Property concerns conflicts – both conflicts between individuals and conflicts of interest. Conflicts between individuals have long been the paradigmatic property focus. According to this view, property debates circle around issues of autonomy and productive competition. But this is an impoverished view. In this Article, we shift attention to conflicts of interest. By helping people manage conflicts of interest, a well-governed property system balances interdependence with autonomy and productive cooperation with productive competition. We identify three mechanisms woven throughout property law that help manage conflicts of interest: (1) internalization of externalities; (2) democratization of management; and (3) de-escalation of transactions. …

We live in a time when our right to speak out against our government faces threats unimagined since the Vietnam era. As the present war in Iraq and the campaign against international terrorism have dragged on, the federal and state governments as well as nongovernmental institutions have grown increasingly bold in their efforts to suppress political dissent. Law enforcement officers infiltrate and bully peaceful dissident groups; police crack down brutally on mass demonstrations; cities confine protesters at major political events to ironically designated “free speech zones.” These events buttress a contention, familiar from the work of several prominent First Amendment …

Undue Hardship In The Bankruptcy Courts: An Empirical Assessment Of The Discharge Of Educational Debt, Rafael I. Pardo, Michelle R. Lacey

The discharge in bankruptcy embodies the policy that relief should be granted to an individual who has ceased to be economically productive by virtue of burdensome debt obligations (the fresh start policy). Once the debtor has been deemed eligible for discharge, forgiveness of debt is automatic, accomplished through legislative rule and its judicial enforcement. With regard to the discharge of educational debt, however, Congress has devolved the exercise of debt relief to courts. An obligation to repay such debt will be discharged if a debtor establishes that undue hardship would be suffered in the absence of its discharge. A court …

Background: In the present study we tested the hypothesis that progression of streptozotocin (STZ)-induced diabetes (14-days to 28-days) would produce renal and vascular dysfunction that correlate with altered p38- mitogen-activated protein kinase (p38-MAPK) phosphorylation in kidneys and thoracic aorta. Methods: Male Sprague Dawley rats (350-400 g) were randomized into three groups: sham (N = 6), 14-days diabetic (N = 6) and 28-days diabetic rats (N = 6). Diabetes was induced using a single tail vein injection of STZ (60 mg/kg, I.V.) on the first day. Rats were monitored for 28 days and food, water intake and plasma glucose levels were …

Massive amounts of data are being generated in an effort to represent for the brain the expression of all genes at cellular resolution. Critical to exploiting this effort is the ability to place these data into a common frame of reference. Here we have developed a computational method for annotating gene expression patterns in the context of a digital atlas to facilitate custom user queries and comparisons of this type of data. This procedure has been applied to 200 genes in the postnatal mouse brain. As an illustration of utility, we identify candidate genes that may be related to Parkinson …

In 2004 courts in the Eleventh Circuit addressed several Clean Water Act issues. The Eleventh Circuit Court of Appeals arguably expanded the scope of the injuries a plaintiff may allege to have standing to sue under the Clean Water Act. The court held that the federal court had jurisdiction over a Clean Water Act citizen suit alleging violations of a permit issued by the State of Georgia under its permitting program authorized under the Act. The Eleventh Circuit also addressed whether a Florida state regulation effectively revised or added to the state's Clean Water Act, which mandated water quality standards, …

The effect of growth regulators gibberellic acid (Pro-Gibb™), daminozide (B-Nine™), ancymidol (A-Rest™) and paclobutrazol (Bonzi™) were evaluated on species of Clerodendrum grown as flowering pot plants. Studies on photoperiod and post-production longevity were also included. Experiments were conducted on C. bungei, C. thomsoniae, C. ugandense, C. phillippinum, C. paniculata and C. speciosissimum in polycarbonate greenhouses. For C. thomsoniae the best growth control was achieved by applying paclobutrazol and ancymidol drench at a rate of 1.0 mg a.i. /pot. For C. ugandense, the most appropriate application rate of PGR was paclobutrazol drench at 5 to 15 mg a.i./pot. C. bungei did …

Seasonal Space Use, Habitat Preference And Survival Of Female Wild Turkeys In A Louisiana Bottomland Hardwood Forest, Walker Blake Wilson

Female wild turkeys (Meleagris gallopavo) were captured and radio-marked in a bottomland hardwood forest in south-central Louisiana. Turkeys were monitored using radio telemetry from fixed points on Sherburne Wildlife Management Area, Atchafalaya National Wildlife Refuge, and Bayou des Ourses to observe seasonal patterns of space use, habitat preference and survival from 2002-04. The largest mean seasonal home range of 902.87 ha occurred during preincubation (15 Feb – 9 Apr; n = 24) when females typically search for suitable nest sites, and the smallest mean seasonal home range was 434.12 ha, during brood-rearing (1 Jun – 30 Sep; n = 32) …

North Carolina law authorizes citizen standing for the enforcement of anti-cruelty laws, thus supplementing criminal prosecution by means not used in any other state. Citizens, cities, counties and animal welfare organizations can enforce animal cruelty laws through a civil injunction. This article explores the various amendments to North Carolina's civil enforcement legislation and the present law's strengths and weaknesses. The author suggests an ideal model anti-cruelty civil remedies statute.

