Lessons From And For "Disabled" Students, Sharon E. Rush Apr 2004

Lessons From And For "Disabled" Students, Sharon E. Rush

UF Law Faculty Publications

The traditional understanding of "disabled" means to have a physical, mental, or emotional limitation. It is unfortunate that the word has negative connotations because we all have the ability to do some things and not others. An individual's disabilities, traditional or otherwise, do not diminish the person or detract from the universal tenet that all people are inherently equal and entitled to be treated with dignity. Generally, it is unproductive to compare the circumstances of one group with another for the purpose of discerning which group has it better or worse. Struggles by different groups to achieve equality have different …

Prosecutor Circumvents The Sixth Amendment Right To Counsel With A Simple Wink And Nod, The, Daniel E. Kirsch

Missouri Law Review

This Note argues that the Eighth Circuit's decision in United States v. Johnson severely limits a defendant's protections against the government's intentional use of implicit, or "wink and nod," agreements with undercover informants to circumvent the right to counsel. Although the court's decision may further the interests of effective law enforcement, the resulting sacrifices of fair play in the adversarial justice system is too costly for society to bear.

Avoiding A Manifest Injustice: Missouri Decides Not To Execute The Actually Innocent, Ryan Edward Shaw

Missouri Law Review

This Note will examine State ex rel. Amrine v Roper in light of the decision in Herrera and the subsequent cases; cases in which states made determination about state habeas relief in response to the ruling of the United State Supreme Court. In granting habeas relief to Amrine, the Missouri Supreme Court changed previous law that would have allowed Amrine to be executed despite having persuasive evidence of actual innocence.

Prosecutorial Misconduct In Capital Cases In The Commonwealth Of Kentucky: A Research Study 1976-2000, Roberta M. Harding, Bankole Thompson Apr 2004

Prosecutorial Misconduct In Capital Cases In The Commonwealth Of Kentucky: A Research Study 1976-2000, Roberta M. Harding, Bankole Thompson

Law Faculty Scholarly Articles

The prosecutor wields tremendous power within the American criminal justice system. When that power is misused-particularly in capital cases-tremendous injustices are perpetrated. Yet, occurrences of prosecutorial misconduct seem to occur with distressing regularity. An exhaustive study covering appeals from 1973-95 revealed that two-thirds of overturned death penalties in the United States resulted from overzealous police and prosecutors who withheld exculpatory evidence. Our study covered 55 Kentucky cases from 1976-2000 and found evidence of prosecutorial misconduct in nearly one-half of them, often with several instances per case.

Charterwithout Borders? The Supreme Court Of Canada, Transnational Crime And Constitutional Rights And Freedoms, Robert J. Currie Apr 2004

Charterwithout Borders? The Supreme Court Of Canada, Transnational Crime And Constitutional Rights And Freedoms, Robert J. Currie

Dalhousie Law Journal

The first decades of the Supreme Court of Canada's Charter jurisprudence have coincided roughly with an increase in the extent to which Canada is affected by transnational crime and the nation s consequential participation in inter-state efforts to combat it. The Court itself has remarked on its discrete "jurisprudence on matters involving Canada's international co-operation in criminal investigations and prosecutions." This article examines the Court s adoption of a different approach to Charter analysis in cases involving transnational elements and surveys where the Court has "drawn the line" in terms of Charter application. By way of analyzing jurisprudence on exclusion …

A Comparative Study Of Factors Related To Adoption, Management, And Impact Of Police Consolidation And Amalgamation In Norfolk, County, England, And Kent And Ottawa Counties, Michigan, United States, Terry Lee Fisk

Dissertations

The evolution of law enforcement in the United States has created a circumstance where thousands of smaller communities are served by a police agency, some of which may not have the capability or resources to provide adequate police service. Many of these are agencies operate within a geographical area where they are joined by common boundaries, yet each operates as an autonomous police force. One possible solution to this quandary is to consolidate those existing agencies experiencing difficulties in the provision of police services into single, larger departments with combined resources.

The purpose of this research was to determine what …
