The Epistle To The Hebrews And Patron-Client Relationships: Toward A Missiological Appropriation, Cheryl D. Doss

Faculty Publications

Missionaries in cultures where patron-client relationships are common can find their participation in such relationships difficult. Recent New Testament scholarship has illuminated the patron-client relationships implicitly described in the epistle to the Hebrews. Utilizing this scholarship, this article explores the patron-client relationships illustrated in the epistle to the Hebrews seeking biblical principles to guide missionary life and practice.

Danish Anti-Americanism: A Socio-Cultural Perspective, Poul Houe Jan 2005

Danish Anti-Americanism: A Socio-Cultural Perspective, Poul Houe

The Bridge

In the spring of 2002, Granta, the distinguished "Magazine of New Writing," put out a special issue in which "twenty-four writers drawn from many countries" reflect on "What We Think of America." On the magazine's back cover, the occasion for their musings is presented as follows:

The September 11 attacks on the US provoked shock and pity in the rest of the world, but mingled with the sympathy was something harsher: anti-Americanism. It wasn't confined to the West Bank or Kabul. It could be heard in English country pubs, in the bars of Paris and Rome, the tea stalls of …

Rights, Performatives, And Promises In Karl Olivecrona’S Legal Theory, Martin P. Golding Jan 2005

Rights, Performatives, And Promises In Karl Olivecrona’S Legal Theory, Martin P. Golding

Faculty Scholarship

Karl Olivecrona (1971) maintains that "right" is a "hollow word," and so also for some other legal terms. "Right," he says, "has no conceptual background." He arrives at this position after an examination of metaphysical and naturalistic accounts, including American legal realism. Some of Olivecrona's arguments will be evaluated here. His position is influenced by Hagerstrom's theory of legal language, but he argues that Hagerstrom fails to account for how such terms as "right," "duty," etc. function in legal discourse and why they are useful. A parallel approach is also found in Olivecrona's book The Problem of the Monetary Unit …

Jaycees Reconsidered: Judge Richard S. Arnold And The Freedom Of Association, Richard W. Garnett Jan 2005

Jaycees Reconsidered: Judge Richard S. Arnold And The Freedom Of Association, Richard W. Garnett

Journal Articles

In Roberts v. United States Jaycees, the Supreme Court reversed Judge Richard S. Arnold's decision for the Court of Appeals and held - without dissent - that the First Amendment did not shield the Jaycees' men-only membership policy from the non-discrimination requirements of the Minnesota Human Rights Act. The claim in this essay is that Judge Arnold's position and decision in the Jaycees case deserved, and still deserve, more thoughtful and sympathetic treatment. Even some of Judge Arnold's many friends and fans tend to treat as something of an embarrassing lapse or anomalous error his conclusion in that case that, …

The (Surprising) Truth About Schiavo: A Defeat For The Cause Of Autonomy, O. Carter Snead Jan 2005

The (Surprising) Truth About Schiavo: A Defeat For The Cause Of Autonomy, O. Carter Snead

Journal Articles

A survey of the commentary following the conclusion of the Theresa Marie Schiavo matter leaves one with the impression that the case was a victory for the cause of autonomy and the right of self-determination in the end-of-life context. In this essay, I seek to challenge this thesis and demonstrate that, contrary to popular understanding, it is the defenders of autonomy and self-determination who should be most troubled by what transpired in the Schiavo case. In support of this claim, I will first set forth (in cursory fashion) the underlying aim of the defenders of autonomy in this context. Then, …

The Pedagogical Significance Of The Bush Stem Cell Policy: A Window Into Bioethical Regulation In The United States (President George W. Bush, Fifth Anniversary Essay Collection), O. Carter Snead

