A Public Interest Model For Applying Lost Chance Theory To Probabilistic Injuries In Employment Discrimination Cases, Paul M. Secunda

This article assesses Judge Posner's opinion in Doll v. Brown, suggesting that lost chance theory be applied to probabilistic injuries in competitive hiring and promotion cases involving employment discrimination. I agree with Judge Posner that the lost chance remedial approach, derived from medical malpractice law, has a proper role to play in determining just and equitable remedies in this employment discrimination context. But I argue for a public interest model to appropriately take into account the public interest emphasis of employment discrimination law. I argue that courts should utilize a modified version of lost chance theory to award punitive-like equitable …

Glycyrrhizin is a triterpenoid saponin found in Glychyrrhiza glabra (licorice). Chemically, glycyrrhizin is a sulphated polysaccharide. It is considered to the active constituent of the drug and the standardization of licorice is based on glycyrrhizin content. The standardized extracts of licorice sold in the market contain 20% of glychrrhizin. Glycyrrhizin is converted into glychyrrhetic acid by an enzyme, glycaronidase.

Diana Garner was a student at Ball State University in Muncie, Indiana when she began to write to soldiers stationed in Vietnam during 1968-1969. A friend encouraged her to place her name in the Sea Tiger, a magazine published by the military. Diana began receiving letters from the soldiers shortly after placing her address in the magazine. She continued to write to a few of the soldiers for some time but eventually lost contact with all of her soldier pen-pals. The objective of this thesis is to analyze an effective control scheme for a formation of spacecraft, implement that control, and provide a 3-D simulation. The thesis first summarizes the progress made in formation flight control schemes and then provides a theoretical framework for the control system design. Using established control design techniques, feedback laws are constructed to control both rotational and translational motion of a group of spacecraft. Computer simulations are carried out using Matlab to generate the ephemeris and attitude data, which are exported to Satellite Tool Kit (STK) to create animations. The process by which Matlab is …

The equivocal language of the 1982 Foreign Trade Antitrust Improvements Act ("FTAIA") has led to several disputes concerning when victims of international price-fixing can bring suit under U.S. antitrust law. Recently, the U.S. Supreme Court ruled in E Hoffmann-La Roche, Ltd. v. Empagran S.A. ("Empagran") that the doctrine of "comity among nations" limited the reach of U.S. anti-trust law over foreign plaintiffs who claim injury in nations where other competition regulations exist. A study was conducted to determine the effect of culling BVDV carrier animals on the seroconversion against BVDV in the new generation of heifers from a dairy herd located in Arequipa, Peru. Blood samples were collected from 6-12 month old females in four sampling periods: January (n = 73), June (n = 48), October 2003 (n = 48), and January 2004 (n = 35) to evaluate their serological against BVDV status and to screen for carrier animals using the virus neutralization and antigen-capture ELISA tests, respectively. A Further Consideration Of Galdosian Cultural Nicknames: Mythological, Legendary, And Historical Personages, Vernon A. Chamberlin

Galdós’s use of nicknames has been addressed both directly and indirectly in various studies,1 but much remains to be noted about how historical, legendary, and mythological personages served as source material for sobriquets to designate Galdosian characters. So important were these nicknames to Galdós’s artistry that he would sometimes change the apodo in the Alpha manuscript to a different one in the final printed version. Moreover, the history-based nicknames, which do so much to enliven Galdós’s novels and Episodios are a feature in common with other nineteenth-century novelists, most notably Alas, Pereda, and Pardo Bazán.

In 1898 the Spanish Empire experienced the final stage of its collapse when it lost the last of its colonies: Cuba, Puerto Rico, and the Philippines. A crisis within the Spanish nation ensued, prompting peripheral regions of the Iberian Peninsula to campaign actively for autonomy. Regionalist activists from Galicia, Valencia, the Basque provinces, Catalonia, and Andalusia interpreted the end of Spanish imperialism as Madrid's failure to let an empire of regional differences thrive—be they Cuban or Catalan. García Lorca’s earliest writings (1917–18) reveal his initial identification with Hispanic modernism, which first came into being in Catalonia.1 Catalan modernistes had introduced the word “modernist” in its contemporary acceptation into the languages of the Iberian Peninsula. L’Avenç, a Barcelonese journal and publishing house, first employed the adjective modernista in the sense of an attitude of approval towards innovation in all spheres of culture. This critical book review argues that James T. Patterson’s narrative in, "Brown v. Board of Education: A Civil Rights Milestone and Its Troubled Legacy," is a mostly balanced historical reflection. Here, the term balanced will refer to giving consideration to both the negative and positive aspects of the phenomenon in question. To advance its thesis, the book review initially offers an overview of Patterson’s historical narrative and evaluation of the Brown legacy. An increase in worldwide industrialized shark fisheries resulting from the growing demand for shark products, especially shark fins in Asian markets, as well as high levels of bycatch mortality associated with multi-species fisheries have raised suspicions of substantial declines in global shark populations. Due to varying responses by individual species to fishing pressure, it has become necessary to manage sharks on a species-specific basis, which requires the collection of more accurate catch and trade data.
