Tangled Up In Khaki And Blue: Lethal And Non-Lethal Weapons In Recent Confrontations, David A. Koplow

Too often, military and law enforcement authorities have found themselves constrained by inadequate weaponry: the tools available to them, in addressing confrontations with entrenched opponents of various sorts, are either too weak (not sufficing to disarm or defeat the enemy) or too strong (generating unacceptable "collateral damage" in harming innocent people or property). An emerging category of "non-lethal weapons" carries promise for resolving this dilemma, proffering deft new capabilities for disabling, dissuading, or defeating opponents without inflicting death or permanent injury.

Private property is a necessary but insufficient tool for environmental regulation. Why is it necessary? There are several reasons. First, it settles who controls a resource, making rational management possible. While this may sound trivial, countries with weak or fragmented systems of ownership--or where enforcement of law is tainted by corruption--find it impossible even to begin to preserve resources or prevent pollution. This is especially the case when different individuals make conflicting claims to the same plot of land.

What made the Second Bill of Rights possible? Part of the answer lies in a simple idea, one pervasive in the American legal culture during Roosevelt's time: No one really opposes government intervention. Markets and wealth depend on government. Without government creating and protecting property rights, property itself cannot exist. Even the people who most loudly denounce government interference depend on it every day. Their own rights do not come from minimizing government but are a product of government. It has long been recognized that there is a major correlation between smell and memory. Until recently, commercialized multi-sensory experiences involving olfaction were limited to non-computerized mediums. Companies that manufacture computerized scent technologies tout the educational benefits of their product, yet prior to this study, there appeared to be no scholarly research in regard to the efficacy of computerized scent producing peripherals in educational environments. (First paragraph) In elementary school my favorite teachers taught me that the language used in my home was incorrect, incoherent, and inappropriate. My second grade teacher Ms. Hull, a tall, thin, dark-skinned woman, stands out among the others. I can still see her hovering over us. “Was!” Ms. Hull shouted, “not wuz. Spotted Sea Trout (Cynoscion Nebulosus) And Pinfish (Lagodon Rhomboides) Dietary Analysis According To Habitat Type, Micah Russell

The diets of a transitory fish (spotted sea trout, Cynoscion nebulosus) and a fish with presumed greater site-fidelity (pinfish, Lagodon rhomboides) were analyzed with respect to habitat. Sampling occurred in Barataria Bay, Louisiana between May 2003 and May 2004. Spotted sea trout were caught using gillnets, and pinfish were caught using baited fish traps. Each gear was used on three habitats: mud bottom, oyster shell, and marsh edge. In addition, sampling for spotted sea trout was repeated at three locations along a salinity gradient. A total of 175 spotted sea trout stomachs and 137 pinfish stomachs were examined. Seventeen prey …

Most investigations that examine diffusion of disease through urban areas give relatively scant attention to the 'micro-environment.' Employing the many methods of macro-environmental analysis, most studies do not attempt to identify street-level or even residence-level temporal-spatial patterns of disease diffusion. As a result, the mechanisms that lead to diffusion on such small scales are left relatively undefined. There is no doubt that cumulatively these small-scale mechanisms contribute to the diffusion of disease over the urban environment. Studies have shown that weight concern is prevalent in children and that many children believe smoking can be used to control appetite and weight. However, little is known about the impact of the combination of these factors on smoking initiation in children. Initial research has indicated that weight concern predicts smoking initiation in adolescents, but these studies have not addressed the role of weight control outcome expectancies. The purpose of this study was to prospectively investigate the relationship between weight concern and smoking initiation, and to evaluate weight control outcome expectancies as a moderator of this relationship in children. The Supreme Court, Rule 10b-5, And The Federalization Of Corporate Law, Mark J. Loewenstein

This Article examines Supreme Court jurisprudence since 1997 under the federal securities laws in light of the Court's earlier securities law decisions and in light of its recent decisions construing the Constitution and federal statutes as they relate to the regulation of business. These post-1977 cases strongly suggest that the much-heralded new federalism philosophy of the Supreme Court is not a factor in securities law cases or in business cases generally. This Article critically analyzes the judicial decisions and reasoning of the United States Supreme Court and lower courts accepting certain defenses in securities fraud litigation. This Article develops how and why the core notions of materiality of information and the reasonable investor should be revised in light of recent empirical data, experimental evidence, and theoretical models of moody investing. This Article proposes modifying three recent developments in materiality doctrine to take into account moody investing. As American Indian nations revitalize their legal systems, there is renewed interest in "tribal law," that is, the law of each of the Indian nations. Today, there is a particular focus on the subject of "individual rights" under tribal law. The proliferation of free trade agreements (FTAs) in the last decade has resulted in an accompanying increase in dispute settlement regimes pertaining to those agreements. One obvious consequence is that increasingly, states are exposing themselves to such complaints, and not necessarily with the limitations that have been imposed on the at General Agreement on Tariffs and Trade (GATT)/World Trade Organization (WTO). The inherent ambiguity surrounding non-violation complaints at the WTO, and other risks relating to such complaints, are being multiplied manifold by these FTAs. This article assesses the current and likely impact of the Supreme Court's federalism cases on federal environmental regulation. As a result of this assessment, the article seeks to make four points: (1) Thus far, the Supreme Court's federalism cases have had a limited impact on federal regulation, as federal courts have not used these cases as a basis for limiting the reach of federal regulatory authority. (2) Notwithstanding this limited impact, the underlying logic of the Supreme Court's cases does pose a challenge for federal regulation, particularly in the Commerce Clause context. Abstract:

This paper examines the role of Cultural Studies in addressing the limitations of American visual culture through pedagogical interventions at Rochester Institute of Technology. Ray argues that despite globalization's potential to enhance international understanding, American visual media remains largely ethnocentric and resistant to representing the complex realities of global interconnectedness. Using the recent Iraq War as an example, he demonstrates how media coverage systematically obscured cultural, historical, and linguistic contexts while promoting martial nationalism. The author proposes using popular animated television programs like The Simpsons and South Park as pedagogical tools to expose the contradictory nature of contemporary media …
