Folktales Of International Justice, David Luban Jan 2004

Folktales Of International Justice, David Luban

Georgetown Law Faculty Publications and Other Works

When Laura Dickinson asked me to participate on this panel, she very nicely said that she hoped I could bring a different perspective to the discussion. I thought I knew what she meant. The other panelists share a profound knowledge of how international criminal-law institutions work. My "different perspective" would therefore be the perspective of abject ignorance.

Taking comfort from the Socratic dictum that there is wisdom in knowing what you do not know, I accepted the invitation because it gives me the opportunity to pose questions rather than proposing answers. I will raise my questions by examining some stories …

Sunsetting Judicial Opinions, Neal K. Katyal Jan 2004

Sunsetting Judicial Opinions, Neal K. Katyal

Georgetown Law Faculty Publications and Other Works

Contemporary constitutional law, in its quest for judicial restraint, has primarily focused on "the how" of judging - what interpretive methods will constrain the decisionmaker? This Article, by contrast, focuses on the "when"- if there are reasons to think that today's judicial decisions might later prove to be problematic, then are there methods that alter the timing of those decisions' impact to produce better outcomes? This Article outlines one new method for judicial decisionmaking in the post-9/11 world. Informed by pervasive legislative practices, I contend that the Supreme Court should prospectively declare that some of its national security opinions will …

Leaders, Followers, And Free Riders: The Community Lawyer’S Dilemma When Representing Non-Democratic Client Organizations, Michael R. Diamond, Aaron O'Toole Jan 2004

Leaders, Followers, And Free Riders: The Community Lawyer’S Dilemma When Representing Non-Democratic Client Organizations, Michael R. Diamond, Aaron O'Toole

Georgetown Law Faculty Publications and Other Works

This article will explore various aspects of the dissonance between the democratic ideal and the reality of groups in disenfranchised and disempowered communities. We will discuss the intersection of democracy and community action by examining the sociology of groups and the social psychology of leaders and followers. We will also examine the role of, and choices presented to, an attorney working in a community and for local community groups.

Money Demand Stability Under Currency Substitution: Some Recent Evidence, Santi Chaisrisawatsuk, Subhash C. Sharma, Abdur Chowdhury Jan 2004

Money Demand Stability Under Currency Substitution: Some Recent Evidence, Santi Chaisrisawatsuk, Subhash C. Sharma, Abdur Chowdhury

Economics Faculty Research and Publications

This study deals with the issue of independent monetary policy and the stability of the domestic money demand function in the presence of currency substitution and capital mobility in five Asian economies. It is argued that money demand will be less stable and more difficult to control in the presence of international variables. The money demand function is derived using the portfolio balance approach. The results from the cointegration analysis reveal that capital mobility and currency substitution are significant factors in the domestic money demand equations for Indonesia, Korea, Malaysia, Singapore, and Thailand. The results also show that the US …

Gasoline Prices, State Gasoline Excise Taxes, And The Size Of Urban Areas, James Mcgibany Jan 2004

Gasoline Prices, State Gasoline Excise Taxes, And The Size Of Urban Areas, James Mcgibany

Economics Faculty Research and Publications

A monocentric model of land use that assumes urban spatial size is determined by a set of exogenous variables is employed to test the hypothesis that urban land size is negatively related to gasoline prices. Using a model from Brueckner and Fansler (1983), the amount of urbanized land area is shown to be a function of population, income, agricultural land prices and commuting costs. The latter is measured as the price of gasoline, broken into two components; the amount of any state gasoline excise tax imposed plus the total price paid by consumers minus such a tax. Using 1990 data, …

Peoples Union For Civil Liberties V Union Of India: Is Indian Democracy Dependent On A Statute?, Shubhankar Dam Jan 2004

Peoples Union For Civil Liberties V Union Of India: Is Indian Democracy Dependent On A Statute?, Shubhankar Dam

Research Collection Yong Pung How School Of Law

What is the status of a right to vote in the Indian legal system? Is the right a constitutional/fundamental right? Or is it simply a statutory right? Contrary to the decisions of the Supreme Court in the last five decades, this paper argues that the right to vote is a constitutional right: its textual foundation may be located in Article 326. And, in this sense, the Supreme Court has erred in construing the right to vote as a statutory right under the Representation of Peoples Act, 1951. Interpreting the right to vote as a statutory right has larger implications for …

Empirical Correlations Of Global Solar Radiation With Meteorological Data For Onne, Nigeria, Louis E. Akpabio, Sunday O. Udo, Sunday E. Etuk Jan 2004

Empirical Correlations Of Global Solar Radiation With Meteorological Data For Onne, Nigeria, Louis E. Akpabio, Sunday O. Udo, Sunday E. Etuk

Turkish Journal of Physics

Multiple linear regression models were developed to estimate the monthly average daily global solar radiation using ten parameters during a period of sixteen years (1984 to 1999) for Onne, Nigeria; the extraterrestrial radiation, average daily temperature, ratio of minimum and maximum daily temperature, relative humidity, ratio of sunshine duration, solar declination, average soil temperature, average pan evaporimeter, average rain fall and average daily dew. Even though up to ten variable correlations has been developed; the results showed that eight variable correlations with the highest value of correlation coefficient R gives the best result when considering the error terms (mean percentage …

