As a result of Daubert, trial judges were advised to only admit an expert once they determine 1) that the testimony is supported with scientific evidence and 2) would assist the trier(s) of fact. The present studies were designed to address the second criterion of admissibility by 1) assessing jurors' knowledge of eyewitness memory, and 2) determining if they can apply this knowledge when assessing mock courtroom testimony. In the first study, subjects evaluated trial transcripts of testimony concerning an eyewitness account where factors that influence eyewitness memory were present in either a negative form or a positive form. This thesis presents three views of anomaly in explanation: the linguistic view, the perceptual view, and the mechanistic view. The linguistic view is based on the notion that an anomaly is an instance of logical inconsistency. According to the perceptual view, an anomaly is a perceptual event which consists of a phenomenon deviating from a paradigmatic set of expectations. Lastly, the mechanistic view defines anomaly as a phenomenon which reveals the predictive failure of a model of the mechanism underlying the phenomenon to be explained. Paper Versus Electronic Sources For Law Review Cite Checking: Should Paper Be The Gold Standard?, April Schwartz, Mary Rumsey

Despite law students' reliance on electronic sources for legal research, a survey confirmed that many journals make their staff members check authors' citations against paper sources. Rumsey and Schwartz argue that the advent of image-based document collections should change this practice, making life easier for law students and law school librarians.

Incompressible Finite Elements Via Hybridization. Part Ii: The Stokes System In Three Space Dimensions, Bernardo Cockburn, Jay Gopalakrishnan

We introduce a method that gives exactly incompressible velocity approximations to Stokes ow in three space dimensions. The method is designed by extending the ideas in Part I (http://archives.pdx.edu/ds/psu/10914) of this series, where the Stokes system in two space dimensions was considered. Thus we hybridize a vorticity-velocity formulation to obtain a new mixed method coupling approximations of tangential velocity and pressure on mesh faces. Once this relatively small tangential velocity-pressure system is solved, it is possible to recover a globally divergence-free numerical approximation of the fluid velocity, an approximation of the vorticity whose tangential component is continuous across …

Linear regression and analysis of variance (ANOVA) are two of the most widely used statistical techniques in ecology. Regression quantitatively describes the relationship between a response variable and one or more continuous independent variables, while ANOVA determines whether a response variable differs among discrete values of the independent variable(s). Designing experiments with discrete factors is straightforward because ANOVA is the only option, but what is the best way to design experiments involving continuous factors? This work studies a fault detection method which analyzes sensor data for changes in their characteristics to detect the occurrence of faults in a dynamic system. The test system considered in this research is a Boeing-747 aircraft system and the faults considered are the actuator faults in the aircraft. The method is an alternative to conventional fault detection method and does not rely on analytical mathematical models but acquires knowledge about the system through experiments. Most investigations that examine diffusion of disease through urban areas give relatively scant attention to the 'micro-environment.' Employing the many methods of macro-environmental analysis, most studies do not attempt to identify street-level or even residence-level temporal-spatial patterns of disease diffusion. As a result, the mechanisms that lead to diffusion on such small scales are left relatively undefined. There is no doubt that cumulatively these small-scale mechanisms contribute to the diffusion of disease over the urban environment. Children with mental retardation are more likely to be abused than the general population, yet are often denied access to the justice system. Research on children without mental retardation has revealed skepticism as to their reliability as witnesses in the court of law. Even more so, children with mental retardation face the issue of credibility because of their age and disability. This study assesses attorneys' perceptions of child witnesses with mental retardation. The dress and appearance of contemporary Chinese women have not been studied much by mass communication researchers. This paper, however, explored the factors that influence the development and evolution of contemporary Chinese women’s dress and appearance. This dissertation discusses algorithmic and implementation aspects of an automatically configurable remote visualization system, which optimally decomposes and adaptively maps the visualization pipeline to a wide-area network. The first node typically serves as a data server that generates or stores raw data sets and a remote client resides on the last node equipped with a display device ranging from a personal desktop to a powerwall. Intermediate nodes can be located anywhere on the network and often include workstations, clusters, or custom rendering engines. Since 9/11, airport security has become an area of critical national security. The current study investigates the effect of mental rotation training and the presence of visual decision aids on inspection performance. Forty-eight participants were divided into two groups (Group A and Group B) of twenty-four each. Each group was provided with training on visual inspection, baggage screening and on using the software simulation of airport baggage inspection. Participants had to identify from images any object that cannot be allowed on a passenger plane and register a response by clicking one of the buttons, “Threat” or “No Threat”. Participants in …

