Measurement Of Lipid Peroxidation In Biology Models Using Gas-Chromatography-Aass Spectrometry, Madhavi Lokireddy Jan 2005

Measurement Of Lipid Peroxidation In Biology Models Using Gas-Chromatography-Aass Spectrometry, Madhavi Lokireddy

Master's Theses and Doctoral Dissertations

C2C12 mouse myoblast cells, grown in glass vials, were connected to a cryofocusing unit to trap volatile organic compounds (VOCs). The VOCs were eluted from the trap by capacitive discharge into a gas chromatograph with time-of-flight mass spectral capabilities (GC-TOFMS) and were found to include the lipid peroxidation product hexanal. The pro-oxidant cumene hydroperoxide elevated the levels of these lipid peroxidation products, whereas the anti-oxidant butylated hydroxy toluene (BHT) impaired their production. Derivatization of the aldehyde products of lipid peroxidation in the same myoblast cells with pentafluorobenzyl hydroxylamine hydrochloride (PFB) provided evidence for formation of non-volatile products of lipid peroxidation …

Preferred Habitat For Liquidity In International Short-Term Interest Rates, Vladimir Valeryevich Kotomin Jan 2005

Preferred Habitat For Liquidity In International Short-Term Interest Rates, Vladimir Valeryevich Kotomin

Electronic Theses and Dissertations

U.S. money market securities have been found to exhibit behavior consistent with preferred habitat for liquidity around year-ends (Griffiths and Winters (1997, 2004)). In particular, repurchase agreement and commercial paper yields tend to increase when the security begins to mature across the end of the year, and return to normal levels after the year-end obligations have been paid but before the calendar year-end. The competing hypothesis, window dressing by financial intermediaries around disclosure dates, requires that the increase in yields be sustained until after the turn of the year. This study is aimed at finding whether the behavior of international …

The Ncaa's Regulations Related To The Use Of Agents In The Sport Of Baseball: Are The Rules Detrimental To The Best Interest Of The Amateur Athlete?, Richard T. Karcher

Vanderbilt Journal of Entertainment & Technology Law

First, this Article will discuss the NCAA regulations applicable to all sports regarding the use of agents by amateur athletes. Next, this Article will discuss (i) the mechanics of the annual Major League Baseball draft, (ii) the factors that contribute to the necessity and desire for amateur baseball players to retain a competent agent or lawyer before they have extinguished their NCAA eligibility, and (iii) how the NCAA regulations are detrimental to both drafted and draft-eligible amateur baseball players. Finally, this Article will discuss how the NCAA should revise its regulations to better serve the amateur athlete in the sport …

Representant Les Etats-Unis D'Amerique: Reforming The Usoc Charter, Christopher T. Murray Jan 2005

Representant Les Etats-Unis D'Amerique: Reforming The Usoc Charter, Christopher T. Murray

Vanderbilt Journal of Entertainment & Technology Law

This Article proposes a reorganization of Olympic and amateur sports in the States not yet entertained by Congress, the USOC, or the legal academy. Congress should revoke the USOC's charter as a patriotic organization. The USOC should be divided and reformed. The Olympic-related functions of the USOC should be recast into a government corporation. Thus, the financial, political, and legal functions of representing the United States in the Olympic movement would be administered like those of a corporation. The governance of amateur sports should be removed from the USOC's charter and privatized into an association of the individual sports.

Copyright Infringement In The Indian Film Industry, Rachana Desai Jan 2005

Copyright Infringement In The Indian Film Industry, Rachana Desai

Vanderbilt Journal of Entertainment & Technology Law

This Note focuses on the largest of these industries: Bollywood, the center of Hindi language cinema. In recent years, nearly eight out of every ten Bollywood scripts have been inspired by one or more Hollywood films. Previously, this widespread problem was not visible to those outside of India. The emergence of the internet and better global communications, however, have made Westerners more aware of the cultural copy situation in India. In 2003, best-selling fiction writer Barbara Taylore-Bradford brought a copyright infringement suit against Sahara Television for allegedly making a television series out of her book "A Woman of Substance." After …

Some Catching Up To Do, Kara M. Wolke Jan 2005

Some Catching Up To Do, Kara M. Wolke

Vanderbilt Journal of Entertainment & Technology Law

The analysis begins with a discussion of the purposes behind the WPPT and the international recognition of a general sound recording performance right. Part I discusses Congress' partial implementation of the WPPT through the Digital Millennium Copyright Act of 1998 (DMCA) and the digital performance right. Part II explores the value that recognition of the full public performance right under the WPPT would create for the American music industry. Finally, Part III proposes a solution in the form of an amendment to the Copyright Act and the coordination of national and international performance rights organizations.

