The optimal scope of patent protection is an issue with which patent system observers have struggled for decades. Various patent doctrines have been recognized as tools for creating specific patent scopes and, as a result, implementing specific patent theories. One area of patent law that has not been addressed in the discussion on patent scope and theories is patent claim interpretation. Does Choice Of Estimators Influence Conclusions From True Metabolizable Energy Feeding Trials?, Mark H. Sherfy, Roy L. Kirkpatrick, Kenneth E. Webb Jr.

True metabolizable energy (TME) is a measure of avian dietary quality that accounts for metabolic fecal and endogenous urinary energy losses (EL) of non-dietary origin. The TME is calculated using a bird fed the test diet and an estimate of EL derived from another bird (Paired Bird Correction), the same bird (Self Correction), or several other birds (Group Mean Correction). We evaluated precision of these estimators by using each to calculate TME of three seed diets in blue-winged teal (Anas discors). The TME varied by <2% among estimators for all three diets, and Self Correction produced the least variable TMEs for each. The TME did not differ between estimators in nine paired comparisons within diets, but variation between estimators within individual birds was sufficient to be of practical consequence. Although differences in precision among methods were slight, Self Correction required the lowest sample size to achieve a given precision. Feeding trial methods that minimize variation among individuals have several desirable properties, including higher precision of TME estimates and more rigorous experimental control. Consequently, we believe that Self Correction is most likely to accurately represent nutritional value of food items and should be considered the standard method for TME feeding trials.

The latency-associated transcript (LAT) is essential for the wild-type herpes simplex virus type 1 (HSV-1) high-reactivation phenotype since LAT- mutants have a low-reactivation phenotype. We previously reported that LAT can decrease apoptosis and proposed that this activity is involved in LAT’s ability to enhance the HSV-1 reactivation phenotype. The first 20% of the primary 8.3-kb LAT transcript is sufficient for enhancing the reactivation phenotype and for decreasing apoptosis, supporting this proposal. We studied a local population of mountain plovers (Charadrius montanus) in southern Phillips County, Montana, USA, from 1995 to 2000 to estimate annual rates of recruitment rate (f) and population change (λ). We used Pradel models, and we modeled λ as a constant across years, as a linear time trend, as year-specific, and with an additive effect of area occupied by prairie dogs (Cynomys ludovicianus). We modeled recruitment rate (f) as a function of area occupied by prairie dogs with the remaining model structure identical to the best model used to estimate λ. Our results indicated …

Investigations of coevolutionary relationships between plants and the animals that disperse their seeds suggest that disperser-plant interactions are likely shaped by diffuse, rather than species-to-species, coevolution. We studied the role of dietary plasticity in shaping the potential for diffuse coevolution by comparing dietary fruit preferences and seed dispersal by 3 species of spider monkeys (Ateles spp.) in 4 moist forests in Colombia, Ecuador, Panama, and Surinam. In all forests, spider monkeys were highly frugivorous and preyed upon seeds of few species. We estimated dietary use of fruiting taxa based on absolute consumption and preference, which accounts for resource availability. …

We tested the hypothesis that relatively symmetrical flies live longer. Vein measurements on the left and right wings from the same individual were used to characterize bilateral symmetry in relationship to age-specific survival in defined cohorts. A longitudinal cohort study supported the hypothesis of a correlation between bilateral symmetry and longevity. For another type of experiment, wings were removed from females and males at approximately the beginning of adult life. Thus, there would be no effect of wings per se on adult survival. The cytolethal distending toxin B (CdtB) of the mouse pathogen Helicobacter hepaticus has cation binding and DNA catalysis residues in common with members of the mammalian deoxyribonuclease I (DNase I) family. The purpose of the present study was to characterize CdtB nuclease. To establish optimal digestion conditions and to evaluate co-factor requirements, a novel and sensitive fl uorometric assay that quantitatively determines double stranded DNA digestion was developed. 1. We incorporated spatial data on swift foxes (Vulpes velox) with genetic analysis to assess the influence of relatedness between individuals on their social and spatial ecology. We recorded the space use patterns of 188 radio-collared swift foxes in southeastern Colorado from January 1997 to December 2000. One hundred and sixty-seven foxes were also genotyped at 11 microsatellite DNA loci and the degree of relatedness between individuals was estimated.

This is a brief summary of the 2003 Vincentian Leadership Conference’s purpose and proceedings. It was part of the Hay-Vincentian Leadership Project, whose mission statement is included. The conference gathered Vincentian scholars, leadership experts, and Vincentian service leaders to discuss bringing the Vincentian Family’s mission into the future. Although there are fewer vowed and ordained members, it seems likely that Vincentian service will continue through the lay members of the Family.

Nonlinear systems are known to exhibit widely differing steady-state behaviors based on small modifications to the control parameters within the equations. These small modifications may be the difference between a chaotic output and a periodic output. Many investigators choose to study the varying behaviors through varying forcing conditions, specifically the forcing amplitude or frequency. However, from a linear vibration theory standpoint, systems are often "tuned" to minimize system response to a known forcing input by varying the strength of the damping and stiffness elements within the system. Animation is a powerful medium that is accessible to few, because current animation tools are extremely complex. This complexity arises partially from current tools’ focus on precise, often unnecessary details and partially from the difficulty of finding a small but sufficiently powerful set of tool features.
