In the Blackfeet Tribal Court, in a personal injury tort claim by Bear Child (“Plaintiff”) against Siyeh Development inc, the Blackfeet Tribe, First American Insurance Group, and five separate John Does (collectively “Defendants”), the Court denied a motion to dismiss the claim on the grounds of sovereign immunity. The claim arose from a fall in one of the Tribe’s Bingo halls/casinos.

Defendants cited Oklahoma v. Manufacturing Technologies, 532 U.S. 751, stating that “Indian tribes enjoy sovereign immunity from civil suits on contracts whether those contracts involve governmental or commercial activities... a tribe is subject to suit only where Congress has …

Bear Child, a member of the Blackfeet Tribe, was injured in a fall at one of the Tribe’s casino/bingo halls. Bear Child filed a personal injury suit against the Tribe, the Siyeh corporation which runs the casino/bingo hall, and First Americans Insurance, Siyeh’s insurer. The defendants moved to dismiss the case on the grounds of sovereign immunity. Siyeh argued that it is a department of the Tribe, entitling it to sovereign immunity. The Trial Court was unpersuaded by the defendants’ arguments for sovereign immunity. The Court held that the Tribe was acting in its corporate, not governmental capacity in relation …

Wave Scattering From Infinite Cylindrical Obstacles Of Arbitrary Cross-Section, Matthew B. Weber

In this work the scattering of an incident plane wave propagating along a plane perpendicular to the xy-plane is studied. The wave is scattered from an infinitely long cylindrical object of arbitrary cross-section. Due to the arbitrary geometry of the obstacle, a finite differences numerical method is employed to approximate the solution of the scattering problems. The wave equation is expressed in terms of generalized curvilinear coordinates. Boundary conforming grids are generated using elliptic grid generators. Then, a explicit marching in time scheme is implemented over these grids. It is found that as time grows the numerical solution converges to …

Hucr, A Novel Uric Acid-Responsive Member Of The Marr Family Of Transcriptional Regulators From Deinococcus Radiodurans, Steven P. Wilkinson, Anne Grove

Faculty Publications

The MarR family of transcriptional regulators comprises a subset of winged helix DNA-binding proteins and includes numerous members that function in environmental surveillance of aromatic compounds. We describe the characterization of HucR, a novel MarR homolog from Deinococcus radiodurans that demonstrates phenolic sensing capabilities. HucR binds as a homodimer to a single site within its promoter/operator region with Kd = 0.29 ± 0.02 nM. The HucR binding site contains a pseudopalindromic sequence, composed of 8-bp half-sites separated by 2 bp. The location of the HucR binding site in the intergenic region between hucR and a putative uricase suggests a mechanism …
