Distribution Of The Subspecies Of Great Horned Owls In Texas, Robert W. Dickerman

Bulletin of the Texas Ornithological Society

This study analyzes the distribution of two subspecies of Great Horned Owls—B. v. virginianus and B. v. pallescens—across Texas using 157 specimens. Results show that their ranges align with distinct habitat types, especially hardwood and pine-oak forests for virginianus and xeric environments for pallescens.

The Barton Springs Salamander Catastrophic Spill Plan describes when and how endangered salamanders would be protected or rescued should a catastrophic spill occur in the Barton Spring watershed. The best response to any particular spill depends on a variety of factors, thus an effective spill response plan requires a method to determine thresholds that will elicit each tier of salamander rescue efforts. This plan focuses primarily on developing response tiers for gasoline, since it is considered to be the most common problematic spilled material with high toxicity and the potential for very large spills., The method developed for gasoline is …

A new numerical ground-water-flow model (Edwards aquifer model) that incorporates important components of the latest information and plausible conceptualization of the Edwards aquifer was developed. The model includes both the San Antonio and Barton Springs segments of the Edwards aquifer in the San Antonio region, Texas, and was calibrated for steady-state (1939–46) and transient (1947–2000) conditions, excluding Travis County. Transient simulations were conducted using monthly recharge and pumpage (withdrawal) data. The model incorporates conduits simulated as continuously connected (other than being separated in eastern Uvalde and southwestern Medina Counties), one-cell-wide (1,320 feet) zones with very large hydraulic-conductivity values (as much …

What Does The Public Get? Experimental Use And The Patent Bargain, Katherine J. Strandburg

This article deals with the increasing tension between the tradition of protecting commercially valuable inventions through patenting and the need for a robust public domain of freely available technical information as a springboard for further research. The "experimental use exemption," permitting some unauthorized research uses of patented inventions, might be used to relieve some of this tension. However, the scope of the research exemption has been shrunk so far by recent Federal Circuit opinions that even basic university research is not excused from infringement liability. In Defense Of The "Old" Public Health: The Legal Framework For The Regulation Of Public Health, Richard A. Epstein

The traditional forms of public health law were directed largely toward communicable diseases and other externalities, such as pollution, with negative health impacts. The more modern view treats any health issue as one of public health so long as it affects large numbers of individuals, and this definition includes such matters as obesity and diabetes. This paper examines the historical and constitutional evolution of the public health principle as it moved from the narrower to the broader conception. It then argues that the narrower principle better defines the appropriate scope of coercive government intervention than the broader definition, which could …

Current thinking about trademark law is dominated by economic analysis, which views the law as a system of rules designed to promote informational efficiencies. Yet the economic analysis has failed to explain, because it is unequipped to do so, a number of concepts of fundamental importance in the law, most notably the concepts of trademark "distinctiveness" and trademark "dilution." This article proposes that a more robust understanding of trademark law may be achieved by viewing the law through the lens of semiotics, a systems-theoretical field of knowledge, of which structural linguistics forms a part, dedicated to the study of signs …
