Private Law And Public Stakes In European Integration: The Case Of Property, Daniela Caruso Nov 2004

Private Law And Public Stakes In European Integration: The Case Of Property, Daniela Caruso

Faculty Scholarship

In European legal discourse, the old public/private divide is experiencing a revival and a transformation. Member States used to claim autonomy in private law matters. Now private law is subsumed into a functionalist logic and can presumptively be harmonised if so demanded by the goal of market integration. States or local constituencies can only resist harmonisation by highlighting the connection between their private laws and those ‘public’ matters still immune from Europeanisation. Property law can effectively illustrate this phenomenon. The written pledge of non-interference with States’ property systems, restated both in the TEC and in the draft Constitution, cannot be …

Why Do Plaintiffs Sue Private Parties Under Section 1983, Jack M. Beermann Nov 2004

Why Do Plaintiffs Sue Private Parties Under Section 1983, Jack M. Beermann

Faculty Scholarship

The subject of this article is why people make federal cases, under section 1983,' out of claims they have against private parties. Section 1983 provides a cause of action against "any person" who, while acting "under color of' state law, subjects or causes the plaintiff to be subjected to a violation of federal constitutional or statutory rights. The requirement that the defendant act under color of law means that the typical section 1983 claim is brought against state and local government officials or entities, not against private individuals or entities. However, there are situations in which a private party (i.e. …

Thymosin Alpha 1 In Combination With Interferon Alpha And Ribavirin In Chronic Hepatitis C Patients Who Are Non-Responders Or Relapsers To Interferon Alpha Plus Ribavirin, Z Abbas, S S. Hamid, S Tabassum, W Jafri Nov 2004

Thymosin Alpha 1 In Combination With Interferon Alpha And Ribavirin In Chronic Hepatitis C Patients Who Are Non-Responders Or Relapsers To Interferon Alpha Plus Ribavirin, Z Abbas, S S. Hamid, S Tabassum, W Jafri

Section of Gastroenterology

Objective: Interferon alpha (IFN-alpha) with or without ribavirin is an approved therapy for patients with chronic hepatitis C. However, a sustained response is achieved in less than 40% of all treated cases. Retreatment of relapsers or non-responders usually fails. Thymosin alpha 1 (Ta-1) is a polypeptide with immunomodulatory properties that has been suggested to increase response rates in patients with chronic hepatitis C. The aim of present study was to evaluate the efficacy of a novel triple regimen which includes Ta-1 for relapsers and non-responders to the combination of TA-1 and ribavirin. Methods: In the present study, 11 patients who relapsed …

Bankruptcy Law And Inefficient Entitlements, Irit Haviv-Segal Oct 2004

Bankruptcy Law And Inefficient Entitlements, Irit Haviv-Segal

ExpressO

The question as to the justification of bankruptcy law remains unanswered. The literature tends to emphasize the conflict and inability to compromise between the different normative outlooks of the insolvency law system. A deeper reflection on the existing theories of bankruptcy law reveals, however, that all theories share the same starting point: All theories share the understanding that efficiency considerations justify the enforcement of contractual bankruptcy arrangements. When the social theories call for increased levels of coercion and redistribution, these theories rely on normative considerations of distributive justice and rehabilitation values. They by no means rely on efficiency grounds. This …

Bayesian Hierarchical Distributed Lag Models For Summer Ozone Exposure And Cardio-Respiratory Mortality, Yi Huang, Francesca Dominici, Michelle L. Bell Oct 2004

Bayesian Hierarchical Distributed Lag Models For Summer Ozone Exposure And Cardio-Respiratory Mortality, Yi Huang, Francesca Dominici, Michelle L. Bell

Johns Hopkins University, Dept. of Biostatistics Working Papers

In this paper, we develop Bayesian hierarchical distributed lag models for estimating associations between daily variations in summer ozone levels and daily variations in cardiovascular and respiratory (CVDRESP) mortality counts for 19 U.S. large cities included in the National Morbidity Mortality Air Pollution Study (NMMAPS) for the period 1987 - 1994.

