So Much Activity, So Little Change: A Reply To The Critics Of Battered Women's Self-Defense, Kit Kinports Jan 2004

So Much Activity, So Little Change: A Reply To The Critics Of Battered Women's Self-Defense, Kit Kinports

Faculty Scholarship

Prior to 1970, the term "domestic violence" referred to ghetto riots and urban terrorism, not the abuse of women by their intimate partners. Today, of course, domestic violence is a household word. After all, it has now been ten years since the revelation of football star O.J. Simpson's history of battering purportedly sounded "a wake-up call for all of America"; ten years since Congress enacted legislation haled as "a milestone . . .truly a turning point in the national effort to break the cycle" of violence; and twenty years since Farrah Fawcett's portrayal of Francine Hughes in the movie The …

Toward A Constitutional Regulation Of Minors' Access To Harmful Internet Speech, Dawn C. Nunziato Jan 2004

Toward A Constitutional Regulation Of Minors' Access To Harmful Internet Speech, Dawn C. Nunziato

GW Law Faculty Publications & Other Works

In this article, I scrutinize Congress's recent efforts to regulate access to sexually-themed Internet speech. The first such effort, embodied in the Communications Decency Act, failed to take into account the Supreme Court's carefully-honed obscenity and obscenity-for-minors jurisprudence. The second, embodied in the Child Online Protection Act, attended carefully to Supreme Court precedent, but failed to account for the geographic variability in definitions of obscene speech. Finally, the recently-enacted Children's Internet Protection Act apparently remedies the constitutional deficiencies identified in these two prior legislative efforts, but runs the risk of being implemented in a manner that fails to protect either …

The Tyranny Of Time: Vulnerable Children, Bad Mothers, And Statutory Deadlines In Parental Termination Proceedings, Catherine J. Ross Jan 2004

The Tyranny Of Time: Vulnerable Children, Bad Mothers, And Statutory Deadlines In Parental Termination Proceedings, Catherine J. Ross

GW Law Faculty Publications & Other Works

This paper explores issues raised by the Adoption and Safe Families Act of 1997 (ASFA) and contends that the Act may have unwittingly harmed some children and mothers by creating a categorical imperative that a child's health and safety must be a paramount consideration in child welfare decisions. After discussing the reforms made by the Act, this paper analyzes hard cases, in particular cases involving substance abusing mothers and battered mothers, and concludes that in some instances children's interests in these cases might be better served by a flexible standard where the child asserts a claim to a continued relationship …

The Digital Person: Technology And Privacy In The Information Age (Introduction), Daniel J. Solove

GW Law Faculty Publications & Other Works

THE DIGITAL PERSON: TECHNOLOGY AND PRIVACY IN THE INFORMATION AGE (ISBN: 0814798462) (NYU Press 2004) explores the social, political, and legal implications of the collection and use of personal information in computer databases. In the Information Age, our lives are documented in digital dossiers maintained by hundreds (perhaps thousands) of businesses and government agencies. These dossiers are composed of bits of our personal information, which when assembled together begin to paint a portrait of our personalities. The dossiers are increasingly used to make decisions about our lives - whether we get a loan, a mortgage, a license, or a job; …

Hiv/Aids Related Stigma In Sub-Saharan Africa: Context And Consequences, Chinyelu B. Okafor, Barbara Holder Jan 2004

Hiv/Aids Related Stigma In Sub-Saharan Africa: Context And Consequences, Chinyelu B. Okafor, Barbara Holder

International Journal of Global Health and Health Disparities

While HIV infection has been a worldwide epidemic, minority and poor rural groups the world over have been disproportionately affected by the disease. People of color have been most affected, particularly in rural areas of sub-Saharan Africa and the United States. HIV/AIDS is a highly stigmatized disease, and the stigma attached to the disease has fed into, and in many ways strengthened, pre-existing stigma and prejudice against certain groups in the society. This paper gives an analysis of factors that create and sustain such stigma in rural communities, with particular reference to Nigeria, which is Africa's most populous country. The …

Istart: Interactive Strategy Training For Active Reading And Thinking, Danielle S. Mcnamara, Irwin B. Levinstein, Chutima Boonthum