Pauline Viardot (1821- 1910) was a famous mezzo-soprano with a career spanning twenty-four years (1839-1863). Her Music Salon is credited for launching the careers of Camille Saint-Säens, Jules Massenet, Gabriel Fauré, and Charles Gounod. After her retirement she turned her attention towards teaching and composition. She has written over 100 Vocal compositions, 15 Instrumental compositions and 5 Salon Operas. Chapter 1 presents an introduction and biography of the composer, with special emphasis on her family, friends, colleagues, performance career and music salon. This study reads the rise, reign, and fall of the English gentleman through the lens of the hobbledehoy novels of Anthony Trollope. It explores Trollope’s use of the hobbledehoy (a term, now almost archaic, for an awkward young man) in eight novels appearing between 1857 and 1879: The Three Clerks (1857), The Small House at Allington (1864), The Last Chronicle of Barset (1867), Phineas Finn (1869), Phineas Redux (1874), John Caldigate (1879), The Way We Live Now (1875), and The Prime Minister (1876). Thirty-nine ejaculates from 8 Holstein bulls were collected. Straws of semen (n=750) were distributed among dairies in three states. Ten straws per ejaculate were sent to Louisiana State University (LSU) Dairy Improvement Center for conventional polymerase chain reaction (PCR) analysis. Spermatozoal DNA was extracted and PCR analysis was done using one primer set amplifying a single copy 125 base pair (bp) section of the Bos taurus factor IX (Christmas factor) precursor (found on the X chromosome) and another primer set amplifying a single copy section of the Bos taurus sex determining region Y protein (SRY) gene (found on the Y …

Sidescan Sonar, chirp sonar sub-bottom profiles, and grab samples were collected on the north-central Gulf of Mexico continental shelf as part of an interdisciplinary study mapping juvenile red snapper habitat. Demarcation of essential fish habitat for juvenile red snapper (Lutjanus campechansis) in the Gulf of Mexico is considered critical for effective management of this valuable species. The first goal of this study was to map and describe the geology of this region. The second goal was to attempt to relate variations in geology to juvenile red snapper abundance and distribution. Radiotherapy treatment planning utilizing PET and CT is rapidly gaining acceptance in oncology. A limiting factor of the dual modality is the PET/CT alignment. A small error in PET/CT alignment may result in giving large doses of radiation to healthy tissues as a result of poor treatment planning. For this purpose, regular quality assurance testing of PET/CT must be performed. Separate QA procedures and phantoms have been developed for the two different modalities. In particular, many existing phantoms cannot be used for both modalities, which is a requirement for evaluating PET/CT alignment. Our goal is to evaluate several existing phantom …

This paper is an invitation to those in the legal academy who self-identify as egalitarian, as feminist, or as otherwise committed to equality in the law and the legal profession. The essay asks feminists and egalitarians to notice and resist the institutionalized and illegitimate status hierarchy operating in American law schools. Like any status hierarchy, its boundaries are well defined and well enforced. Additionally, and perhaps not surprising to feminists, this hierarchy is gendered, with the lowest rank overwhelmingly composed of women and the highest rank overwhelmingly composed of men. In this thesis, we use log-polar transform to solve object tracking. Object tracking in video sequences is a fundamental problem in computer vision. Even though object tracking is being studied extensively, still some challenges need to be addressed, such as appearance variations, large scale and rotation variations, and occlusion. We implemented a novel tracking algorithm which works robustly in the presence of large scale changes, rotation, occlusion, illumination changes, perspective transformations and some appearance changes. Rubato is widely regarded as a purely intuitive art. While it may be true that most performers rely solely on intuition for their rubato, a conscious approach may also be helpful. For the teacher of “analysis for performers,” a conscious approach is essential if rubato is to be discussed at all.
Rubato is a difficult subject to theorize. The late David Epstein made an admirable attempt in his book Shaping Time, using recordings by performers he admired to construct quantitative models. My approach here will be qualitative rather than quantitative, and introspective rather than empirical. Unlike Epstein, I will …
