The Entrepreneurship Effect: An Accidental Externality In The Federal Income Tax, Leandra Lederman Jan 2004

The Entrepreneurship Effect: An Accidental Externality In The Federal Income Tax, Leandra Lederman

Articles by Maurer Faculty

Case law and commentators sometimes speak as if all income-producing activities are taxed similarly. However, that simply is not true for individuals. Although the expenses and losses of business activities generally are deductible from income of any source and net losses can be carried to other tax years, individuals' investment expenses and losses generally are deductible only from investment income. Although many of the provisions restricting investment-related deductions were enacted at different times, and each one has its own rationale, the combined effect of these provisions on individual investors is a systematic preference for business losses over investment losses.

Predictions And Prescriptions For The Endangered Species Act, Robert L. Fischman Jan 2004

Predictions And Prescriptions For The Endangered Species Act, Robert L. Fischman

Articles by Maurer Faculty

The thirtieth anniversary of the enactment of the modern Endangered Species Act (ESA) offers an irresistible excuse to suggest changes that are needed to set the statute, and the larger project of environmental protection, on course for greater effectiveness. The 1973 ESA is novel in its approach and reach, in that it reflects both the resource management and pollution control traditions in environmental law. Its evolution indicates broader trends in the legal landscape of environmental law.

Making predictions about the future of the ESA is a daunting task. Most predictions made thirty years ago about the statute proved to be …

Contemplating Failure And Creating Alternatives In The Balkans: Bosnia's Peoples, Democracy And The Shape Of Self-Determination, Timothy W. Waters Jan 2004

Contemplating Failure And Creating Alternatives In The Balkans: Bosnia's Peoples, Democracy And The Shape Of Self-Determination, Timothy W. Waters

Articles by Maurer Faculty

A decade after Dayton, Bosnia is a fictive, failed state held together by outsiders' weapons and outsiders' will. All parties recognize that Bosnia's current constitutional dispensation is dysfunctional and are calling for change, but how should the international community respond? In deciding, we should recognize that we may owe Bosnians much, but we owe Bosnia nothing.

This Article argues that traditional self-determination doctrine is unable to justify either further claims for secession from Bosnia or Bosnia's own original secession. It examines the processes used by the international community to frame the dissolution of Yugoslavia and the recognition process for Bosnia, …

Rebuilding The Closet: Bowers V. Hardwick, Lawrence V. Texas, And The Mismeasure Of Homosexual Historiography, Jody L. Madeira Jan 2004

Rebuilding The Closet: Bowers V. Hardwick, Lawrence V. Texas, And The Mismeasure Of Homosexual Historiography, Jody L. Madeira

Articles by Maurer Faculty

In an effort to engage in such specification, this paper will first address the mischaracterization of history in Bowers, which portrays the historic legal and ecclesiastical penalties of what the Court labels as "homosexual activities" as a continuous, unitary narrative extending from the halls of the Emperors Theodosius and Justinian to the legislative assembly rooms of Georgia and Texas. This illusory perspective portrays the criminalization of sodomy (and therefore the identity of homosexuality itself) as an impossible cultural continuum. The impossibility of this continuum lies not only in its implicit assumption that states and other lawmaking entities throughout history shared …

Livestock Depredations By Black Vultures And Golden Eagles, Michael L. Avery, J. L. Cummings Jan 2004

Livestock Depredations By Black Vultures And Golden Eagles, Michael L. Avery, J. L. Cummings

United States Department of Agriculture Wildlife Services: Staff Publications

Black Vulture: The available evidence suggests that black vultures act as typical predators by seeking and disabling vulnerable animals prior to overwhelming and killing them (Gluesing et al., 1980). These birds take the path of least resistance and eat carrion when it is available. Black vultures are opportunists, however, and when the chance arises, they will attack and eat defenseless live animals. Defenseless does not necessarily mean sick or injured. Healthy newborn livestock are defenseless, especially if the mother is exhausted or otherwise not able to care for and protect the offspring. In assessing the role of black vultures as …

Evaluation Of A Deer-Activated Bioacoustic Frightening Device For Reducing Deer Damage In Cornfields, Jason M. Gildorf, Scott E. Hygnstrom, Kurt C. Vercauteren, Greg M. Clements, Erin E. Blankenship, Richard M. Engeman Jan 2004