Computer Science Faculty Publications

Interactive Strategy Training for Active Reading and Thinking (iSTART) is a Web-based application that provides young adolescent to college-age students with high-level reading strategy training to improve comprehension of science texts. iSTART is modeled after an effective, human-delivered intervention called self-explanation reading training (SERT), which trains readers to use active reading strategies to self-explain difficult texts more effectively. To make the training more widely available, the Web-based trainer has been developed. Transforming the training from a human-delivered application to a computer-based one has resulted in a highly interactive trainer that adapts its methods to the performance of the students. The …

Regulating Teenage Abortion In The United States: Politics And Policy, Carol Sanger Jan 2004

Regulating Teenage Abortion In The United States: Politics And Policy, Carol Sanger

Faculty Scholarship

Thirty-four US states currently require pregnant minors either to notify their parents or get their consent before having a legal abortion. The Supreme Court has upheld the constitutionality of theses statutes provided that minors are also given an alternative mechanism for abortion approval that does not involve parents. The mechanism used is the 'judicial bypass hearing' at which minors persuade judges that they are mature and informed enough to make the abortion decision themselves. While most minors receive judicial approval, the hearings intrude into the most personal aspects of a young woman's life. The hearings, while formally civil in nature, …

Factors Influencing The Accuracy Of Task Completion Time Estimates, Kevin Edward Thomas Jan 2004

Factors Influencing The Accuracy Of Task Completion Time Estimates, Kevin Edward Thomas

School of Psychology Theses

Whilst considerable research has found that people tend to underestimate their task completion times (e.g., Buehler et al., 1994), factors that might influence the accuracy of temporal predictions have received little empirical treatment. The research presented in this thesis identified two distinct factors that mediated time estimation accuracy and bias. One factor was task duration, whereas the other factor was the person’s prior experience of the task. There was evidence that having prior experience of performing all or a substantial part of the same task enabled participants to more accurately estimate its duration. Additionally, predictions were more accurate when participants …

Affordance, Attention And Laterality, Lari Vainio Jan 2004

Affordance, Attention And Laterality, Lari Vainio

School of Psychology Theses

This thesis examines object-guided actions. Recently, micro-affordance effects have shown that a visual object affords actions automatically. These effects are observed when the grasp type (precision and power grasp) is facilitated by size (small and large) of the categorized object (the object-size effect), or when right or left hand responses are facilitated by object orientation (the object-orientation effect). It has been shown elsewhere that attentional mechanisms have a vital role in visually guided movements. In addition, visually guided movements have associated with hemispheric lateralization. Thus, the central focus of the thesis was the role of different components of attention (location-based-, …

Deconstructing The Tower Of London : Resolution, Alternatives And Executive Function, Hassina Carder-Gilbert Jan 2004

Deconstructing The Tower Of London : Resolution, Alternatives And Executive Function, Hassina Carder-Gilbert

School of Psychology Theses

Although widely employed as an executive task, the performance demands of the Tower of London task (TOL) are not well understood. The aim of this Thesis is to determine what TOL measures and seven studies are included that illustrate its performance demands. Much of the work is experimental and TOL is explored via a novel verification paradigm in which participants make speeded judgements about whether a demonstrated move is optimal or suboptimal. The deconstruction of the task to the level of the individual move indicated that the number of moves until a disk was placed in its goal position (resolution) …

True To Character: Honoring The Intellectual Foundations Of The Character Evidence Rule In Domestic Violence Prosecutions, Andrew King-Ries Jan 2004

True To Character: Honoring The Intellectual Foundations Of The Character Evidence Rule In Domestic Violence Prosecutions, Andrew King-Ries

Faculty Law Review Articles

This article calls for a new character evidence rule allowing the admission of prior acts of abuse within the context of a current domestic violence prosecution. Section II discusses the history of domestic violence in America and explores the three ways that the law has condoned domestic violence, including implicit sanction through the effect of the character evidence rule. Section III examines the intellectual background of the character evidence ban. This section also explores the conflict between the character evidence rule and the law's recognition of domestic violence. Further, Section III demonstrates how the character evidence ban violates its underlying …

Salesperson Listening: A Replication And Extension Of The Ilps Scale, Stephen B. Castleberry, Rick Ridnour, C. David Shepherd