ERFs (ethylene-responsive element binding factors) belong to a large family of transcription factors that are found exclusively in plants. A small subfamily of ERF proteins can act as transcriptional repressors. The Arabidopsis genome contains eight ERF repressors, namely AtERF3, AtERF4, AtERF7, AtERF8, AtERF9, AtERF10, AtERF11, and AtERF12. The different ERF repressors show differential expression, suggesting that they may have different function. The expression of AtERF4 can be induced by ethylene, jasmonic acid, or abscisic acid. AtERF7 can be induced by abscisic acid only. Using a transient expression system, we demonstrated that AtERF4 and AtERF7 can function as transcriptional repressors. By …

When Congress banned the immigration of Chinese prostitutes with the Page Law of 1875, it was the first restrictive federal immigration statute. Yet most scholarship treats the passage of the Page Law as a relatively unimportant event, viewing the later Chinese Exclusion Act as the crucial landmark in the federalization of immigration law. This Article argues that the Page Law was not a minor statute targeting a narrow class of criminals, but rather an attempt to prevent Chinese women in general from immigrating to the United States. A computational cognitive neuroscience approach was used to examine processes of visual attention in the human and monkey brain. The aim of the work was to produce a biologically plausible neurodynamical model of both spatial and object-based attention that accounted for observations in monkey visual areas V4, inferior temporal cortex (IT) and the lateral intraparietal area (LIP), and was able to produce search scan path behaviour similar to that observed in humans and monkeys. BACKGROUND: Two-photon-excitation fluorescence lifetime imaging (2P-FLIM) was used to investigate the association of protein kinase C alpha (PKCalpha) with caveolin in CHO cells. PKCalpha is found widely in the cytoplasm and nucleus in most cells. Upon activation, as a result of increased intracellular Ca2+ and production of DAG, through G-protein coupled-phospholipase C signalling, PKC translocates to a variety of regions in the cell where it phosphorylates and interacts with many signalling pathways. Due to its wide distribution, discerning a particular interaction from others within the cell is extremely difficult. Transactions of the Nebraska Academy of Sciences and Affiliated Societies

During the 1997-98 fall hunting season, samples from 154 Wild Turkeys were donated by hunters to the Nebraska Game and Parks Commission (NGPC) Genetic and Forensic Laboratory. Assistance was provided by the Veterinary Diagnostic Center, and the Harold W. Manter Laboratory of Parasitology, University of Nebraska, Lincoln, for this survey of infectious diseases and internal parasites. One hundred and thirteen sinus swabs were cultured for pathogenic bacteria, and fecal samples were examined for parasite ova and protozoa. One hundred and six gastrointestinal samples were examined for helminth parasites. Intestinal coccidiosis was present in 42 birds. Salmonella was isolated from fecal …

Whether or not chimpanzees have the ability to mentally represent others' mental states or theory of mind (ToM) has yet to be definitively established. This results from three problems. First, modular theory of mind accounts lead researchers to adopt an either/or approach to psychological faculties which obfuscates both within- and across-species variability. Second, present research continues to rely on the continued trend to polarize nature and nurture. Third, the bulk of the work compares humans with chimpanzees rather than looking at the entire range of primate species. This thesis involves development of a computer-aided diagnosis (CAD) tool for the detection of cancerous nodules in X-ray images. Both cancerous and non-cancerous regions appear with little distinction on an X-ray image. For accurate detection of cancerous nodules, we need to differentiate the cancerous nodules from the non-cancerous. We developed an artificial neural network to differentiate them. Artificial neural networks (ANN) find a large application in the area of medical imaging. They work in a manner rather similar to the brain and have good decision making criteria when trained appropriately. We trained the neural network by the backpropagation algorithm and …

The murine pathogen Helicobacter hepaticus has important confounding effects on research. Neonatal fostering has been studied in our laboratory for elimination of infection in mice. The purpose of our study was to examine fostering of pups from experimentally infected dams in male-absent parturition, and to determine the significance of gender and time on quantity of bacterial colonization in the cecum and feces of C57BL/6 mice. Approximately 20 C57BL/6 mice were fostered per day from one to four days of age. None of the C57BL/6 pups tested positive by PCR in fecal or cecal samples through four days of age. This …