Evaluation Of A Deer-Activated Bioacoustic Frightening Device For Reducing Deer Damage In Cornfields, Jason M. Gildorf, Scott E. Hygnstrom, Kurt C. Vercauteren, Greg M. Clements, Erin E. Blankenship, Richard M. Engeman

United States Department of Agriculture Wildlife Services: Staff Publications

Deer (Odocoileus spp.) can cause substantial damage to agricultural crops, resulting in economic losses for producers. We developed a deer-activated bio-acoustic frightening device to reduce white-tailed deer (O. virginianus) damage in agricultural fields. The device consisted of an infrared detection system that activated an audio component which broadcast recorded distress and alarm calls of deer. We tested the device against unprotected controls in cornfields during the silking–tasseling stage of growth in July 2001. The device was not effective in reducing damage: track-count indices (F1,4=0.02, P=0.892), corn yield (F1,9=1.27, P=0.289), and estimated damage levels (F1,10=0.87, P=0.374) did not differ between experimental …

Predacides For Canid Predation Management, K. A. Fagerstone, J. J. Johnston, P. J. Savarie

United States Department of Agriculture Wildlife Services: Staff Publications

Throughout the livestock industry in the western United States, control of canid predators was considered to be of considerable importance to the livestock industry, especially to sheep producers, who sufkred high losses from coyotes and wolves. In the 19th century, the demand for predator control was communicated to Congress and the western state assemblies, with the result that predator control was provided in western states by the Fedcral Bureau of Biological Survey in cooperation with state agencies, and by trappers hired by stockmen. Steel traps and poisons were the principal methods used for predator control during the early years of …

Sympathy And Approbation In Hume And Smith: A Solution To The Other Rational Species Problem, David M. Levy, Sandra J. Peart Jan 2004

Sympathy And Approbation In Hume And Smith: A Solution To The Other Rational Species Problem, David M. Levy, Sandra J. Peart

Jepson School of Leadership Studies articles, book chapters and other publications

This paper examines a key implication of the different conceptions of sympathy and the approbation associated with sympathy in the writings of David Hume and Adam Smith. For Hume, sympathy is an empathy we feel for those like us and hence we are motivated to obtain the praise or approbation of those with whom we sympathize. In Hume’s construction there is a direct link from sympathy to motivation because sympathy is reflected self-love. By contrast, in Smith’s construction sympathy is an act of imagination which only habit makes motivational. The abstraction by our imagination means we earn the approbation (or …

On The "Bitter Quarrel" Between Economics And Its Enemies, Sandra J. Peart Jan 2004

On The "Bitter Quarrel" Between Economics And Its Enemies, Sandra J. Peart

Jepson School of Leadership Studies articles, book chapters and other publications

Economics has long had its enemies. The question is, why? What, precisely, is it about economics that its critics oppose? William Coleman seeks to tell the story of «anti-economics», «to take its measure» (p. 3), and then finally to defend economics from these attacks. His is a broad, sweeping study that uses a wide lens, panoramically over time, to survey the opposition. The crisis in economics, edited by Edward Fullbrook, provides us instead with a detailed snapshot of a recent sort of anti-economics - the Post-Autistic Economics (PAE) movement that originated among French economics students in 2000. Both serve to …

Survivable Virtual Topology Routing Under Shared Risk Link Groups In Wdm Networks, Ajay Todimala, Byrav Ramamurthy Jan 2004

Survivable Virtual Topology Routing Under Shared Risk Link Groups In Wdm Networks, Ajay Todimala, Byrav Ramamurthy

School of Computing: Conference and Workshop Papers

Network survivability is one of the most important issues in the design of optical WDM networks. In this work we study the problem of survivable routing of a virtual topology on a physical topology with Shared Risk Link Groups (SRLG). The survivable virtual topology routing problem against single-link failures in the physical topology is proved to be NP-complete in [1]. We prove that survivable virtual topology routing problem against SRLG/node failures is also NP-complete. We present an improved integer linear programming (ILP) formulation (in comparison to [1]) for computing the survivable routing under SRLG/node failures. Using an ILP solver, we …

An Analysis Of Mcmc Sampling Methods For Estimating Weighted Sums In Winnow, Qingping Tao, Stephen Scott Jan 2004