At the first stage, we define a semi-parametric distributed lag Poisson regression model to estimate city-specific relative rates of CVDRESP associated with short-term exposure to summer ozone. At the second stage, we specify a class of distributions for the true city-specific relative rates to estimate an overall effect by …

Evaluation Of Extent And Bioavailability Of Chromium Contamination Near An Abandoned Strip Mine, C. Appel, J. Stuckey, A. Cosley, R. Donald, C. Griffith, S. Lager, M. Perry, T. Ray, P. Smith

Earth and Soil Sciences

Chromium is a potentially toxic element to plants and animals commonly associated with serpentine and anthropogenic sources. An abandoned Cr strip-mine at US National Guard Camp SLO, CA containing serpentinitic parent material was tested for total and bioavailable Cr in the soil and overlying vegetation via US EPA Methods 3050a (Total Cr) and 1311 (Total Characteristic Leaching Procedure, TCLP) (US EPA, 1995), respectively. The analysis of total and bioavailable Cr was used to assess the risk of nearby surface and groundwater contamination and to evaluate the site’s need for remediation. In addition, trends in soil Cr levels with respect to …

Hyperownership In A Time Of Biotechnological Promise: The International Conflict To Control The Building Blocks Of Life, Sabrina Safrin Oct 2004

Hyperownership In A Time Of Biotechnological Promise: The International Conflict To Control The Building Blocks Of Life, Sabrina Safrin

Rutgers Law School (Newark) Faculty Papers

This article addresses the corrosive interplay between the patent-based and the sovereign- based systems of ownership of genetic material. In patent-based systems, genetic material is increasingly “owned” by corporations or research institutions which obtain patents over such material. In sovereign-based systems, the national government owns or extensively controls such material. As more patents issue for synthesized genes in developed countries through the patent system, more raw genetic material is legally enclosed by the governments of developing nations, which house most of the world’s wild or raw genetic material. This interactive spiral of increased enclosure results in the sub-optimal utilization, conservation …

Haki Dan Masyarakat Lokal Indonesia, Agus Sardjono

Indonesian Journal of International Law

There are several substansial problems remain on intellectual property rights in the local society of Indonesia. The needed for protection of intellectual property did not come from the civil society itself but from the pressure of external factor. Intellectual Property Regime is also known as capitalistic regime and that is the problem. The protection is given to the one who own the right, not for the real author. The characteristic of intellectual property is to protect individually. In the other hand, the background of local society of Indonesia, which consists of many tribes, lived based on communalistic. The opposite of …

Memahami "Cultural Studies" Dan Multikulturalisme Dari Perspektif Pascamodern, Akhyar Yusuf Lubis Oct 2004

Memahami "Cultural Studies" Dan Multikulturalisme Dari Perspektif Pascamodern, Akhyar Yusuf Lubis

Wacana, Journal of the Humanities of Indonesia

Cultural studies is a study of culture, the paradigm of which is quite different from that of the conventional (i.e. modern) studies. If we accept this view, it means that the whole problem of cultural reality, epistemology, and methodology cannot be used to understand and investigate cultural studies and multiculturalism. The infeasibility of using conventional study of culture to apprehend cultural studies and multiculturalism is related with the principle of incommensurability between those two fields, so there are different worldviews and rules (language games) between the two. This difference is vividly showed in character and model of study that conceives …

Aspek Hukum Masalah Pengungsi Internasional, Sri Setianingsih Suwardi Oct 2004

Aspek Hukum Masalah Pengungsi Internasional, Sri Setianingsih Suwardi

Indonesian Journal of International Law

Under international law, a State may refuse to accord entry permit to its territory for aliens. However, there is always a possibility that under certain circumstances an alien enters a State without having any permit as it is in the case of refugee. Refugees have the right to be given protection as attached to their refugee status. The refugee rights for protection by the host state is included in various regional and international treaties such as Conventin relating the Status of Refugee 1951 and Protocol relating the Status of Refugee 1967. In reality, the refugee problem is more complex as …

Promotion Of Refugee Law In Indonesia, Enny Soeprapto

Indonesian Journal of International Law

The effort to introduce the refugee law has been started since 1981 in Indonesia and has been intensified since 1998 which resulted several progresses. It can be seen implicitly under Law No, 37 Years 1999 on International Relations. Moreover, there are several national regulations that can be related with the refugee issue, such as; Prime Minister Circular Letter Number 11 Years 1956 on Protection of Asylum Seekers, Presidential Decree Number 38 Years 1979 on Coordination of Resolving the Vietnam’s refugees in Indonesia, and Presidential Decree Number 3 Years 2001 on National Coordinating Board for the Management Disaster and Refugees. Pengungsi Dalam Kerangka Kebijakan Keimigrasian Indonesia Kini Dan Yang Akan Datang, Ajat Sudrajat Havid

Indonesian Journal of International Law

Being a transtitory destination, Indonesia has been drawn into the problem of refugees. Since 1979, when Vietnam was tormented by war, up to the recent times, when tumoil and instability erupted in the Middle East and South East, thousands refugees have fled their countries and Indonesia has received the clausative predicaments of their being illegally stranded in Indonesian territory. Indonesia is not a paty to the 1951 The UN Convention relating to the Status of Refugees and its Protocol of 1967. That being the case, Indonesia is not the legal obligations of the convention. However, Indonesia has established a strong …
