over the years without previously receiving much attention,' were proclaimed by the Israeli Supreme Court to have a constitutional nature. Consequently, those laws invite judicial review. 2 As Chief Justice Barak refers to them, these Basic Laws serve as a "Crippled Constitution."

The Israeli Supreme Court serves as a constitutional …

Translating The French Civil Code: Politics, Linguistics And Legislation, Olivier Cachard Oct 2005

Translating The French Civil Code: Politics, Linguistics And Legislation, Olivier Cachard

Connecticut Journal of International Law

The close of 2004 gave rise to a sharp controversy about French Law, namely its Civil Law. On the one hand, the French were celebrating the bicentennial of the Civil Code, placing emphasis on its flexibility and its adaptability to new economic models.2 On the other hand, a report of the World Bank concluded that the French Legal System was deterring business, 3 the enforcement of contracts being quite difficult to manage in French Law. The French disputed the accuracy of the methods and data used. in this report, correctly assuming there were many material errors. They argued that the …

Dartmouth Scholarship

Multi-wavelength Near-Infrared (NIR) Tomography was utilized in this study to non-invasively quantify physiological parameters of breast tumors using direct spectral reconstruction. Frequency domain NIR measurements were incorporated with a new spectrally constrained direct chromophore and scattering image reconstruction algorithm, which was validated in simulations and experimental phantoms. Images of total hemoglobin, oxygen saturation, water, and scatter parameters were obtained with higher accuracy than previously reported. Using this spectral approach, in vivo NIR images are presented and interpreted through a series of case studies (n=6 subjects) having differing abnormalities. The corresponding mammograms and ultrasound images are also evaluated. Three of six …

Ritual Legitimacy And Scriptural Authority, James W. Watts Oct 2005

Ritual Legitimacy And Scriptural Authority, James W. Watts

Religion - All Scholarship

In this essay, James W. Watts explains the interdependence of texts and rituals with regard to ancient religions. Specifically, he outlines patterns of practice and developments in the ritual use of texts and the texual authorization of rituals in antiquity.

Watts also makes the case that beyond the interplay of texual authority and ritual legitimacy that most ancient cultures engaged in, Judaism was unique in elevating the Torah along with its other laws and stories to special "scriptural" status.

On Brian Attebery’S Decoding Gender In Science Fiction, C. Jason Smith Oct 2005

On Brian Attebery’S Decoding Gender In Science Fiction, C. Jason Smith

Reconstruction: Studies in Contemporary Culture

[First paragraph]

The premise of Decoding Gender in Science Fiction is, as Brian Attebery states in the first chapter, that “Science fiction is a useful tool for investigating habits of thought, including conceptions of gender. Gender, in turn, offers an interesting glimpse into some of the unacknowledged messages that permeate science fiction” (1). What we have in Decoding Gender in Science Fiction is the most comprehensive analysis of gender tropes in Science Fiction from its origins in Gothic literature to today. Attebery states in his introduction that he was surprised to find there was no historical study of the development …

Association Between Lower Extremity Posture At Contact And Peak Knee Valgus Moment During Sidestepping: Implications For Acl Injury, Scott G. Mclean, Xuemei M. Huang, Antonie J. Van Den Bogert

Mechanical Engineering Faculty Publications

Background. Knee valgus load during sports movement is viewed as an important predictor of non-contact anterior cruciate ligament injury risk, particularly in females. Formulating movement strategies that can reduce valgus loading during these movements therefore appears pertinent to reducing anterior cruciate ligament injury rates. With this in mind, the current study examined the relationship between peak valgus moment and lower extremity postures at impact during a sidestep cutting task.

Methods. Ten male and ten female NCAA athletes had initial contact three-dimensional hip, knee and ankle angles and subsequent knee valgus moment quantified during the execution of (n=10 trials) …

Numerical Comparative Law: Do We Need Statistical Evidence In Law In Order To Reduce Complexity?, Mathias M. Siems Oct 2005

Numerical Comparative Law: Do We Need Statistical Evidence In Law In Order To Reduce Complexity?, Mathias M. Siems

Cardozo Journal of International and Comparative Law

The article explores the use of numerical methods in comparative law, questioning whether statistical approaches can effectively simplify legal complexity without oversimplification. It examines both the potential benefits and drawbacks of quantifying legal systems, arguing that while numerical methods can enhance practical utility, they must be used cautiously to avoid neglecting legal complexity and contextual factors.

Contractarianism And Corporate Law: Alternative Explanations To The Law's Mandatory And Enabling/Default Contents, Ige Omotayo Bolodeoku Oct 2005

Contractarianism And Corporate Law: Alternative Explanations To The Law's Mandatory And Enabling/Default Contents, Ige Omotayo Bolodeoku

Cardozo Journal of International and Comparative Law

The article critically examines the contractarian theory of corporate law, which posits that corporate governance should primarily consist of default rules that parties can modify through private bargaining. While this approach offers valuable economic insights, the article argues that its limitations as both a descriptive and prescriptive framework undermine its effectiveness in addressing the complexities of corporate governance, particularly in widely held companies. The analysis highlights the tension between the efficiency of default rules and the need for mandatory legal protections to prevent managerial abuse and protect public interests. Ultimately, the article advocates for a balanced approach that incorporates both …

Globalization & Law: Beyond Traditional Methodology Of Comparative Legal Studies And An Example From Private International Law, Fabio Morosini

Cardozo Journal of International and Comparative Law

The article explores the impact of globalization on comparative legal studies and private international law, arguing that traditional methodologies in comparative law must evolve to address the challenges posed by globalization. It emphasizes the need for interdisciplinary approaches, particularly incorporating economic analysis, to better understand and adapt to the changing legal landscape. The analysis focuses on the European Union as a case study, demonstrating how European Community law influences the private international law of its member states and advocating for methodological innovations to maintain the relevance of comparative legal studies in a globalized world.

Lost And Found: The Imagined Geographies Of American Studies, Cindi Katz

Publications and Research

In the days after September 11th, 2001, and continuing until now, the national guard and other military personnel fanned out around New York City. Automatic rifles slung over their camouflaged shoulders, they "guarded" New York City's transportation stations, vital corners and thoroughfares, marquee buildings, and each and every bridge and tunnel entrance. Their comportment was usually cordial and rarely vigilant. Exuding the antithesis of an urban sensibility, they complemented the beefy boredom of the police who usually stood nearby, with an almost surreal sense of incredulity; not just "Why am I here?" but a sort of bafflement that anyone would …

Electrical and Computer Engineering Faculty Research & Creative Works

The modeling and the analysis of the power distribution networks (PDN) within multi-layer printed circuit board is crucial for the investigation of the performance of PCB systems. Carrying out such analyses in SPICE based tools has the advantage of being faster than the corresponding full-wave modeling and it allows obtaining both frequency and time domain results.