An Analysis Of Mcmc Sampling Methods For Estimating Weighted Sums In Winnow, Qingping Tao, Stephen Scott

School of Computing: Technical Reports

Chawla et al. introduced a way to use the Markov chain Monte Carlo method to estimate weighted sums in multiplicative weight update algorithms when the number of inputs is exponential. But their algorithm still required extensive simulation of the Markov chain in order to get accurate estimates of the weighted sums. We propose an optimized version of Chawla et al.’s algorithm, which produces exactly the same classifications while often using fewer Markov chain simulations. We also apply three other sampling techniques and empirically compare them with Chawla et al.’sMetropolis sampler to determine how effective each is in drawing good samples …

Rerouting Schemes For Dynamic Traffic Grooming In Optical Wdm Mesh Networks, Wang Yao, Byrav Ramamurthy Jan 2004

Rerouting Schemes For Dynamic Traffic Grooming In Optical Wdm Mesh Networks, Wang Yao, Byrav Ramamurthy

School of Computing: Conference and Workshop Papers

Traffic grooming in optical WDM mesh networks is a two-layer routing problem to effectively pack low-rate connections onto high-rate lightpaths, which, in turn, are established on wavelength links. In this work, we employ the rerouting approach to improve the network throughput under the dynamic traffic model. We propose two rerouting schemes, rerouting at lightpath level (RRAL) and rerouting at connection level (RRAC). A qualitative comparison is made between RRAL and RRAC. We also propose the critical-wavelength-avoiding one-lightpath-limited (CWA-1L) and critical-lightpath-avoiding one-connection-limited (CLA-1C) rerouting heuristics, which are based on the two rerouting schemes respectively. Simulation results show that rerouting reduces the …

Maximizing Resource Sharing In Wdm Mesh Networks With Path-Based Protection And Sparse Oeo Regeneration, Xi Yang, Byrav Ramamurthy, Lu Shen Jan 2004

Maximizing Resource Sharing In Wdm Mesh Networks With Path-Based Protection And Sparse Oeo Regeneration, Xi Yang, Byrav Ramamurthy, Lu Shen

School of Computing: Conference and Workshop Papers

We propose a resource-sharing scheme that supports three kinds of sharing scenarios in a WDM mesh network with path-based protection and sparse OEO regeneration. Several approaches are used to maximize the sharing of wavelength-links and OEO regenerators.

Survivable Traffic Grooming With Path Protection At The Connection Level In Wdm Mesh Networks, Wang Yao, Byrav Ramamurthy Jan 2004

Survivable Traffic Grooming With Path Protection At The Connection Level In Wdm Mesh Networks, Wang Yao, Byrav Ramamurthy

School of Computing: Conference and Workshop Papers

Survivable traffic grooming (STG) is a promising approach to provide reliable and resource-efficient multigranularity connection services in wavelength division multiplexing (WDM) optical networks. In this paper, we study the STG problem in WDM mesh optical networks employing path protection at the connection level. Both dedicated protection and shared protection schemes are considered. Given the network resources, the objective of the STG problem is to maximize network throughput. To enable survivability under various kinds of single failures such as fiber cut and duct cut, we consider the general shared risk link group (SRLG) diverse routing constraints. We first resort to the …

Survivable Traffic Grooming With Differentiated End-To-End Availability Guarantees In Wdm Mesh Networks, Wang Yao, Byrav Ramamurthy Jan 2004

Survivable Traffic Grooming With Differentiated End-To-End Availability Guarantees In Wdm Mesh Networks, Wang Yao, Byrav Ramamurthy

School of Computing: Conference and Workshop Papers

Traffic grooming is critical in WDM optical metropolitan area networks (MANS), where low-rate connections are packed onto high-rate wavelength paths (lightpaths). Various applications in the MAN demand different levels of reliability. Therefore, it is necessary to provision connections with differentiated reliability guarantees in the MAN. In this paper, we first present an analytical model to calculate the availability of connections using different protection schemes in WDM optical MANs with general mesh topologies. Then we propose and simulate two grooming algorithms which can provision availability guaranteed connections based on per-connection requirements.