Faculty Articles

The primary purpose of this study was further testing of the ILPS scale (Castleberry, et al. 1999). The sample consisted of 101 salespeople from three business-to-business farms in the Midwest. In addition to the ILPS exhibiting good reliability, results are consistent with prior research indicating a significant positive relationship between listening ability and salesperson performance. Results also found a significant positive relationship between listening ability and adaptability and age. Contrary to past salesperson listening research, females were found to be better listeners than men, and there was no significant relationship between listening and salesperson experience. Implications for managers and researchers …

The Effect Of Assistive Technology Staff Development On Improving Reading Of Intermediate Grade Students With Learning Disabilities, Verna R. Benjamin-Lambert Jan 2004

The Effect Of Assistive Technology Staff Development On Improving Reading Of Intermediate Grade Students With Learning Disabilities, Verna R. Benjamin-Lambert

Abraham S. Fischler College of Education ETD Archive

A 3-year review of Pow Elementary School’s test scores showed that there was a decline in reading scores on standardized tests. The IOWA test results in 2000 and the Stanford 9 and the Georgia Criterion Competency Test results in 2001 and 2002 showed a decline in reading comprehension. The decline in test results among students with learning disabilities was even more significant. A 2-year comparison of test score results on the Georgia Criterion Competency Test of students with reading disabilities in Grades 3, 4, and 5 showed that 76% did not meet state standards in school year 2001 and 100% …

"You Are Entering A Gay And Lesbian Free Zone": On The Radical Dissents Of Justice Scalia And Other (Post-) Queers – [Raising Questions About Lawrence, Sex Wars, And The Criminal Law], Bernard Harcourt

Faculty Scholarship

The most renowned substantive criminal law decision of the October 2002 Term, Lawrence v. Texas, will go down in history as a critical turning point in criminal law debates over the proper scope of the penal sanction. For the first time in the history of American criminal law, the United States Supreme Court has declared that a supermajoritarian moral belief does not necessarily provide a rational basis for criminalizing conventionally deviant conduct. The Court's ruling is the coup de grâce to legal moralism administered after a prolonged, brutish, tedious, and debilitating struggle against liberal legalism in its various criminal …

Destabilization Rights: How Public Law Litigation Succeeds, Charles F. Sabel, William H. Simon Jan 2004

Destabilization Rights: How Public Law Litigation Succeeds, Charles F. Sabel, William H. Simon

Faculty Scholarship

"Public law litigation" – civil rights advocacy seeking to restructure public agencies - has changed course over the last three decades. It has moved away from remedial intervention modeled on command-and-control bureaucracy toward a kind of intervention that can be called "experimentalist." Instead of top-down, fixed-rule regimes, the experimentalist approach emphasizes ongoing stakeholder negotiation, continuously revised performance measures, and transparency. Experimentalism is evident in all the principal areas of public law intervention – schools, mental health institutions, prisons, police, and public housing. This development has been substantially unanticipated and unnoticed by both advocates and critics of public law litigation. In …

Madisonian Equal Protection, James S. Liebman, Brandon L. Garrett Jan 2004

Madisonian Equal Protection, James S. Liebman, Brandon L. Garrett

Faculty Scholarship

James Madison is considered the "Father of the Constitution," but his progeny disappointed him. It had no effective defense against self-government's "mortal disease" – the oppression of minorities by local majorities. This Article explores Madison's writings in an effort to reclaim the deep conception of equal protection at the core of his constitutional aspirations. At the Convention, Madison passionately advocated a radical structural approach to equal protection under which the "extended republic's" broadly focused legislature would have monitored local laws and vetoed those that were parochial and "unjust." Rejecting this proposal to structure equal protection into the "interior" operation of …

Which Aspects Of Time Are The Most Effective When Analyzing And Implementing Schedules For Student Instruction, Sarah Beth Peiffer Jan 2004

Which Aspects Of Time Are The Most Effective When Analyzing And Implementing Schedules For Student Instruction, Sarah Beth Peiffer

Theses

For many years, educators have researched the correlation between student achievement and instructional time. In this study, allocated time, engaged time, and academic learning time will be researched at Walt Disney Elementary in Marceline, Missouri. Through research studies, teacher surveys, and building schedules, the researcher will conclude aspects needed to improve instructional time and student achievement at Walt Disney Elementary.

Teacher perception and opinions are paramount. Classroom teachers completed a questionnaire to address specific strengths and weaknesses within the current scheduling theory. Teacher input regarding administrative requests for information and peripheral job duties were questioned as to their impact on …