The Downhill Battle To Copyright Sonic Ideas In Bridgeport Music, Matthew S. Garnett Jan 2005

The Downhill Battle To Copyright Sonic Ideas In Bridgeport Music, Matthew S. Garnett

Vanderbilt Journal of Entertainment & Technology Law

This Note argues that the bright-line rule announced in Bridgeport Music should not apply where the disputed digital sample appropriates only the "sonic" ideas of the original work. The main thrust of this argument is that the Sixth Circuit's holding in Bridgeport Music is inapplicable where the disputed copying is a protected exercise of "fair use" reverse engineering; that is, where copying is necessary to appropriate the "sonic" ideas embodied in the sampled work.

Part II of this Note presents a brief history of digital sampling, including its application in the Hip-Hop musical genre. Part III presents a walkthrough of …

Protecting The Future: A Strategy For Creating Laws Not Constrained By Technological Obsolescence, Jay Campbell Jan 2005

Protecting The Future: A Strategy For Creating Laws Not Constrained By Technological Obsolescence, Jay Campbell

Vanderbilt Journal of Entertainment & Technology Law

This note will examine the obsolescence of laws through the lens of recent cases relating to "wiretapping laws" and propose the creation of laws that protect certain rights independent of technology. Recently, a number of courts have held that laws created in the mid-1980's to protect communications do not apply to Internet-related communications, reasoning that the method of transmission falls outside the language of the statutes. As a result, e-mail and other forms of Internet-based communications are treated differently from older forms of communication such as telephone conversations. This note will propose a broad legislative solution with the aim of …

Scylla Or Charybdis: Navigating The Jurisprudence Of Visual Clutter, M. Ryan Calo Jan 2005

Scylla Or Charybdis: Navigating The Jurisprudence Of Visual Clutter, M. Ryan Calo

Michigan Law Review

This Note argues that passing close to Discovery Network is the safest route - municipalities can still drastically reduce visual clutter by regulating commercial speech alone without violating the First Amendment. Part I looks at the onsite/offsite distinction, a singularly popular method of sign regulation, and concludes that this distinction runs squarely afoul of Metromedia. Part II looks at the once-accepted alternative route - the commercial/noncommercial distinction - and argues that this distinction does not run afoul of Discovery Network. Rather, a close reading of Discovery Network permits the regulation of exclusively commercial billboards where, as typically, they …

Leveling The Playing Field: A New Theory Of Exclusion For A Post-Patriot Act America, Christian Halliburton Jan 2005

Leveling The Playing Field: A New Theory Of Exclusion For A Post-Patriot Act America, Christian Halliburton

Faculty Articles

This article takes the position that, although the PATRIOT Act is superficially unrelated to the specifics of the exclusionary rule, such a drastic departure from constitutional norms would not have been possible had the Court not conditioned the Fourth Amendment exclusionary rule's operation on pursuit of the inherently unstable target of institutional deterrence. Part I of this article will trace the development of the Fourth Amendment's exclusionary rule from its origins in federal court through its incorporation against the states, paying particular attention to the underlying purpose of the exclusionary rule as announced by the Court, and concluding with a …

The Case Of The Little Yellow Cuban Biplane: Can Interest Analysis Reconcile Conflicting Provisions In Federal Statutes And International Treaties?, Diane Lourdes Dick Jan 2005

The Case Of The Little Yellow Cuban Biplane: Can Interest Analysis Reconcile Conflicting Provisions In Federal Statutes And International Treaties?, Diane Lourdes Dick

Faculty Articles

This article analyzes conflicts that arise under international agreements that define and protect foreign ownership interests in civil aircraft, on the one hand, and domestic laws that allow Americans to bring suit against state sponsors of terrorism, on the other hand. Finding that courts often perform concealed interest analyses under the guise of mechanical application of canons of construction, this article recommends a comparative impairment interest analysis approach to resolving this and related conflicts.

Evaluating Brady Error Using Narrative Theory: A Proposal For Reform, John B. Mitchell Jan 2005

Evaluating Brady Error Using Narrative Theory: A Proposal For Reform, John B. Mitchell

Faculty Articles

When the United States Supreme Court granted certiorari in Old Chief v. United States, the Court examined Federal Rule of Evidence 403 in light of a defense offer to stipulate to aspects of the proffered prosecution evidence, purportedly to lessen their prejudicial impact. At the core of the opinion rests the validation of a theory born from such disparate fields as Law and Literature, Sociology, and Narrative Theory. This article argues that, though it was not on the proverbial radar screen of the Court when it decided Old Chief, narrative theory provides the most effective tool available for assessing prejudice …

Screening The Law: Ideology And Law In American Popular Culture, Mark Niles, Naomi Mezey Jan 2005

Screening The Law: Ideology And Law In American Popular Culture, Mark Niles, Naomi Mezey

Faculty Articles

This paper reevaluates Frankfurt School theory, and other cultural critiques, in an effort to bring a more sophisticated analysis to bear on popular culture depictions of law. It invokes the cultural critiques of the Birmingham School in order to assess the more subtle ideological content more often found in film. The focus is not only on how popular culture functions as a mechanism for communicating and reproducing ideologies, but also what this function is based on, a theoretical analysis that asks what images of law and legal justice one might expect to see in popular media. The article also assesses …