A Load-Balancing Spare Capacity Reallocation Approach In Service-Rich Sonet Metro Mesh Networks, Lu Shen, Xi Yang, Byrav Ramamurthy Jan 2004

A Load-Balancing Spare Capacity Reallocation Approach In Service-Rich Sonet Metro Mesh Networks, Lu Shen, Xi Yang, Byrav Ramamurthy

School of Computing: Conference and Workshop Papers

The next-generation SONET metro network is evolving into a service-rich infrastructure. At the edge of such a network, multi-service provisioning platforms (MSPPs) provide efficient data mapping enabled by Generic Framing Procedure (GFP) and Virtual Concatenation (VC). The core of the network tends to be a meshed architecture equipped with Multi-Service Switches (MSSs). In the context of these emerging technologies, we propose a load-balancing spare capacity reallocation approach to improve network utilization in the next-generation SONET metro networks. Using our approach, carriers can postpone network upgrades, resulting in increased revenue with reduced capital expenditures (CAPEX). For the first time, we consider …

Designing A Mixed Methods Study In Primary Care, John W. Crewell, Michael D. Fetters, Nataliya V. Ivankova

Department of Educational Psychology: Faculty Publications

BACKGROUND Mixed methods or multimethod research holds potential for rigorous, methodologically sound investigations in primary care. The objective of this study was to use criteria from the literature to evaluate 5 mixed methods studies in primary care and to advance 3 models useful for designing such investigations.

METHODS We first identified criteria from the social and behavioral sciences to analyze mixed methods studies in primary care research. We then used the criteria to evaluate 5 mixed methods investigations published in primary care research journals.

RESULTS Of the 5 studies analyzed, 3 included a rationale for mixing based on the need …

Using Transcendental Phenomenology To Explore The “Ripple Effect” In A Leadership Mentoring Program, Tammy Moerer-Urdahl, John W. Creswell Jan 2004

Using Transcendental Phenomenology To Explore The “Ripple Effect” In A Leadership Mentoring Program, Tammy Moerer-Urdahl, John W. Creswell

Department of Educational Psychology: Faculty Publications

Several approaches exist for organizing and analyzing data in a phenomenological qualitative study. Transcendental phenomenology, based on principles identified by Husserl (1931) and translated into a qualitative method by Moustakas (1994), holds promise as a viable procedure for phenomenological research. However, to best understand the approach to transcendental phenomenology, the procedures need to be illustrated by a qualitative study that employs this approach. This article first discusses the procedures for organizing and analyzing data according to Moustakas (1994). Then it illustrates each step in the data analysis procedure of transcendental phenomenology using a study of reinvestment or the “ripple effect” …

Configuration Of Traffic-Responsive Plan Selection System Parameters And Thresholds: Robust Bayesian Approach, Montasir M. Abbas, Anuj Sharma Jan 2004

Configuration Of Traffic-Responsive Plan Selection System Parameters And Thresholds: Robust Bayesian Approach, Montasir M. Abbas, Anuj Sharma

Department of Civil and Environmental Engineering: Faculty Publications

Traffic-responsive plan selection (TRPS) is one of the two major closed-loop system modes of operation. The TRPS mode is more beneficial than its competitor (time-of-day mode) because of its ability to accommodate abnormal traffic conditions such as incidents, special events, and holiday traffic. However, no guidelines are available for optimal setup of TRPS systems. Improper configuration of a TRPS system can result in inefficient system performance or unstable operation in which the closed-loop system operates in a perpetual transitioning state. The TRPS mechanism implemented in current traffic signal controllers is described, and a Bayesian-based methodology for selecting an optimal set …

Midwest Guardrail System For Standard And Special Applications, Ronald K. Faller, Karla A. Polivka, Beau D. Kuipers, Robert W. Bielenberg, John D. Reid, John R. Rohde, Dean L. Sicking Ph.D.

Department of Civil and Environmental Engineering: Faculty Publications

Development, testing, and evaluation of the Midwest Guardrail System were continued from the original research started in 2000. This new strong-post W-beam guardrail system provides increased safety for impacts with higher-center-of-mass vehicles. Additional design variations of the new system included stiffened versions using reduced (half and quarter) post spacings as well as a standard guardrail design configured with a concrete curb 152 mm (6 in.) high. All full-scale vehicle crash tests were successfully performed in accordance with the Test Level 3 requirements specified in NCHRP Report 350: Recommended Procedures for the Safety Performance Evaluation of Highway Features. The research …
