Mutual Wealth In Rural America, E. G. Nadeau, Elisabeth Howard

This essay contends that mutual wealth in rural America, particularly related to the use of land and other natural resources, has undergone three major paradigm shifts in the last 500 years, and may be at the threshold of a fourth. First, from the early 1500s to about 1800, European diseases and conquest destroyed the elaborate management systems for agriculture, forests, game, and other natural resources developed by North American Indians. Second, from the early 1500s to the early 1900s, European and white American settlers, induced by offers of land, repopulated the continent primarily with small and medium-sized farms and ranches. …

In 2004 courts in the Eleventh Circuit addressed several Clean Water Act issues. The Eleventh Circuit Court of Appeals arguably expanded the scope of the injuries a plaintiff may allege to have standing to sue under the Clean Water Act. The court held that the federal court had jurisdiction over a Clean Water Act citizen suit alleging violations of a permit issued by the State of Georgia under its permitting program authorized under the Act. The Eleventh Circuit also addressed whether a Florida state regulation effectively revised or added to the state's Clean Water Act, which mandated water quality standards, …

Many science fiction writers depend on the multiple narratives of the American West as templates for framing their understandings of the future. This essay examines the ways in which the western homesteading story has been adapted in fictions about future planetary settlement. It argues that the increasing complexity of these treatments reflects the deepening awareness of the ambiguities of the American homesteading experience and parallels many of the insights of the 'new western history.' States' and nations' laws collide when foreign factors appear in a lawsuit. Nonresident litigants, incidents outside the forum, parallel lawsuits, and judgments from other jurisdictions can create problems with personal jurisdiction, choice of law, and the recognition of foreign judgments. This article reviews Texas conflicts cases from Texas state and federal courts during the Survey period from October 1, 2003 through November 31, 2004. The article excludes cases involving federal-state conflicts; intrastate issues such as subject matter jurisdiction and venue; and conflicts in time, such as the applicability of prior or subsequent law within a state. The concept of place has usually been understood as either a phenomenological, epistemological, or ethical category. An understanding of place as aesthetic or rhetorical, on the other hand, tends to focus on the widely varied uses of the concept. First, I sketch out the wide range of uses of place, that have been drawn from writings on the concept. These uses are not definitions of place, but rather functions that the term performs. The Small Mammals Of Isle Of Wight County, Virginia, As Revealed By Pitfall Trapping, Robert K. Rose

In a study conducted in mid-winter, pitfall traps were used to assess the small mammal communities on 14 grids set in open habitats in Isle of Wight County in eastern Virginia. In all, 136 shrews of three species and 103 rodents of five species were trapped. Least shrews (n=110) comprised 46 percent of small mammals and 80 percent of shrews. Eastern harvest mice (n=62) were the most common rodents. Reproduction was detected only in pine voles and southern bog lemmings. The majority of small mammals of the region were trapped during this month-long study.

Effects Of Estradiol On Lipopolysaccharide And Pam3cys Stimulation Of Ccl20/Macrophage Inflammatory Protein 3 Alpha And Tumor Necrosis Factor Alpha Production By Uterine Epithelial Cells In Culture, Mardi A. Crane-Godreau, Charles R. Wira

We have previously demonstrated that rat uterine epithelial cells (UEC) produce CCL20/macrophage inflammatory protein 3 alpha (MIP3alpha) and tumor necrosis factor alpha (TNF-alpha) in response to live and heat-killed Escherichia coli and to the pathogen-associated molecular patterns (PAMP) lipopolysaccharide (LPS) and Pam3Cys. To determine whether estradiol (E2) modulates PAMP-induced CCL20/MIP3alpha and TNF-alpha secretion, primary cultures of rat UEC were incubated with E2 for 24 h and then treated with LPS or Pam3Cys or not treated for an additional 12 h. E2 inhibited the constitutive secretion of TNF-alpha and CCL20/MIP3alpha into culture media. Interestingly, E2 pretreatment enhanced CCL20/MIP3alpha secretion due to …

In this paper I argue that the goal of “democratizing technology” (as espoused by Feenberg, Winner, Sclove and others) must be linked to some kind of overarching norm or objective. That by itself, the apparently worthwhile aim of democratizing technological design is nebulous. [Is it the case that democratizing technology will necessarily lead to an overall improvement in the built environment? Obviously, this question raises a host of additional questions: How does one define “improvement”? Or, better for whom? Pyrosequencing is a new DNA sequencing method relying on the sequencing-bysynthesis principle and bioluminometric detection of nucleotide incorporation events. The objective of this thesis is to design a protocol for the improvement of the identification of fungi and mold samples in the outdoors and in enclosed environments. Fungi (mold) and bacteria are naturally present in both indoor and outdoor environments. Pyrosequencing method has been introduced as an alternative detection. Efforts are currently shifting from structural to functional genomics, in which the related functions of genomic sequences are being studied. Instead of ranking law schools through statistical aggregations of expert judgments, or by combining a list of heterogeneous factors, it would be possible to rely on a market test, simply by examining student choices. This tournament-type approach would have the large advantage of relying on the widely dispersed information that students actually have; it would also reduce reliance on factors that can be manipulated (and whose manipulation does no good other than to increase rankings). This study examined vocabulary teaching techniques. Its major purpose was to discover ways of teaching vocabulary to students that motivate them to use the words and allow them to understand and use these words appropriately. This study utilized a qualitative approach, examining instruction through the use of a case study. The study took place in an inclusive fifth grade classroom of twenty-five students. Sixteen of these students participated in the study. A checklist, student writing samples, and field notes were used to gather data surrounding varied forms of instruction and the ability of students to use newly learned words. Collected …

Feedback from the spinal locomotor networks provides rhythmic modulation of the membrane potential of reticulospinal (RS) neurons during locomotor activity. To further understand the origins of this rhythmic activity, the timings of the oscillations in spinobulbar (SB) neurons of the spinal cord and in RS neurons of the posterior and middle rhombencephalic reticular nuclei were measured using intracellular microelectrode recordings in the isolated brain stem-spinal cord preparation of the lamprey. A diffusion barrier constructed just caudal to the obex allowed induction of locomotor activity in the spinal cord by bath application of an excitatory amino acid to the spinal bath. …

Domestic Violence And The Danger Of Joint Custody Presumptions, Judith G. Greenberg

Northern Illinois University Law Review

This article points out that the current trend towards joint custody as the preference or presumption in divorces can create some unwanted side-effects. Specifically, joint custody is dangerous for victims of spousal abuse because it allows, and sometimes even facilitates, the continuation of patterns of abuse. Although many jurisdictions that apply a joint custody presumption attempt to protect victims of domestic violence, neither of the two usual approaches is successful in protecting the victims and their children. As a result, the author makes two recommendations. First, statutes should never create a presumption in favor of joint custody. Second, courts should …
