After the September 11th attacks in 2001, Congress hastily passed the USA-Patriot Act which made several changes to electronic surveillance law. The Act has sparked a fierce debate. However, the pros and cons of the USA-Patriot Act are only one part of a much larger issue: How effective is the law that regulates electronic surveillance?
The USA-Patriot Act made a number of changes in electronic surveillance law, but the most fundamental problems with the law did not begin with the USA-Patriot Act. The Confucian tradition has often been credited with a strong allegiance to the value of community. It recognizes that certain goods might be attained through special forms of human association, but not by any solitary individual. Are such community goods attained at the expense of the liberty of individual members? Philosophers have struggled with the tension between liberty and community since the dawn of Western philosophy. Aristotle complained about the false idea of liberty as "doing what one likes," which is contradictory to the true interests of the polis.2 Such lib- erty, or rather license, is undoubtedly detrimental to any …

During the period from June 2002 to July 2003, the Court of Appeals for the Fifth Circuit decided twenty-two appeals originating in eight federal district courts. Certainly, the greater majority of the insurance appeals involved recurring substantive and procedural conflicts. Major disagreements about the interpretation and enforcement of insurance contracts were before the court. Also, federal preemption questions and conflicts over subject-matter jurisdiction appeared in several cases. Furthermore, the Fifth Circuit addressed one case of first impression, and on remand from the Supreme Court, the appellate court modified and reinstated portions of a vacated opinion. Geographic Relationships Of Pocket Gophers In Southeastern Colorado, David C. Lovell, William R. Whitworth, Jerry R. Choate, Steven J. Bissell, Michael P. Moulton, Justin D. Hoffman
Transactions of the Nebraska Academy of Sciences and Affiliated Societies
Distributional patterns of the four species of pocket gophers in southeastern Colorado are variously parapatric, allopatric, or sympatric. More specifically, Geomys bursarius is parapatric with Thomomys talpoides, Thomomys bottae, and Cratogeomys castanops; T. bottae is both sympatric and parapatric with C. castanops; and both C. castanops and T. bottae are allopatric with T. talpoides. Geomys bursarius is restricted to sandy soils and soils of cultivated or otherwise disturbed habitats. Cratogeumys castanops and T. bottae occupy a wide variety of soils but are found most commonly in compacted rangeland soils. Thomomys talpoides is found in well-drained …

The Matt Christopher Papers consist of published manuscripts, published short stories (1943-1994) (drafts, synopses, plot outlines, and magazines, comics, and newspapers with articles and short stories), galleys (1954-1990s), leather bound author’s editions (1954-1991), and publisher’s editions of Matt Christopher’s children’s books (1954-2004). The purpose of this planning report is to present problems threatening downtowns and explore a variety of solutions for restoring the downtown core. A downtown is the heart of the city. If it is not operating well the rest of the city is affected. I have a stake in this planning report since I am an artist passionate about historic preservation and appreciative of ethnic diversity. These elements are crucial for downtown success. When they are coupled with good business and planning strategies downtowns cannot help but come back.

If it could be seen that a 'body of training' has a crucial impact on a creative practice, my own history of 'training' would be difficult to trace within any specific discipline or mode of self-expression. I have been 'trained' as a visual artist, actor, performance-artist, and to some extent, musician/sonic performer. This coexistence of modalities with associated meta-praxis, has in fact created a set of parallel dimensions embodied within a collective of theories as well as practices. These newly arrived suburbanites exchange their multidimensional urban city views for those of a carefully constructed and intensely controlled pastoral view. This view from their windows is one that symbolizes their ownership of the land and their freedom from dense urban living conditions. The open space and grass function as powerful reminders of why they live in suburbia. But what would occur if the suburbanites were to exchange their view of plastic Eden with images from the city? The research encompasses an analysis of Paradigms of practice, material as content, historical precedents, social and political conditions relative to the project themes and corresponding theoretical discourse. It reflects issues of domesticity and familial relationships, memory, narrative and the use of specific materials and methods sympathetic to these concerns. Aspects of the practices of Eva Hesse and Marcel Duchamp have been considered to contextualise and differentiate the creative work. The research also attempts to define and position the artworks through relative critical evaluation of contemporary art practices.

The second millennium has brought with it a new era of modern surgery. The creation of video surgery is as revolutionary to this century as the development of anesthesia and sterile technique was to the last one. With ten years of solid experience behind them, surgeons can now confidently approach almost every part of the human body with cameras and video monitors. Today more than 90% of all gallbladder surgery is performed laparoscopically, leaving patients with only four tiny marks and minimal discomfort. The Universidad Iberoamericana - UNIBE- has been using strategies to attract and maintain graduates' involvement within the university. Furthermore, UNIBE has invested financial and marketing efforts to continue being part of their lives. After attracting alumni, the association's intention is to maintain their interest and focus on enhancing customer satisfaction and customer value. The purpose of the present study is to evaluate the customer service delivered by the alumni office to 2,371 Dominican graduates so far reached. Will Employment Discrimination Class Actions Survive?, Melissa Hart

Recent years have witnessed increasing attacks on the appropriateness of certification of employment discrimination class action claims. The shift is often attributed to amendments to federal antidiscrimination laws in the Civil Rights Act of 1991. This paper argues, however, that the changes wrought by the 1991 amendments need not pose a barrier to resolution of employment discrimination claims through class litigation. The addition of compensatory and punitive damages and a jury-trial right may increase the level of scrutiny and perhaps the level of judicial involvement necessary in an employment discrimination class action. But they do not render such a class …

With All Deliberate Speed: Civil Human Rights Litigation As A Tool For Social Change, Beth Van Schaack

It has been said that Filártiga v. Pena-Irala is the Brown v. Board of Education of human rights litigation. Like Brown, Filártiga presents one of those rare breakthrough moments in law. In Filártiga, the Second Circuit confirmed that victims of human rights abuses abroad could seek legal redress in United States courts under the then-obscure Alien Tort Statute (ATS). Filártiga thus inaugurated a steady line of cases in U.S. courts invoking the ATS and related statutes to adjudicate international human rights claims. For a variety of reasons, including the very existence of these statutes, civil litigation has emerged as a …
