Supreme Court Review Of The Foreign Trade Antitrust Improvements Act: A Case Of A Misleading Question?, Joshua P. Davis

AN ATTORNEY DEFENDING a deposition may at times raise a relatively obscure objection-that the interlocutor has asked a "misleading question." The objection is appropriate when any answer will provide erroneous information. The classic example is, "Have you stopped beating your wife?" As a useful book on the topic explains, "If the witness answers [']yes,['] the implication is that he at one time did beat his wife; if he answers 'no,' it sounds as though he continues to beat her." The query calls naturally for one of two responses and both are misleading.

The Nature Of Consent In The American Republic: Substance Or Procedure? The Elections Clause And Singlemember Congressional Districts, Robert Alexander Schwartz

FOR MOST OF the last 162 years, Congress has regulated the "manner" of congressional elections by imposing a requirement that its members be elected from single-member districts. In doing so, it has presumed to exercise its authority under Article I, Section 4, the "Elections Clause," of the Constitution, which provides: The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of ch[oo]sing Senators.

AS WITH ALL other contracts, the goal of insurance policy interpretation is to give effect to the mutual intention of the parties. This is a difficult goal to achieve based on the fact that most insurance policies utilize standardized forms, which are rarely bargained for or negotiated by the parties, and which often contain ambiguous terms and provisions. Who's Minding The Nonprofit Store: Does Sarbanes-Oxley Have Anything To Offer Nonprofits?, Jane Heath

IN JUNE OF 2003, nonprofit public benefit corporation PipeVine, processor of charitable donations for dozens of charities, closed its doors, admitting it did not have enough funds to distribute what it owed to its clients. The California attorney general filed suit and the San Francisco Superior Court appointed a receiver to take over the affairs of the corporation. The receiver's preliminary report indicates PipeVine (formerly known as United Nonprofit Operations or "UNO") likely owed over $18 million, with cash and assets worth just over $3 million, placing PipeVine among the most costly nonprofit failures ever. The Workers’ Compensation Steering Committee of the National Academy of Social Insurance formed the Benefit Adequacy Study Panel to review the literature on benefit adequacy and to develop an approach to document what is currently known—and not known—about benefit adequacy in WC programs. The panel documents the extent to which WC cash benefits replace workers’ lost wages, and assesses the adequacy of that wage replacement.