Toward Reconciliation In The Middle East: A Framework For Christian-Muslim Dialogue Using Natural Law Tradition, Russell Powell Jan 2005

Toward Reconciliation In The Middle East: A Framework For Christian-Muslim Dialogue Using Natural Law Tradition, Russell Powell

Faculty Articles

In this paper, Professor Powell argues that the thinking of Bernard Lonergan in light of the natural law insights of St. Thomas Aquinas, Ali Ezzati and Abdullahi Ahmed An-Na'im provides a framework for Christian-Muslim dialogue. Lonergan's transcendental method moves from the individual subject to universal insights rather than presuming to deduce universals a priori, without regard for history, culture and individual experience. Professor Powell asserts that the most fruitful starting place for meaningful dialogue is to address questions of human rights and social justice using natural law theory, rather than focusing on theological concerns. If Muslims and Christians mutually acknowledge …

Best Practices And Web Practices: Comparing Corporate Supplier Diversity Programs With Web-Based Minority Supplier Content, Dale Young Jan 2005

Best Practices And Web Practices: Comparing Corporate Supplier Diversity Programs With Web-Based Minority Supplier Content, Dale Young

Journal of International Technology and Information Management

The growing use of the Web for business-to-business transactions means corporate Web sites could be used to communicate with diverse suppliers. This study compares the Web-based supplier diversity content on Fortune 500 public sites with the content of off-line minority supplier programs. Web sites are underused for communicating with diverse suppliers, as the content appears on only 12.5% of the sites. They emphasize information publishing because the most common Web-based supplier diversity items are contact information, such as a title and name, and third-party certification. Web-based supplier diversity content, however, is very similar to off-line diversity program content.

Impacts Of B2c E-Commerce On Hospital Productivity: An Empirical Study, Shin-Yuan Hung, Hsin-Min Hung, Mu-Yi Huang

Journal of International Technology and Information Management

This work conducted a comprehensive study of Business-to-Consumer Electronic Commerce (B2C e-Commerce) applications in Taiwanese hospitals. To further assess the impacts of B2C e-Commerce on hospital productivity, this study also employed three quantitative methods to analyze historical data. The results confirm those of broader research into applications of B2C e-Commerce to hospitals. Additionally, the results of the quantitative analysis demonstrate that B2C e-Commerce significantly impacts the hospital productivity.

Features Of Born-Global Processing Plants Under The Global Economy, Helen G. Zhao, Vistor H.Y. Lo, Domenic Sculli Jan 2005

Features Of Born-Global Processing Plants Under The Global Economy, Helen G. Zhao, Vistor H.Y. Lo, Domenic Sculli

Journal of International Technology and Information Management

A Born-Global Processing Plant (BGPP) is the formation of a new manufacturing plant specifically for the world-wide outsourcing industry and is a unique product of the global economy. The concept of a Born-Global entity has been mainly associated with high-tech industries and high-tech products. In this paper we extend the term BGPP to cover the concept of Born-Global to mature/low-tech and labor intensive processing plants that produce many of the traditional manufactured products. Such processing plants form the backbone of Southern China’s economic development. The conventional view regards a BGPP as playing a minor role in a traditional multinational enterprise …

A Model Regime Of Privacy Protection (Version 2.0), Daniel J. Solove, Chris Jay Hoofnagle Jan 2005

A Model Regime Of Privacy Protection (Version 2.0), Daniel J. Solove, Chris Jay Hoofnagle

GW Law Faculty Publications & Other Works

This version incorporates and responds to the many comments that we received to Version 1.1, which we released on March 10, 2005.

Privacy protection in the United States has often been criticized, but critics have too infrequently suggested specific proposals for reform. Recently, there has been significant legislative interest at both the federal and state levels in addressing the privacy of personal information. This was sparked when ChoicePoint, one of the largest data brokers in the United States with records on almost every adult American citizen, sold data on about 145,000 people to fraudulent businesses set up by identity thieves. …

The Impact Of The Sarbanes-Oxley Act Of 2002 On The Auditing Profession, Samantha Marie Rayburn Jan 2005

The Impact Of The Sarbanes-Oxley Act Of 2002 On The Auditing Profession, Samantha Marie Rayburn

Honors Theses

The Sarbanes-Oxley Act of 2002 was passed in order to restore investor confidence to the market after a series of accounting fiascos. Congress included in this act legislation creating the Public Company Accounting Oversight Board to monitor audits conducted on publicly traded companies and made many provisions concerning auditor independence. However, the most controversial part of the legislation was Section 404 which requires an audit of internal controls. The intent of this study was to determine how Sarbanes-Oxley will impact the auditing profession. This was determined through an intense review of the most current articles available on the subject. It …