Determination Of The Rotational Constant A_0 And The Bending Angle Cnc For Ch_3 Nc And Ch_3 ^{15}Nc Molecules, Mohammad Al-Share Jan 2004

Determination Of The Rotational Constant A_0 And The Bending Angle Cnc For Ch_3 Nc And Ch_3 ^{15}Nc Molecules, Mohammad Al-Share

Turkish Journal of Physics

The rotational constant A_0 for the ground state of CH_3 NC and CH_3 ^{15}NC isotopomers is calculated using a technique which was used earlier for CH_3CCH [9], CH_3CN [10] and SiH_3CCH [11]. This technique is based on calculating the moment of inertia tensors in the bent configuration due to the \nu_8 vibrational state, which is associated with the CNC bending vibration. These values of the moments of inertia are fitted with the values calculated from the rotational constant B_V, found experimentally by measuring the rotational frequencies in the microwave and infrared regions. From the fitting, the rotational constant A_0, the …

A Framework For Decision Support In Information Systems Security, Omar F. El-Gayar, Brian D. Fritz Jan 2004

A Framework For Decision Support In Information Systems Security, Omar F. El-Gayar, Brian D. Fritz

Research & Publications

As the structure of modern organizations shifts, so correspondingly must the methodologies which underlie the evaluation and development of the security posture of their information systems. We have witnessed an ever-growing gap between organizational policy and technology. We have also witnessed an ever increasing complexity of decisions regarding the planning and design of IS security. Within this paper, we propose a decision support framework consistent with security and decision theory and develop a model of the decision analysis space suitable for multiple criteria decision making (MCDM). The adoption of MCDM techniques within the context of this model can show inherent …

Business Process Re-Engineering And Information Security Planning: Opportunities For Integration, Omar F. El-Gayar, Brian D. Fritz

Research & Publications

Business process re-engineering (BPR) has come to recognize a need for the adoption of socio-technical methodologies and capabilities for knowledge representation of qualitative concerns. Security planning and decision-making has a similar need, and furthermore socio-technical methods common to BPR can be usefully applied in this capacity. The introduction of security models like Defense-in- Depth and similar efforts to recognize the organizational impact of security planning in operational security management serve as an initial step in educating security personnel and provide a more comprehensive view, but unfortunately, security decision-making has traditionally relied almost solely upon quantitative risk assessment, cost/benefit mechanisms, and …

Application Of Fuzzy Logic To Multiple Criteria Decision Making In Aquacultural Planning, Omar F. El-Gayar Jan 2004

Application Of Fuzzy Logic To Multiple Criteria Decision Making In Aquacultural Planning, Omar F. El-Gayar

Research & Publications

The field of regional planning is characterized by the large number of issues and attributes involved, and regional planning for aquaculture development is no exception. Moreover, aquacultural plans do not have clearly defined objectives and require information that, if exist, is often imprecise and uncertain. This paper applies fuzzy set theory to multiple criteria decision making (MCDM) in aquaculture planning. In effect, the paper demonstrates how fuzzy set theory can be used to explicitly account for the inherent uncertainty encountered when planning for aquaculture development in a given region. A case study for regional aquaculture planning in Northern Egypt demonstrates the …

A Preliminary Analysis Of The Amendments To The Japanese Secured Transaction Law, Wei Zhang Jan 2004

A Preliminary Analysis Of The Amendments To The Japanese Secured Transaction Law, Wei Zhang

Research Collection Yong Pung How School Of Law

The collapse of the Japanese asset price bubble in the 90's left a record amount of non-performing loans in the nation's financial system. To tackle this unprecedented crisis, both legal scholars and practitioners in Japan advocated for a series of amendments to its secured transaction law to facilitate the enforcement of mortgages by banks. In this paper, based on the state of the post-bubble real estate finance market, I discussed the major drawbacks of the existing Japanese secured transaction system as it was applied in the real estate arena. I commented on the proposed material amendments to the Japanese secured …

Development Of An In-Situ Hydrothermal Dissolved Carbon Dioxide Sensor For Hydrothermal Environments, Brooke Love Jan 2004

Development Of An In-Situ Hydrothermal Dissolved Carbon Dioxide Sensor For Hydrothermal Environments, Brooke Love

Link Foundation Ocean Engineering and Instrumentation Fellowship Reports

Hydrothermal systems at mid ocean ridges are a unique environment which connect the mantle, lithosphere, ocean, and biosphere in one complex system. Fluid chemistry is one key tool in understanding this environment, and carbon dioxide is the most abundant gas in these fluids. Its relative abundance and the information it can give about the magmatic activity, which is one of the ultimate drivers of these systems, and other processes, make it an attractive target for development of an in-situ sensor. This work has shown that attenuated total reflection (ATR) is a promising technique for in situ carbon dioxide measurements under …