Journal Articles

The enormous significance of the Bush stem cell funding policy has been evident since its inception. The announcement of the policy on August 9, 2001 marked the first time a U.S. president had ever taken up a matter of bioethical import as the sole subject of a major national policy address. Indeed, the August 9th speech was the President's first nationally televised policy address of any kind. Since then, the policy has been a constant focus of attention and discussion by political commentators, the print and broadcast media, advocacy organizations, scientists, elected officials, and candidates for all levels of office …

Some Varieties And Vicissitudes Of Lochnerism, Barry Cushman Jan 2005

Some Varieties And Vicissitudes Of Lochnerism, Barry Cushman

Journal Articles

This article is a contribution to the Lochner Centennial Symposium at Boston University School of Law. Until recently, a consensus appeared to be emerging among constitutional historians concerning how best to interpret Lochner-era decisions involving Fifth and Fourteenth Amendment challenges to state and federal economic regulation. After decades during which the Court's jurisprudence had been characterized as the product of a reactionary judiciary's commitments to Social Darwinism and laissez-faire economics, more recent scholars had come to see the Court's police powers decisions as animated by what Professor Howard Gillman has called the principle of neutrality. On this view, the Court's …

Rights And The Need For Objective Moral Limits, Charles E. Rice Jan 2005

Rights And The Need For Objective Moral Limits, Charles E. Rice

Journal Articles

In this article, we will examine the natural law conception that rights are rooted in human nature, which nature itself is of divine origin through creation. We will compare this natural law concept to the premises and social consequences of the secular, relativist, and individualist approaches common to the jurisprudence of the Enlightenment. This article will offer the conclusion that only a grounding of right in the nature of persons as immortal beings created by God can offer moral and cultural security against the depersonalization characteristic of regimes premised on a relativist individualism.

In Search Of A Theory For Constitutional Comparativism, Roger P. Alford Jan 2005

In Search Of A Theory For Constitutional Comparativism, Roger P. Alford

Journal Articles

Constitutional comparativism - the notion that international and foreign material should be used to interpret the U.S. Constitution - is gaining currency. Yet proponents of this practice rarely offer a firm theoretical justification for the practice. This Article contends that constitutional comparativism should be examined from the perspective of constitutional theory. The use of comparative and international material must be deemed appropriate or inappropriate based on a particular judge's interpretive mode of constitutional analysis. The Article presents four classic constitutional theories - originalism, natural law, majoritarianism, and pragmatism - and addresses the propriety of constitutional comparativism under each theory. This …

The Spiritual Values Of Wilderness, John Copeland Nagle Jan 2005

The Spiritual Values Of Wilderness, John Copeland Nagle

Journal Articles

The Wilderness Act of 1964 is the principal legal mechanism for preserving wilderness in the United States. The law now protects over 100 million acres of federal land, half of which is in Alaska. Yet the contested meaning of the term wilderness continues to affect the management of those wilderness areas, and the designation of additional lands as wilderness areas. Much current thinking about wilderness emphasizes the ecological and recreational interests that Congress cited when it enacted the law. These justifications for wilderness preservation are important, but they are incomplete. They are best supplemented by a better understanding of the …

An Idea Whose Time Has Come – But Where Will It Go, Jane C. Ginsburg Jan 2005

An Idea Whose Time Has Come – But Where Will It Go, Jane C. Ginsburg

Faculty Scholarship

This Reply picks up where Professor Miller's bold proposal leaves off: with the private international law and international copyright implications of state common law protection for idea-submitters. We will first address the compatibility of the proposal with international copyright norms disqualifying ideas from copyright protection. We will then turn to the consequences of the proposal for a federal system. Professor Miller's article thoroughly examines one aspect of the federalism problem, that of federal copyright policy preemption of statebased idea protection. But in advocating a regime constricted to the fifty separate states, not all of whose courts choose to secure idea …

The Emergence And Decline Of The Delaware Indian Nation In Western Pennsylvania And The Ohio Country, 1730--1795, Richard S. Grimes Jan 2005

The Emergence And Decline Of The Delaware Indian Nation In Western Pennsylvania And The Ohio Country, 1730--1795, Richard S. Grimes

