This article deals with the application of Community competition law to sports rights acquisition markets in the light of their close relationship with retail television. Analysed is their impact on the development of Community competition law, and especially the fact that they illustrate the necessity to re-evaluate some of its fundamental concepts, as well as to expand the scope of this analysis to incorporate new economic models. Ochrona Konkurencji A Prokonkurencyjna Regulacja Sektorowa, Tadeusz Skoczny

The article discusses the two main pro-competitive functions of public intervention into market economy, that is 'competition protection' and 'pro-competitive sector-specific regulation'. It aims in particular to illustrate the basic differences between these two functions. Competition protection is defined here as an intervention directed at the protection of existing competition. It has an ex post (re-active) and individually penalising character. On the other hand, pro-competitive sector-specific regulation is understood as intervention supporting the development of competition. It has an ex ante (pro-active), prescriptive and non-transitory character. The text also shows the fact that the fulfilment of both functions is entrusted …

This communiqué relates to the Decision of the European Commission of 24 March 2004 in Case Microsoft. In the Decision, the Commission concluded that Microsoft Corporation broke EC competition law by leveraging its near monopoly on the market of PC operating systems onto the markets of work group server operating systems and of media players. The Commission ordered Microsoft to disclose to competitors the interfaces required for their products to be interoperable with Windows. Microsoft is also required to offer to PC manufacturers a version of its Windows without Windows Media Player. Microsoft was fined € 497 million.

The sector of legal services (including liberal professions) has a significant role in contemporary EU communities and economies. Legal services are subject to broad and specific regulation in Member States. There is no regulation on liberal professions at this stage of European Law. The Institute for Advanced Studies in Vienna (on demand of European Commission) has prepared a report on regulation in the field of liberal professions in Member States. The article presents basic assumptions, structure and principles of telecommunications markets regulation in the light of EU directives on electronic communications. Discussed are the pro-competitive regulatory activities of the state authorities as one of the public functions in the economy, the status of the regulatory authorities, the principles and aims of the regulatory activity. Following the liberalisation of network industries, rapid development of regulatory bodies may be treated as a paradox if we take into account the fact that deep criticism of this form of regulation in US paved the way for market-oriented reforms in these industries. The author reviews the main lines of theoretical and empirical arguments against US institutionalised regulation, and then shows the key role of regulation in the liberalisation of these kinds of industries. The starting point for this text is the assumption that regulation of the mass media sector is a political problem and, therefore, a democratic debate is an indispensable prerequisite for settling it. The analysis of stakeholders' interests in this sector is conducted in order to answer the question formulated in the text's title. Next, two theories (the agenda-setting theory, the framing effect theory) are presented with the intention of explaining how the media outlets influence public debate on mass media sector regulation. The regulation of access to essential facilities in network industries should first of all introduce competition in downstream markets. Thus, the main objectives of the regulation are: creation of competition, consumer protection, and fulfilment of national and social objectives. The European Commission has based the access regulation regime on the antitrust essential facilities doctrine and has developed the access rules to essential facilities according to non-discriminatory, transparent and reasonably priced terms.

African American, Latino and other minority children are at risk of being overrepresented in special education classes because of a shortage of culturally knowledgeable and bilingual professionals in speech-language pathology.
A new grant awarded to the College of Health Professions at Governors State University will help change that.
The $788,592 personnel preparation grant from the U.S. Department of Education’s Office of Special Education and Rehabilitative Services will assist bilingual and culturally competent minorities who are earning their Master’s in Communication Disorders degree through Governors State.