Graduate Theses, Dissertations, and Problem Reports (ETD)

Many past and current generations of historians, anthropologists, and literary writers have acknowledged the existence of a Delaware Indian nation. They, however, have failed to thoroughly understand or address the historical and cultural dynamics that contributed to both the formation and quick decline of this Indian nation. This multidisciplinary study includes the oral traditions and oratory of Delaware Indians, the observances of Moravian missionaries and colonial-revolutionary officials, and contemporary anthropological and historical sources, to construct the building of the Delaware nation during the eighteenth century.;Once decentralized and living in the Delaware River watershed, three phratries or animal tribes (Turtle, Turkey, …

Role Of The Host Cell In The Type Iii Translocation Of Pseudomonas Aeruginosa Exoenzyme S, Elizabeth A. Rucks Jan 2005

Role Of The Host Cell In The Type Iii Translocation Of Pseudomonas Aeruginosa Exoenzyme S, Elizabeth A. Rucks

Graduate Theses, Dissertations, and Problem Reports (ETD)

Exoenzyme S (ExoS) is a bifunctional toxin that is directly translocated into eukaryotic cells by the Pseudomonas aeruginosa (Pa) type III secretory (T3S) process. The N-terminal region of ExoS includes a GTPase activating protein (GAP) activity and the C-terminal region includes an ADP-ribosyltransferase (ADPRT) activity. The T3S-translocation (T3S-T) of ExoS allows the bacteria to directly manipulate host cell function, thereby contributing the virulence of Pa. A cell culture model of infection was developed to study the effects of ExoS on cell function, which differentiates the effects of ExoS expression from other bacterial effects. Previous studies found that ExoS inactivates cell …

Determination Of Rx Expression In The Adult Mouse Retina And Delineation Of The Rx Mediated Gene Regulation, Supriya A. Shah Jan 2005

Determination Of Rx Expression In The Adult Mouse Retina And Delineation Of The Rx Mediated Gene Regulation, Supriya A. Shah

Graduate Theses, Dissertations, and Problem Reports (ETD)

The Retinal homeobox gene, Rx, is expressed in the anterior neural plate and the optic vesicle shows Rx expression throughout development. Rx is required for the proliferation of retinal progenitor cells during eye development.;Our expression studies of the Rx gene in the adult mouse retina show Rx expression in the Photoreceptor and inner nuclear layer of the adult neural retina and ciliarybody. The cotransfection assays indicate that Rx supports the transcription of neural retinal markers, as well as the RPE-markers. Therefore we characterize Rx as a proliferation marker for the entire optic vesicle region.;To determine the mechanism of Rx-mediated regulation …

Property, Michael A. Heller Jan 2005

Property, Michael A. Heller

Faculty Scholarship

This article argues that despite its seeming disintegration, property is more vibrant than ever — it is a field that has focused on understanding the formal and informal institutions by which society channels decision-making for scarce resources. Many exciting recent innovations in property theory have arisen through dialogue between US and Commonwealth scholars and legislatures. The article is organized as follows. The first part explains the focus on analytic property theory, which is posed in distinction to a jurisprudential approach. The second part introduces the familiar division of ownership into a trilogy of ideal types: private, commons, and state. The …

Legal Socialization Of Children And Adolescents, Jeffrey Fagan, Tom Tyler Jan 2005

Legal Socialization Of Children And Adolescents, Jeffrey Fagan, Tom Tyler

Faculty Scholarship

Research on children and the law has recently renewed its focus on the development of children's ties to law and legal actors. We identify the developmental process through which these relations develop as legal socialization, a process that unfolds during childhood and adolescence as part of a vector of developmental capital that promotes compliance with the law and cooperation with legal actors. In this paper, we show that ties to the law and perceptions of law and legal actors among children and adolescents change over time and age. We show that neighborhood contexts and experiences with legal actors shape the …
